أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ: أَنَّ مَوْلاةً لِبَنِي عَدِيٍّ، يُقَالُ لَهَا: زَبْرَاءُ أَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ عَبْدٍ وَهِيَ يَوْمَئِذٍ أَمَةٌ فَعَتَقَتْ. قَالَتْ: فَأَرْسَلَتْ إِلَيَّ حَفْصَةُ فَدَعَتْنِي فَقَالَتْ: إِنِّي مُخْبِرَتُكِ خَبَرًا، وَلا أُحِبُّ أَنْ تَصْنَعِي شَيْئًا إِنَّ أَمْرَكِ بِيَدِكِ مَا لَمْ يَمَسَّكِ زَوْجُكِ، قَالَتْ: فَفَارَقَتْهُ ثَلاثًا. قَالَ الشَّافِعِيُّ: وَلَمْ تَقُلْ لَهَا حَفْصَةُ: لا يَجُوزُ أَنْ تُطَلَّقِي ثَلاثًا.
مسند امام شافی · Hadith 1265
Malik told us, on the authority of Shihab, on the authority of Arwah: that Mawla was the son of Adi, it is said to her: Zubarah told him that it was time for you. She said she sent to Hafsa Vdatna said: I am Mkhbertk news, I do not like to Tsenai something that your order with your hand unless you catch your husband, she said: Vvargueth three times. Al-Shafi’i said: Hafsah did not say to her: It is not permissible to divorce her three times.
