2423 - (7) [صحيح] وروى أبو داود وغيره بالإسناد المذكور عن ابنِ عبَّاسٍ عن النبيِّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "مَنْ أتى بَهيمَةً فاقْتُلوه، واقْتُلوها مَعَهُ". (قال الخطابي): "قد عارض هذا الحديث نهي النبي - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - عن قتل الحيوان إلا لمأكله" (1). وروى البيهقي أيضاً وغيره عن مفضل بن فضالة عن ابن جريج عن عكرمة [عن ابن عباس] (2) عنِ النبيِّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "اقْتُلوا الفاعِلَ والمفعُولَ بِه، والَّذي يأْتي البَهيمَةَ". (قال البغوي): "اختلف أهل العلم في حدِّ اللوطي، فذهب قوم إلى أنَّ حدَّ الفاعل حدُّ الزنا، إنْ كان محصناً يرجم، وإنْ لم يكن محصناً يجلد مئة. وهو قول سعيد بن المسيب وعطاء بن أبي رباح والحسن وقتادة والنخعي. وبه قال الثوري والأوزاعي، وهو أظهر قولَي الشافعي، ويحكى أيضاً عن أبي يوسف ومحمد بن الحسن. وعلى المفعول به عند الشافعي على هذا القول جلد مئة، وتغريب عام، رجلاً كان أو امرأة، محصناً كان أو غير محصن. وذهب قوم إلى أنَّ اللوطي يرجم محصناً كان أو غير محصن". رواه سعيد بن جبير ومجاهد عن ابن عباس. وروي ذلك عن الشعبي. وبه قال الزهري، وهو قول مالك وأحمد وإسحاق. وروى حماد بن أبي سليمان (1) عن إبراهيم -يعني النخعي- قال: "لو كان أحد يستقيم أنْ يرجم مرتين لرجم اللوطي. والقول الآخر للشافعي أنه يقتل الفاعل والمفعول به كما جاء في الحديث" انتهى. (قال الحافظ): "حَرَّق اللوطية بالنار أربعةٌ من الخلفاء: أبو بكر الصديق، وعلي بن أبي طالب، وعبد الله بن الزبير، وهشام بن عبد الملك". [ضعيف] (*) وروى ابن أبي الدنيا ومن طريقه البيهقي (2) بإسناد جيد عن محمد بن المنكدر: أن خالد بن الوليد كتب إلى أبي بكر الصديق أنه وجد رجلاً في بعض ضواحي العرب يُنكح كما تنكح المرأة، فجمع لذلك أبو بكر أصحابَ رسولِ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - وفيهم عليُّ بنُ أبي طالبٍ فقال علي: إنَّ هذا ذنبٌ لم تعمل به أمة إلا أمة واحدة، ففعل الله بهم ما قد علمتم، أرى أن تَحرِقَهُ بالنار. فاجتمع رأيُ أصحابِ رسولِ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - أن يحرق بالنار. فأمر به أبو بكر أن يحرق بالنار. [قال: وقد حرقه ابن الزبير وهشام بن عبد الملك]. __________ (1) "معالم السنن" (6/ 275). والحديث المذكور لعله رواه بالمعنى، ويعني حديث ابن عمرو المتقدم (10 - العيدين/ 4) في الترهيب من قتل العصفور، ولا تعارض كما هو ظاهر، والله أعلم. (2) زيادة من "الشعب" لم يستدركها مدعو التحقيق!

2424 - (8) [صحيح] وعن ابن عباسٍ رضي الله عنهما؛ أنَّ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "لا ينظرُ الله عزَّ وجلَّ إلى رجلٍ أتى رجلاً أوِ امْرأَةً في دُبُرِها". رواه الترمذي والنسائي وابن حبان في "صحيحه". __________ (1) الأصل والمخطوطة (حماد بن إبراهيم)، وكذا في "العجالة" (187/ 1)، وطبعة الثلاثة! والتصويب من "حديث علي الجعد" (ق 148/ 2 - مخطوطة الظاهرية). و"شعب الإيمان" (2/ 122/ 1) وكتب الرجال، واسم (أبي سليمان) مسلم الأشعري. (2) يعني في "شعب الإيمان" (2/ 2/121)، والزيادة الآتية منه. قلت: ورواه في "السنن" من غير طريق ابن أبي الدنيا، وأعله بالإرسال (8/ 232). (*) قال مُعِدُّ الكتاب للشاملة: هذا الموضع هنا - كما ترى، في صحيح الترغيب - بدون حكم، وذكر هذا الحكم [ضعيف] الشيخ مشهور في طبعته، وقال: قوله «وروى ابن أبي الدنيا. . .» إلى آخره، موجود في «صحيح الترغيب» دون حكم، وبمراجعة أصول الشيخ تبين أنه كتب عليه (ضعيف)، وقال في هامشٍ معلقا على قول الحافظ السابق: «الجزم بهذا فيه نظر، لأن الأثر منقطع»

