قال الشافعي : وأقل ما يكفي من الكسوة كل ما وقع عليه اسم كسوة من عمامة ، أوسراويل ، أو إزار ، أو مقنعة أو غير ذلك ( 1 ) . قال : وإذا أعتق في كفارة اليمين لم يجزه إلا رقبة مؤمنة ، ويجزئ ولد الزنا ، وكل ذي نقص بعيب لا يضر بالعمل إضراراً بينا ( 1 ) .

وأخبرنا أبو زكريا بن أبي إسحاق ، أنا أبو العباس الأصم ، أنا محمد بن عبد الله بن عبد الحكم ، أنا ابن وهب ، أنا مالك ابن أنس ، عن نافع ، أن عبد الله بن عمر كان يكفر عن يمينه بإطعام عشرة مساكين لكل إنسان منهم مد من حنطة ، وكان ليعتق المرة إذا وكد اليمين ( 1 ) .

وروينا عن ابن عباس ، وابن عمر ، وأبي هريرة رضي الله عنه في جواز إعتاق ولد الزنا في الكفارة ( 3 ) ، والذي روي عن النبي صلى الله عليه وسلم : ' ولد الزنا من الثلاثة ' ( 1 ) ۔ فقد روي في الحديث : ' إذا عمل بعمل أبويه ' والمحفوظ أنه من قول سفيان الثوري ( 1 ) .
