أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ، عَنْ عَبْدِ الْعَزِيزِ بْنِ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عَمْرٍو، عَنْ مُحَمَّدِ بْنِ أَبِي بَكْرِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «تَجَافَوْا لِذَوِي الْهَيْئَاتِ عَنْ عَثَرَاتِهِمْ» .

قَالَ مُحَمَّدُ بْنُ إِدْرِيسَ: سَمِعْتُ مِنْ أَهْلِ الْعِلْمِ مِمَّنْ يَعْرِفُ هَذَا الْحَدِيثَ يَقُولُ: يُتَجَافَى لِلرَّجُلِ ذِي الْهَيْئَةِ مِنْ عَثْرَتِهِ مَا لَمْ يَكُنْ حَدًّا.

Muhammad ibn Idris said: I heard from the people of the world who know this hadith, saying: The man who has a sheep will be spared.

أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ أَبِي جَعْفَرٍ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، قَالَ: إِنْ يُجْلَدْ قُدَامَةُ الْيَوْمَ فَلَنْ يُتْرَكَ أَحَدٌ بَعْدَهُ، وَكَانَ قُدَامَةُ بَدْرِيًّا. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْجَنَائِزِ، وَالثَّالِثَ مِنْ كِتَابِ الأَشْرِبَةِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي إِدْرِيسَ، عَنْ عُبَادَةَ بْنِ الصَّامِتِ، قَالَ: كُنَّا مَعَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي مَجْلِسٍ، فَقَالَ: «بَايِعُونِي عَلَى أَنْ لا تُشْرِكُوا بِاللَّهِ شَيْئًا» . وَقَرَأَ عَلَيْهِمُ الآيَةَ، وَقَالَ: «فَمَنْ وَفَّى مِنْكُمْ فَأَجْرُهُ عَلَى اللَّهِ، وَمَنْ أَصَابَ مِنْ ذَلِكَ شَيْئًا فَعُوقِبَ بِهِ فَهُوَ كَفَّارَةٌ لَهُ، وَمَنْ أَصَابَ مِنْ ذَلِكَ شَيْئًا فَسَتَرَهُ اللَّهُ عَلَيْهِ، فَهُوَ إِلَى اللَّهِ إِنْ شَاءَ غَفَرَ لَهُ وَإِنْ شَاءَ عَذَّبَهُ» . أَخْرَجَهُ مِنْ كِتَابِ الْجَنَائِزِ.

حَدَّثَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِنْ شَرِبَ فَاجْلِدُوهُ، ثُمَّ إِنْ شَرِبَ فَاجْلِدُوهُ، ثُمَّ إِنْ شَرِبَ فَاجْلِدُوهُ، ثُمَّ إِنْ شَرِبَ فَاقْتُلُوهُ» لا يَدْرِي الزُّهْرِيُّ بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ. فَأُتِيَ بِرَجُلٍ قَدْ شَرِبَ فَجَلَدَهُ، ثُمَّ أُتِيَ بِهِ قَدْ شَرِبَ فَجَلَدَهُ، ثُمَّ أُتِيَ بِهِ قَدْ شَرِبَ فَجَلَدَهُ، وَوَضَعَ الْقَتْلَ وَصَارَتْ رُخْصَةً. قَالَ سُفْيَانُ: قَالَ الزُّهْرِيُّ لِمَنْصُورِ بْنِ الْمُعْتَمِرِ وَمُخَوَّلٍ: كُونَا وَافِدَيِ الْعِرَاقِ بِهَذَا الْحَدِيثِ.

أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِنْ شَرِبَ الْخَمْرَ فَاجْلِدُوهُ» . أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الأَشْرِبَةِ، وَالثَّانِيَ مِنْ كِتَابِ اخْتِلافِ الْحَدِيثِ.

حَدَّثَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَزْهَرَ، قَالَ: رَأَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ حُنَيْنٍ يَسْأَلُ عَنْ رَحْلِ خَالِدِ بْنِ الْوَلِيدِ، فَجَرَيْتُ بَيْنَ يَدَيْهِ أَسْأَلُ عَنْ رَحْلِ خَالِدٍ، حَتَّى أَتَاهُ جَرِيحًا. وَأُتِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِشَارِبٍ، فَقَالَ: «اضْرِبُوهُ» ، فَضَرَبُوهُ بِالأَيْدِي وَالنِّعَالِ وَأَطْرَافِ الثِّيَابِ وَحَثَوْا عَلَيْهِ مِنَ التُّرَابِ، ثُمَّ قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «بَكِّتُوهُ» ، فَبَكَّتُوهُ، ثُمَّ أَرْسَلَهُ. قَالَ: فَلَمَّا كَانَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ، فَسَأَلَ مَنْ حَضَرَ ذَلِكَ الْمَضْرُوبَ، فَقَوَّمَهُ أَرْبَعِينَ، فَضَرَبَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ فِي الْخَمْرِ أَرْبَعِينَ حَيَاتَهُ، ثُمَّ عُمَرُ رَضِيَ اللَّهُ عَنْهُ أَرْبَعِينَ، حَتَّى تَتَابَعَ النَّاسُ فِي شُرْبِ الْخَمْرِ، فَاسْتَشَارَ فَضَرَبَهُ ثَمَانِينَ.

أَخْبَرَنَا مَالِكٌ، عَنْ ثَوْرِ بْنِ زَيْدٍ الدِّيلِيِّ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ اسْتَشَارَ فِي الْخَمْرِ يَشْرَبُهَا الرَّجُلُ، فَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ: نَرَى فِيهَا أَنْ يُجْلَدَ ثَمَانِينَ؛ فَإِنَّهُ إِذَا شَرِبَ سَكِرَ، وَإِذَا سَكِرَ هَذَى، وَإِذَا هَذَى افْتَرَى، أَوْ كَمَا قَالَ: فَجَلَدَهُ عُمَرُ رَضِيَ اللَّهُ عَنْهُ ثَمَانِينَ فِي الْخَمْرِ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الأَشْرِبَةِ.

حَدَّثَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ السَّائِبِ بْنِ يَزِيدَ: أَنَّهُ أَخْبَرَهُ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ خَرَجَ عَلَيْهِمْ، فَقَالَ: إِنِّي وَجَدْتُ مَعَ فُلانٍ رِيحَ شَرَابٍ، فَزَعَمَ أَنَّهُ شَرِبَ الطِّلاءَ وَأَنَا سَائِلٌ عَمَّا شَرِبَ، فَإِنْ كَانَ مُسْكِرًا جَلَدْتُهُ، فَجَلَدَهُ عُمَرُ الْحَدَّ تَامًّا.

أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنِ السَّائِبِ بْنِ يَزِيدَ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ خَرَجَ فَصَلَّى عَلَى جِنَازَةٍ، فَسَمِعَهُ السَّائِبُ يَقُولُ: إِنِّي وَجَدْتُ مَعَ عُبَيْدِ اللَّهِ وَأَصْحَابِهِ رِيحَ الشَّرَابِ، وَأَنَا سَائِلٌ عَمَّا شَرِبُوا، فَإِنْ كَانَ مُسْكِرًا حَدَدْتُهُمْ. قَالَ: قَالَ سُفْيَانُ: فَأَخْبَرَنِي مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنِ السَّائِبِ بْنِ يَزِيدَ: أَنَّهُ حَضَرَهُ يَحُدُّهُمْ.

أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ الزَّنْجِيُّ، عَنْ يَحْيَى بْنِ جُرَيْجٍ، قَالَ: قُلْتُ لِعَطَاءٍ: أَيُجْلَدُ فِي رِيحِ الشَّرَابِ؟ فَقَالَ عَطَاءٌ: إِنَّ الرِّيحَ لَتَكُونُ مِنَ الشَّرَابِ الَّذِي فِيهِ بَأْسٌ، فَإِذَا اجْتَمَعُوا جَمِيعًا عَلَى شَرَابٍ وَاحِدٍ فَسَكِرَ أَحَدُهُمْ جُلِدُوا جَمِيعًا الْحَدَّ تَامًّا. قَالَ الشَّافِعِيُّ: وَقَوْلُ عَطَاءٍ مِثْلُ قَوْلِ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُمَا لا يُخَالِفُهُ.

Muslim Bin Khalid Al-Zinji told us about Yahya Bin Jarij, he said: I said to Tender: Is it whipped in the wind of the drink? Ata 'said: The wind will not be from the drink in which there is despair, so when they all gather together in one drink, the sugar will be drunk. Al-Shafi’i said: A tender saying like the saying of Omar Bin Al-Khattab, may God be pleased with them, does not violate it.
