أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " لا أَزَالُ أُقَاتِلُ النَّاسَ حَتَّى يَقُولُوا: لا إِلَهَ إِلا اللَّهُ، فَإِذَا قَالُوهَا فَقَدْ عَصَمُوا مِنِّي دِمَاءَهُمْ وَأَمْوَالَهُمْ إِلا بِحَقِّهَا وَحِسَابُهُمْ عَلَى اللَّهِ عَزَّ وَجَلَّ ".

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِذَا هَلَكَ كِسْرَى فَلا كِسْرَى بَعْدَهُ، وَإِذَا هَلَكَ قَيْصَرُ فَلا قَيْصَرَ بَعْدَهُ، وَالَّذِي نَفْسِي بِيَدِهِ لَتُنْفَقَنَّ كُنُوزُهُما فِي سَبِيلِ اللَّهِ تَعَالَى» . أَخْرَجَ الأَوَّلَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ، وَالثَّانِيَ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ، وَالثَّالِثَ مِنْ كِتَابِ الْجِزْيَةِ.

أَخْبَرَنَا سُفْيَانُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ قَالَ: مَنْ فَرَّ مِنْ ثَلاثَةٍ فَلَمْ يَفِرَّ وَمَنْ فَرَّ مِنَ اثْنَيْنِ فَقَدْ فَرَّ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الْجِزْيَةِ، وَالثَّانِيَ مِنْ كِتَابِ قِتَالِ الْمُشْرِكِينَ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا الثِّقَةُ، عَنْ مُحَمَّدِ بْنِ أَبَانٍ، عَنْ عَلْقَمَةَ بْنِ مَرْثَدٍ، عَنْ سُلَيْمَانَ بْنِ بُرَيْدَةَ، عَنْ أَبِيهِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ إِذَا بَعَثَ جَيْشًا أَمَّرَ عَلَيْهِمْ أَمِيرًا، وَقَالَ: «فَإِذَا لَقِيتَ عَدُوًّا مِنَ الْمُشْرِكِينَ فَادْعُهُمْ إِلَى ثَلاثِ خِلالٍ أَوْ ثَلاثِ خِصَالٍ، شَكَّ عَلْقَمَةُ، ادْعُهُمْ إِلَى الإِسْلامِ، فَإِنْ أَجَابُوكَ فَاقْبَلْ مِنْهُمْ وَكُفَّ عَنْهُمْ ثُمَّ ادْعُهُمْ إِلَى التَّحَوُّلِ مِنْ دَارِهِمْ إِلَى دَارِ الْمُهَاجِرِينَ، فَأَخْبِرْهُمْ إِنْ هُمْ فَعَلُوا أَنَّ لَهُمْ مَا لِلْمُهَاجِرِينَ، وَأَنَّ عَلَيْهِمْ مَا عَلَيْهِمْ فَإِنِ اخْتَارُوا الْمُقَامَ فِي دَارِهِمْ أَنَّهُمْ كَأَغْرَابِ الْمُسْلِمِينَ يَجْرِي عَلَيْهِمْ حُكْمُ اللَّهِ كَمَا يَجْرِي عَلَى الْمُسْلِمِينَ، وَلَيْسَ لَهُمْ فِي الْفَيْءِ شَيْءٌ إِلا أَنْ يُجَاهِدُوا مَعَ الْمُسْلِمِينَ، فَإِنْ لَمْ يُجِيبُوكَ فَادْعُهُمْ إِلَى أَنْ يُعْطَوُا الْجِزْيَةَ عَنْ يَدٍ وَهُمْ صَاغِرُونَ، فَإِنْ فَعَلُوا فَاقْبَلْ مِنْهُمْ وَدَعْهُمْ، فَإِنْ أَبَوْا فَاسْتَعِنْ بِاللَّهِ تَعَالَى وَقَاتِلْهُمْ» .

أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ، يَعْنِي: ابْنَ عَبْدِ اللَّهِ، عَنِ ابْنِ عَبَّاسٍ، عَنِ الصَّعْبِ بْنِ جَثَّامَةَ اللَّيْثِيِّ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُئِلَ عَنْ أَهْلِ الدَّارِ مِنَ الْمُشْرِكِينَ يَبِيتُونَ فَيُصَابُ مِنْ نِسَائِهِمْ وَأَبْنَائِهِمْ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «هُمْ مِنْهُمْ» ، وَرُبَّمَا قَالَ سُفْيَانُ فِي الْحَدِيثِ: «هُمْ مِنْ آبَائِهِمْ» . أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الرِّسَالَةِ وَالثَّانِيَ مِنْ كِتَابِ قِتَالِ الْمُشْرِكِينَ.
