أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ رَبِيعَةَ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهَا قَالَتْ: كَانَتْ فِي بَرِيرَةَ ثَلاثُ سُنَنٍ وَكَانَتْ فِي إِحْدَى السُّنَنِ أَنَّهَا أُعْتِقَتْ فَخُيِّرَتْ فِي زَوْجِهَا.

Tell us Shafei may Allah be pleased with him, said: Tell us Malik from Rabia, Qasim ibn Muhammad, Aisha, may Allah be pleased wife of the Prophet peace be upon him, she said: She was in Bareerah three Sunan and was in one of the Sunan it she freed Fajert in her husband.

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ: أَنَّ مَوْلاةً لِبَنِي عَدِيِّ بْنِ كَعْبٍ، يُقَالُ لَهَا: زَبْرَاءُ أَخْبَرَتْهُ: أَنَّهَا كَانَتْ تَحْتَ عَبْدٍ، وَهِيَ أَمَةٌ يَوْمَئِذٍ فَعَتَقَتْ، قَالَتْ: فَأَرْسَلَتْ إِلَيَّ حَفْصَةُ زَوْجُ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَدَعَتْنِي، فَقَالَتْ: إِنِّي مُخْبِرَتُكِ خَبَرًا، وَلا أُحِبُّ أَنْ تَصْنَعِي شَيْئًا، إِنَّ أَمْرَكِ بِيَدِكِ مَا لَمْ يَمَسَّكِ زَوْجُكِ، قَالَتْ: فَفَارَقَتْهُ ثَلاثًا.

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ: أَنَّ مَوْلاةً لِبَنِي عَدِيٍّ، يُقَالُ لَهَا: زَبْرَاءُ أَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ عَبْدٍ وَهِيَ يَوْمَئِذٍ أَمَةٌ فَعَتَقَتْ. قَالَتْ: فَأَرْسَلَتْ إِلَيَّ حَفْصَةُ فَدَعَتْنِي فَقَالَتْ: إِنِّي مُخْبِرَتُكِ خَبَرًا، وَلا أُحِبُّ أَنْ تَصْنَعِي شَيْئًا إِنَّ أَمْرَكِ بِيَدِكِ مَا لَمْ يَمَسَّكِ زَوْجُكِ، قَالَتْ: فَفَارَقَتْهُ ثَلاثًا. قَالَ الشَّافِعِيُّ: وَلَمْ تَقُلْ لَهَا حَفْصَةُ: لا يَجُوزُ أَنْ تُطَلَّقِي ثَلاثًا.

Malik told us, on the authority of Shihab, on the authority of Arwah: that Mawla was the son of Adi, it is said to her: Zubarah told him that it was time for you. She said she sent to Hafsa Vdatna said: I am Mkhbertk news, I do not like to Tsenai something that your order with your hand unless you catch your husband, she said: Vvargueth three times. Al-Shafi’i said: Hafsah did not say to her: It is not permissible to divorce her three times.

أَخْبَرَنَا سُفْيَانُ، عَنْ أَيُّوبَ بْنِ أَبِي تَمِيمَةَ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ: أَنَّهُ ذَكَرَ عِنْدَهُ زَوْجَ بَرِيرَةَ، فَقَالَ: كَانَ ذَلِكَ مُغِيثٌ عَبْدُ بَنِي فُلانٍ، كَأَنِّي أَنْظُرُ إِلَيْهِ يَتْبَعُهَا فِي الطَّرِيقِ وَهُوَ يَبْكِي.

Tell us Sufian, Ayoub bin Abi amulet, Ikrimah, from Ibn Abbas, may Allah be pleased with him: he said he has a pair Bareerah, he said: it was built so and so succorer Abdul, if I look at him, followed by the road, crying.

أَخْبَرَنَا الْقَاسِمُ بْنُ عَبْدِ اللَّهِ بْنِ عُمَرَ بْنِ حَفْصٍ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ: أَنَّ زَوْجَ بَرِيرَةَ كَانَ عَبْدًا. أَخْرَجَ السِّتَّةَ الأَحَادِيثَ مِنْ كِتَابِ أَحْكَامِ الْقُرْآنِ.

Saeed bin Salim told us on the authority of Ibn Jarij, on the authority of Ibn Malika, on the authority of Saeed bin Jabir: He said: Zaj Al-Azh.

أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ: أَنَّهُ قَالَ: الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ الزَّوْجُ. أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ: أَنَّهُ قَالَ: الَّذِي بِيَدِهِ عُقْدَةُ النِّكَاحِ الزَّوْجُ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ لَيْثِ بْنِ أَبِي سُلَيْمٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ، قَالَ: لَيْسَ لَهَا إِلا نِصْفُ الْمَهْرِ وَلا عِدَّةٌ عَلَيْهَا. يَعْنِي لِمَنْ قَالَ اللَّهُ تَعَالَى: {وَإِنْ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ وَقَدْ فَرَضْتُمْ لَهُنَّ فَرِيضَةً} [البقرة: 237] . وَقَوْلُ اللَّهِ تَعَالَى: {ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا} [الأحزاب: 49] .

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّهُ كَانَ يَقُولُ: لِكُلِّ مُطَلَّقَةٍ مُتْعَةٌ إِلا الَّتِي فُرِضَ لَهَا الصَّدَاقُ وَلَمْ يَدْخُلْ بِهَا فَحَسْبُهَا نِصْفُ الْمَهْرِ.

Malik told us, on the authority of Nafi ', ​​on the authority of Ibn Omar, that he used to say: All divorcees are enjoyable except for which the pact is imposed on him.

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا: أَنَّهُ كَانَ يَقُولُ: لِكُلِّ مُطَلَّقَةٍ مُتْعَةٌ إِلا الَّتِي يُطَلِّقُهَا وَقَدْ فُرِضَ لَهَا صَدَاقٌ وَلَمْ تُمَسَّ فَحَسْبُهَا مَا فُرِضَ لَهَا.

Tell us Malik from Nafi from Ibn 'Umar, may Allah be pleased with them: he was saying: Every absolute pleasure only by divorce has imposed her Friendship did not affect what Vhsabha to impose them.
