وأما الغناء بغير عود فقد قال الشافعي رضي الله عنه في الرجل يغني فيتخذ الغناء صناعته ، يؤتى عليه ، ويأتي له ، ويكون منسوباً إليه مشهوراً به معروفاً ، أو المرأة : فلا تجوز شهادة واحد منهما ، وذلك أنه من اللهو المكروه الذي يشبه الباطل ، وأن من صنع هذا كان منسوباً إلى السَّفَه ، وسَقاطة المروءة ، ومن رضي هذا لنفسه كان مستخفاً ، وإن لم يكن محرماً بيِّن التحريم ( 2 ) .

أخبرنا أبو عبد الله الحافظ ، أنا أبو العباس محمد بن يعقوب ، أنا بكار بن قتيبة القاضي ، أنا صفوان بن عيسى القاضي ، أنا حميد الخراط ، عن عمار الدهني ، عن سعيد بن جبير ، عن أبي الصهباء ، عن ابن مسعود رضي الله عنه قال : ! ( ومن الناس من يشتري لهو الحديث ليضل عن سبيل الله ) ! [ لقمان : 6 ] قال : هو والله الغناء ( 3 ) .

أخبرنا أبو عبد الله الحافظ ، قال : أنا أبو العباس محمد ابن يعقوب ، أنا أحمد بن عبد الحميد الحارثي ، أنا أبو أسامة ، عن هشام ابن عروة ، عن أبيه ، عن عائشة - رضي الله عنها - قالت : دخل عليّ أبو بكر وعندي جاريتان من جواري الأنصار تُغَنِّيَان بما تقاولت الأنصار يوم بُعَاث . قالتْ : وليستا بمُغَنِّيَتَيْنِ . فقال أبو بكر رضي الله عنه : أبمَزْمُور الشيطان في بيت رسول الله ! - وذلك يوم عيد - فقال رسول الله : ' يا أبا بكر ! إن لكل قوم عيداً وهذا عيدنا ' ( 1 ) . وفي رواية الزهري ، عن عائشة في هذا الحديث : جاريتان في أيام منى تُغَنِّيان وتُدَفِّفَان وتضربان ( 1 ) .

أخبرنا أبو بكر محمد بن الحسين بن فورك ، قال : أنا عبد الله بن جعفر ، قال : أنا يونس بن حبيب ، أنا أبو داود ، أنا حماد ابن سلمة ، عن ثابت ، عن أنس رضي الله عنه قال : كان أنجشة يحدو بالنساء ، وكان البراء بن مالك يحدو بالرجال ، وكان أنجشة حسن الصوت ، كان إذا حدا أعنقت الإبل ، فقال رسول الله : ' ويحك يا أنجشة ! رويدك سوقاً بالقوارير ' ( 1 ) . أخبرنا أبو الحسن محمد بن الحسين العلوي ، أنا أبو بكر محمد بن الحسين القطان ، أنا أبو الأزهر السليطي ، أنا عبد الرزاق ، أنا معمر ، عن الزهري ، عن أنس قال : دخل رسول الله مكة ، وابن رواحة آخذ بغرزة وهو يقول : ( خلّوا بني الكفار عن سبيله ** اليوم نضربكم على تنزيله ) ( ضرباً يُزيل الهامَ عن مَقِيلِه ** ويُذْهِل الخليلَ عن خليلِه ) ( يا رب إني مؤمن بقِيلِه ) ( 1 ) .

أخبرنا أبو عبد الله الحافظ قال : أخبرني إسماعيل بن محمد بن الفضل الشعراني قال : أجبرني جدي ، ثنا إبراهيم بن حمزة ، أنا ابن أبي حازم ، عن يزيد بن الهاد ، عن محمد بن إبراهيم ، عن أبي سلمة ، عن أبي هريرة أنه سمع النبي يقول : ' ما أذِن الله لشيء ما أذِن لنبيٍّ حسنِ الصوت بالقرآن يجهر به ' ( 1 ) . ورواه الزهري عن أبي سلمة فقال في الحديث : ' ما أذن لنبي يتغنى بالقرآن ' وفي رواية أخرى : ' كأَذَنِه لنبي يتغنى بالقرآن ' ( 2 ) معناه يقرأه حدراً وتزيناً . هذا الذي يؤوله الشافعي .
