[386] وأخبرنا (3) أَبُو الْحُسَيْنِ بْنُ بِشْرَانَ، أنا أَبُو عَمْرٍو ابْنُ السَّمَّاكِ، ثنا حَنْبَلُ بْنُ إِسْحَاقَ، ثنا عَلِيُّ بْنُ الْمَدِينِيِّ، قَالَ: سَمِعْتُ يَحْيَى، قَالَ: قَالَ شُعْبَةُ. فَذَكَرَ بِنَحْوِهِ.

[387] أخبرنا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ، أنا أَبُو الْحَسَنِ الدَّارَقُطْنِيُّ الْحَافِظُ، قَالَ: انْفَرَدَ بِهِ أَبُو خَالِدٍ عَنْ قَتَادَةَ، وَلَا يَصِحُّ (4). وَقَالَ أَبُو عِيسَى التِّرْمذِيُّ: سَأَلْتُ مُحَمَّدَ بْنَ إِسْمَاعِيلَ الْبُخَارِيَّ عَنْ هَذَا الْحَدِيثِ، فَقَالَ: هَذَا لَا شَيْءٌ، رَوَاهُ سَعِيدُ بْنُ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنِ ابْنِ عَبَّاسٍ قَوْلَهُ، وَلَمْ يَذْكُرْ فِيهِ أَبَا الْعَالِيَةِ، وَلَا أَعْرِفُ لِأَبِي خَالِدٍ الدَّالَانِيِّ سَمَاعًا مِنْ قَتَادَةَ (1) (2). وَقَالَ أَبُو حَاتِمٍ فِي كِتَابِ الْمَجْرُوحِينَ: يَزِيدُ بْنُ عَبْدِ الرَّحْمَنِ أَبُو خَالِدٍ الدَّالَانِيُّ مِنْ أَهْلِ وَاسِطٍ، كَانَ كَثِيرَ (3) الْخَطَأِ، فَاحِشَ الْوَهَمِ، يُخَالِفُ الثِّقَاتِ فِي الرِّوَايَاتِ، حَتَّى إِذَا سَمِعَهَا الْمُبْتَدِئُ فِي هَذِهِ الصِّنَاعَةِ عَلِمَ أَنَّهَا مَعْمُولَةٌ أَوْ مَقْلُوبَةٌ، لَا يَجُوزُ الِاحْتِجَاجُ بِهِ إِذَا وَافَقَ الثِّقَاتِ، فَكَيْفَ إِذَا انْفَرَدَ عَنْهُمْ بِالْمُعْضَلَاتِ؟ ! (4)

[389] حدثنا أبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ، أنا أحْمَد بْنُ مُحَمَّدِ بْنِ رُمَيْحٍ الْحَافِظُ، ثنا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ، ثنا يَزِيدُ بْنُ مَوْهَبٍ، ثنا إِسْحَاقُ بْنُ عَبْدِ الْوَاهِبِ (8)، ثنا دَاوُدُ بْنُ الزِّبْرِقَانِ، عَنْ سُلَيْمَانَ التَّيْمِيِّ، عَنْ أَنَسٍ (1) قَالَ: قَالَ رَسُولُ اللَّهِ - صلى الله عليه وسلم -: "إِذَا نَامَ الْعَبْدُ فِي سُجُودِهِ بَاهَى اللَّهُ بِهِ مَلَائِكَتَهُ، يَقُوُل: انْظُرُوا إِلَى عَبْدِي، رُوحُهُ عِنْدِي وَجَسَدُهُ فِي طَاعَتِي" (2). لَيْسَ هَذَا بِالْقَوِيِّ، ثُمَّ لَيْسَ فِيهِ أَنَّهُ لَا يَخْرُجُ بِهِ مِنْ صَلَاتِهِ، وَالْقَصْدُ مِنْهُ (3) - إِنْ صَحَّ - الثَّنَاءُ عَلَى الْعَبْدِ الْمُوَاظِبِ عَلَى الصَّلَاةِ حَتَّى يَغْلِبَهُ النَّوْمُ، وَقَدْ أُمِرَ فِي الرِّوَايَةِ الصَّحِيحَةِ عَنْ أَنَسٍ بِالِانْصِرَافِ إِذَا نَعَسَ. وَكَذَلِكَ حَدِيثُ ابْنِ عُمَرَ الَّذِي ذَكَرْنَاهُ (4) فِي أَوَّلِ الْمَسْأَلَةِ. فَأَمَّا إِذَا نَامَ قَاعِدًا مُسْتَوِيَ الْجُلُوسِ مُتَمَكِّنًا بِمَقْعَدَتِهِ مِنَ الْأَرْضِ، فَقَدْ قَالَ الشَّافِعِيُّ - رحمه الله -: وَأُحِبُّ لِلنَّائِمِ قَاعِدًا أَنْ يَتَوَضَّأَ، وَلَا يَبِينُ (5) أَنْ أُوجِبَهُ عَلَيْهِ؛ لِمَا رَوَى أَنَسُ بْنُ مَالِكٍ أَنَّ أَصْحَابَ رَسُولِ اللَّهِ - صلى الله عليه وسلم - كَانُوا يَنْتَظِرُونَ الْعِشَاءَ فَيَنَامُونَ - أَحْسَبُهُ قَالَ - قُعُودًا. وَعَنِ (6) ابْنِ عُمَرَ أَنَّهُ كَانَ يَنَامُ قَاعِدًا ويُصَلِّي وَلَا يَتَوَضَّأُ (7). أَمَّا حَدِيثُ أَنَسِ بْنِ مَالِكٍ:

