أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ لَيْثِ بْنِ أَبِي سُلَيْمٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ، قَالَ: لَيْسَ لَهَا إِلا نِصْفُ الْمَهْرِ وَلا عِدَّةٌ عَلَيْهَا. يَعْنِي لِمَنْ قَالَ اللَّهُ تَعَالَى: {وَإِنْ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ وَقَدْ فَرَضْتُمْ لَهُنَّ فَرِيضَةً} [البقرة: 237] . وَقَوْلُ اللَّهِ تَعَالَى: {ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا} [الأحزاب: 49] .
مسند امام شافی · Hadith 1271
Tell us Shafei may Allah be pleased with him, said: Tell us Muslim bin Khalid, the son of Greg, Laith ibn Abi Salim, Tawoos, from Ibn Abbas, may Allah be pleased with him, he said, have only half of the dowry and a number of them. It means to those who said to God Almighty: {And if you divorce them before you touch them, then you have imposed an obligation for them} [Al-Baqarah: 237]. And God Almighty said: {Then you divorced them before you touched them, and what you have from them you are accustomed to.} [Al-Ahzab: 49].