2425 - (9) [حسن] وعن عبد الله بن عمروٍ رضي الله عنهما؛ أنَّ النبيَّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "هي اللوطيَّةُ الصغْرى. يعني الرجلَ يأتي امْرأَتَهُ في دُبُرِها". رواه أحمد والبزار، ورجالهما رجال "الصحيح". (1)

2427 - (11) [صحيح] وعن خزيمة بن ثابت قال: قال رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "إن الله لا يَسْتَحي مِنَ الحقِّ -ثلاث مرات-: لا تأتُوا النساءَ في أدْبارِهِنَّ". رواه ابن ماجه -واللفظ له- والنسائي بأسانيد أحدها جيد.

2428 - (12) [حسن] وعن جابرٍ رضي الله عنه: أن النبيَّ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - نهى عن مَحَاشّ (2) النساءِ. [حسن لغيره] رواه الطبراني في "الأوسط"، ورواته ثقات، والدارقطني، ولفظه: أن رسول الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "اسْتَحْيوا مِنَ الله؛ فإنَّ الله لا يَسْتَحْيِ مِنَ الحقِّ، لا يَحِلُّ مأْتاكَ النساءَ في حُشوشِهِنَّ". __________ (1) قلت: كيف وكلاهما أخرجاه من طريق عمرو بن شعيب عن أبيه عن جده؟! وكذلك رواه جمع آخر خُرجوا في "التعليق الرغيب". (2) جمع (مَحِشَّة)، وهي الدبر، قال الأزهري: ويقال أيضاً بالسين المهملة. كنى بـ (المحاشّ) عن الأدبار كما يكنَى بالحشوش عن مواضع الغائط. "نهاية".

2429 - (13) [حسن صحيح] وعن عقبة بن عامرٍ رضي الله عنه قال: قال رسولُ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -: "لعنَ الله الذين يَأتونَ النساءَ في محاشِّهِنَّ". رواه الطبراني من رواية عبد الصمد بن الفضل. (المحاشّ) بفتح الميم وبالحاء المهملة وبعد الألف شين معجمة مشددة، جمع (مَحِشة) بفتح الميم وكسرها: وهي الدبر.

2433 - (17) [صحيح] (وعنه)؛ أنَّ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - قال: "مَنْ أتى حائضاً، أوِ امْرأَةً في دُبُرِها، أوْ كاهِناً فصدَّقَهُ؛ فقد كَفَر بما أُنْزِلَ على محمَّدٍ - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -". رواه أحمد والترمذي والنسائي وابن ماجه وأبو داود؛ إلا أنه قال: "فقد برئ مما أنزل على محمد - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ -". (قال الحافظ): "رووه من طريق حكيم الأثرم عن أبي تميمة -وهو طريف بن مجالد (1) - عن أبي هريرة. وسئل علي بن المديني عن حكيم: من هو؟ فقال: أعيانا هذا. وقال البخاري في "تاريخه الكبير": لا يعرف لأبي تميمة سماع من أبي هريرة (2) ".

2434 - (18) [حسن] وعن علي بن طلقٍ رضي الله عنه قال: سمعتُ رسولَ الله - صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ - يقول: "لا تَأْتوا النساءَ في أُسْتاهُنَّ (3) فإنَّ الله لا يَسْتَحي مِنَ الحقِّ". رواه أحمد، والترمذي وقال: "حديث حسن". ورواه النسائي وابن حبان في "صحيحه" بمعناه. __________ (1) الأصل: (خالد)، والتصحيح من كتب الرجال، وهو مما غفل عنه المعلقون! وإن من تمام غفلتهم، أنهم لما حذفوا في مجلدهم الذي أسموه "التهذيب" كل الأحاديث التي بين حديث ابن عباس المتقدم قبل صفحتين وبين حديث أبي هريرة هذا طبعوه كما هو: "وعنه. . ."، فرجع ضمير (عنه) إلى ابن عباس المذكور قبله في مجلدهم!! (2) قلت: أبو تميمة تابعي ثقة عاصر أبا هريرة، وحكيم الأثرم، ثقة أيضاً، فالإعلال المذكور غير جار على مذهب الجمهور الذي يكتفي في الاتصال على المعاصرة بشرطه المعروف، ولذلك صحح الحديث غير ما واحد، لا سيما وله طرق أخرى خرجتها في "الإرواء" (2006). (3) أي: أعجازهن، ويراد حلقة الدبر، وهمزته وصل، ولامه محذوفة والأصل (سَتَه) كما في "المصباح".