[390] فأخبرناه أَبُو عَبْدِ اللَّهِ الْحَافِظُ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثنا إِبْرَاهِيمُ بْنُ مَرْزُوقٍ، ثنا أَبُو عَامِرٍ، ثنا شُعْبَةُ (ح). قَالَ: وَأَخْبَرَنِي أَبُو عَمْرِو بْنُ أَبِي جَعْفَرٍ، ثنا عِمْرَانُ بْنُ مُوسَى، ثنا أَبُو بَكْرِ بْنُ خَلَّادٍ، ثنا خَالِدُ بْنُ الْحَارِثِ، ثنا شُعْبَةُ، عَنْ قَتَادَةَ قَالَ: سَمِعْتُ أَنَسَ بْنَ مَالِكٍ يَقُولُ: كَانَ أَصْحَابُ رَسُولِ اللَّهِ - صلى الله عليه وسلم - يَنَامُونَ ثُمَّ يُصَلُّونَ وَلَا يَتَوَضَّئُونَ. قُلْتُ: أَسَمِعْتَهُ مِنْ أَنَسٍ؟ قَالَ: إِي وَاللَّهِ. ذِكْرُ السَّمَاعِ مِنْ خَالِدِ بْنِ الْحَارِثِ. أَخْرَجَهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ يَحْيَى بْنِ حَبِيبٍ عَنْ خَالِدِ بْنِ الْحَارِثِ (1).

[391] أخبرنا أَبُو عَبْدِ اللَّهِ الْحَافِظُ، ثنا أَبُو الْوَلِيدِ الْفَقِيهُ، ثنا عَبْدُ اللَّهِ بْنُ شِيرُويَهْ، ثنا أَبُو قُدَامَةَ، ثنا عَبْدُ الرَّحْمَنِ، ثنا شُعْبَةُ، فَذَكَرَهُ بِنَحْوِهِ. قَالَ عَبْدُ الرَّحْمَنِ يَعْنِي: وَهُمْ قُعُودٌ.لَيْسَ هَذَا بِالْقَوِيِّ، ثُمَّ لَيْسَ فِيهِ أَنَّهُ لَا يَخْرُجُ بِهِ مِنْ صَلَاتِهِ، وَالْقَصْدُ مِنْهُ (3) - إِنْ صَحَّ - الثَّنَاءُ عَلَى الْعَبْدِ الْمُوَاظِبِ عَلَى الصَّلَاةِ حَتَّى يَغْلِبَهُ النَّوْمُ، وَقَدْ أُمِرَ فِي الرِّوَايَةِ الصَّحِيحَةِ عَنْ أَنَسٍ بِالِانْصِرَافِ إِذَا نَعَسَ. وَكَذَلِكَ حَدِيثُ ابْنِ عُمَرَ الَّذِي ذَكَرْنَاهُ (4) فِي أَوَّلِ الْمَسْأَلَةِ. فَأَمَّا إِذَا نَامَ قَاعِدًا مُسْتَوِيَ الْجُلُوسِ مُتَمَكِّنًا بِمَقْعَدَتِهِ مِنَ الْأَرْضِ، فَقَدْ قَالَ الشَّافِعِيُّ - رحمه الله -: وَأُحِبُّ لِلنَّائِمِ قَاعِدًا أَنْ يَتَوَضَّأَ، وَلَا يَبِينُ (5) أَنْ أُوجِبَهُ عَلَيْهِ؛ لِمَا رَوَى أَنَسُ بْنُ مَالِكٍ أَنَّ أَصْحَابَ رَسُولِ اللَّهِ - صلى الله عليه وسلم - كَانُوا يَنْتَظِرُونَ الْعِشَاءَ فَيَنَامُونَ - أَحْسَبُهُ قَالَ - قُعُودًا. وَعَنِ (6) ابْنِ عُمَرَ أَنَّهُ كَانَ يَنَامُ قَاعِدًا ويُصَلِّي وَلَا يَتَوَضَّأُ (7). أَمَّا حَدِيثُ أَنَسِ بْنِ مَالِكٍ:

