واخبرنا أبو الحسين بن الفضل القطان ، أنا عبد الله بن جعفر ، أنا يعقوب بن سفيان ، أنا ابن بشار ، أنا عبد الرحمن بن مهدي ، عن سفيان ، عن محمد بن مخلد ، عن رجل يقال له : الحكم ، عن ابن عباس قال : لا نكاح إلا بأربعة : ولي وشاهدين وخاطب .

وروينا عن أبي هريرة انه قال : لا تزوج المرأة المرأة ، ولا تزوج المرأة نفسها ، فإن الزانية هي التي تزوج نفسها ، وروي عنه هذا مرفوعا ( 3 ) .

وروينا عن عبد الرحمن بن القاسم ، عن أبيه قال : كانت عائشة تخطب إليها المرأة من اهلها ، فتشهد فإذا بقيت عقدة النكاح قالت لبعض أهلها : زوج فإن المرأة لا تلي عقد النكاح ( 1 ) .

وقد رواه عبيد الله بن عمر القواريري ، عن بشر بن منصور وعبد الرحمن بن مهدي وعبد الله بن داود الخريبي ، عن سفيان ، عن عبد الله بن عثمان بن خثيم ، عن سعيد بن جبير ، عن ابن عباس قال : قال رسول الله صلى الله عليه وسلم : ' لا نكاح إلا بولي مرشد ، أو سلطان ' . أخبرناه علي بن أحمد بن عبدان ، أنا سليمان بن أحمد الحافظ ، أنا أحمد بن القاسم بن مساور الجوهري ، أنا عبيد الله القواريري فذكره ( 1 ) .

وروي أيضا عن مومل بن إسماعيل ، عن سفيان مرفوعا ، والصحيح موقوف . ورواه عدي بن الفضل ، عن ابن خثيم بإسناده مرفوعا : ' لا نكاح إلا بولي وشاهدي عدل ، فإن انكحها ولي مسخوط عليه فنكاحها باطل ' وعدي بن الفضل غير قوي في الحديث ( 1 ) .

قال الشافعي رضي الله عنه : ' ولا يكون الكافر وليا لمسملة ، وقد زوج ابن سعيد بن العاص النبي صلى الله عليه وسلم أم حبيبة بنت أبي سفيان ، وأبو سفيان حي ، لأنها كانت مسلمة ، وابن سعيد يعني خالد بن سعيد مسلم ، ولم يكن لأبي سفيان فيها ولاية ، لأن الله تعالى قطع الولاية بين المسلمين والمشركين ' ( 2 ) . وكذلك لا يكون المسلم وليا للكافر ، قال الشافعي : ' إلا أمته فإن ما صار لها بالنكاح ' .

أخبرنا أبو عبد الله الحافظ ، أنا أبو الوليد الفقيه ، أنا محمد بن جرير الطبري ، أنا سعيد بن يحيى بن سعيد الاموي ، أنا ابي ، عن ابن جريج ، عن سلميان بن موسى ، عن الزهري ، عن عروة ، عن عائشة : أن النبي صلى الله عليه وسلم قال : ' أيما امرأة نكحت بغير إذن وليها وشاهدي عدل فنكاحها باطل ' وذكر الحديث . وهكذا رواه أبو يوسف محمد بن أحمد بن الحجاج الرقي ، وسليمان بن عمر بن خالد الرقي ، وعبد الرحمن بن يونس كلهم عن عيسى بن يونس ، عن ابن جريج ( 1 ) .
