1923 - ، قال الشافعي رحمه الله وقد قيل : « هذه الآية في جميع المشركين ، ثم نزلت الرخصة بعدها في إحلال نكاح الحرائر من أهل الكتاب خاصة ، كما جاءت في إحلال ذبائح أهل الكتاب » قال الله تعالى : « اليوم أحل لكم الطيبات ، وطعام الذين أوتوا الكتاب حل لكم ، وطعامكم حل لهم ، والمحصنات من المؤمنات ، والمحصنات من الذين أوتوا الكتاب من قبلكم إذا آتيتموهن أجورهن » (1)

1927 - أخبرنا أبو زكريا بن أبي إسحاق ، أنا أبو الحسن الطرائفي ، ثنا عثمان بن سعيد ، ثنا عبد الله بن صالح ، عن معاوية بن صالح ، عن علي بن أبي طلحة ، عن ابن عباس ، في قوله « ومن لم يستطع منكم طولا أن ينكح المحصنات المؤمنات ، فمن ما ملكت أيمانكم من فتياتكم المؤمنات » (1) يقول : من لم تكن له سعة أن ينكح الحرائر ، فلينكح من إماء المؤمنين « ذلك لمن خشي العنت منكم » وهو الفجور فليس لأحد من الأحرار أن ينكح أمة (2) إلا أن لا يقدر على حرة وهو يخشى العنت وأن تصبروا عن نكاح الإماء فهو خير لكم « __________ (1) سورة : النساء آية رقم : 25 (2) الأمة : الجارية المملوكة