[392] وأخبرنا الْقَاضِي أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْحِيرِيُّ، ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أنا الرَّبِيعُ بْنُ سُلَيْمَانَ، أنا الشَّافِعِيُّ، أنا الثِّقَةُ، عَنْ حُمَيْدٍ، عَنْ أَنَسٍ قَالَ: كَانَ أَصْحَابُ رَسُولِ اللَّهِ - صلى الله عليه وسلم - يَنْتَظِرُونَ الصَّلَاةَ فَيَنَامُونَ - أَحْسَبُهُ قَالَ - قُعُودًا، حَتَّى تَخْفِقَ رُءُوسُهُمْ، ثُمَّ يُصَلُّونَ وَلَا يَتَوَضَّئُونَ (2).

قُعُودًا، حَتَّى تَخْفِقَ رُءُوسُهُمْ. ثُمَّ يُصَلُّونَ وَلَا يَتَوَضَّئُونَ ← كَانَ أَصْحَابُ رَسُولِ اللَّهِ يَنْتَظِرُونَ الصَّلَاةَ فَيَنَامُونَ أَحْسَبُهُ ← أَنَسٍ، ← حُمَيْدٍ ← الثِّقَۃُ ← الشَّافِعِیُّ ← الرَّبِيعُ بْنُ سُلَيْمَانَ، ← أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ← وأخبرنا الْقَاضِي أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ الْحِيرِيُّ،

[393] أخبرنا الْحَاكِمُ أَبُو عَبْدِ اللَّهِ الْحَافِظُ، قَالَ: إِذَا قَالَ الشَّافِعِيُّ: "أنا الثِّقَةُ، ثنا حُمَيْدٌ الطَّوِيلُ" فَإِنَّهُ يَكْنِي بِالثِّقَةِ عَنْ إِسْمَاعِيلَ بْنِ عُلَيَّةَ (3).

إِسْمَاعِيلُ بْنُ عُلَيَّةَ، ← حُمَيْدٌ الطَّوِيلُ" فَإِنَّهُ يَكْنِي بِالثِّقَةِ ← الثِّقَۃُ ← الشَّافِعِیُّ ← «إِذَا ← الحاكم أبو عبد الله الحافظ

[394] وَأَمَّا حَدِيثُ ابْنِ عُمَرَ: فأخبرناه أَبُو بَكْرٍ الْحِيرِيُّ وَأَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ، قَالَا: ثنا أَبُو الْعَبَّاسِ الْأَصَمُّ، أنا الرَّبِيعُ بْنُ سُلَيْمَانَ، أنا الشَّافِعِيُّ، أنا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ كَانَ يَنَامُ قَاعِدًا ثُمَّ يُصَلِّي وَلَا يَتَوَضَّأُ (1).

8. The Book of Zakat

An issue he did not mention (247): Whoever has to fast does not make it up with ability (1) until he dies, he will fast on his behalf if he wants, or feed him on his behalf according to what he said in the old (2).248. Rule (248): Whoever vows to fast on the Day of Sacrifice or the Day of Eid al-Fitr, his vow shall not be complied with (1).
10. Hajj book
    256. Rule (256): Whoever performs Hajj as a Muslim, then apostates and then embraces Islam, he is not obligated to perform Hajj again (1).257. Question (257): If a person is found for money, he is obliged to perform Hajj, and he has to hire someone to perform Hajj on his behalf (1).258. Question (258): Whoever dies after (1) the obligation to perform Hajj is obligatory for him (2), it shall be fulfilled on his behalf, and if he does not recommend it (3).259. 11. The Book of Obligations
    259. Question (259): Whoever does not perform the Hajj of Islam, his Hajj is not valid on behalf of someone else, and if he is forbidden on behalf of someone else then he falls for his obligation, and likewise everyone who has a obligatory Hajj (1).394. 108. Rule (108): It is not permissible to pray on the back of the Ka’bah, if the worshiper does not have any building of the Ka’bah in front of the worshiper (1).

250. Rule (250): If the insane person wakes up on some day in Ramadan, he does not have to make up for the past days of insanity (1). Abu Hanifa said: He has to make it up if his madness was a symptom and was not original (2).
251. Issue (251): It is makrooh to use the siwaak for one who is fasting with ashi (1).
252. Rule (252): Whoever breaks the fast during a voluntary fast (1) deliberately and does not make up for it (2).
