أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُسْلِمٌ، عَنِ ابْنِ جُرَيْجٍ أَظُنُّهُ، عَنْ عَطَاءٍ، عَنْ صَفْوَانَ بْنِ يَعْلَى بْنِ أُمَيَّةَ، عَنْ يَعْلَى بْنِ أُمَيَّةَ، قَالَ: غَزَوْتُ مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ غَزْوَةً، قَالَ: وَكَانَ يَعْلَى يَقُولُ: وَكَانَتْ تِلْكَ الْغَزْوَةُ أَوْثَقَ عَمَلِي فِي نَفْسِي. قَالَ عَطَاءٌ: قَالَ صَفْوَانُ: قَالَ يَعْلَى: كَانَ لِي أَجِيرٌ فَقَاتَلَ إِنْسَانًا، فَعَضَّ أَحَدُهُمَا يَدَ الآخَرِ فَانْتَزَعَ يَعْنِي الْمَعْضُوضُ يَدَهُ مِنْ فِي الْعَاضِّ، فَذَهَبَتْ إِحْدَى ثَنِيَّتَيْهِ فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَهْدَرَ ثَنِيَّتَهُ. قَالَ عَطَاءٌ: وَحَسِبْتُ أَنَّهُ قَالَ: قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَيَدَعُ يَدَهُ فِي فِيكَ تَقْضَمُهَا كَأَنَّهَا فِي فَحْلٍ يَقْضَمُهَا» . قَالَ عَطَاءٌ: وَقَدْ أَخْبَرَنِي صَفْوَانُ أَيَّهُمَا عَضَّ فَنَسِيتُهُ.

أَخْبَرَنَا مُسْلِمٌ، عَنِ ابْنِ جُرَيْجٍ: أَنَّ ابْنَ أَبِي مُلَيْكَةَ أَخْبَرَهُ: أَنَّ أَبَاهُ أَخْبَرَهُ، أَنَّ إِنْسَانًا جَاءَ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ رَضِيَ اللَّهُ عَنْهُ، وَعَضَّهُ إِنْسَانٌ فَانْتَزَعَ يَدَهُ مِنْهُ، فَذَهَبَتْ ثَنِيَّتَهُ، فَقَالَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: تَعَدَّتْ ثَنِيَّتُهُ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ، عَنِ ابْنِ أَبِي لَيْلَى بْنِ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ أَنَّهُ أَخْبَرَهُ، وَرِجَالٌ مِنْ كُبَرَاءِ قَوْمِهِ: أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلِ بْنِ أَبِي حَثْمَةَ وَمُحَيِّصَةَ خَرَجَا إِلَى خَيْبَرَ مِنْ جَهْدٍ أَصَابَهُمَا، فَتَفَرَّقَا فِي حَوَائِجِهِمَا فَأُتِيَ مُحَيِّصَةُ فَأُخْبِرَ: أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَدْ قُتِلَ وَطُرِحَ فِي فَقِيرٍ أَوْ عَيْنٍ فَأَتَى يَهُودَ، فَقَالَ: وَاللَّهِ أَنْتُمْ قَتَلْتُمُوهُ. قَالُوا: وَاللَّهِ مَا قَتَلْنَاهُ، فَأَقْبَلَ حَتَّى قَدِمَ عَلَى قَوْمِهِ فَذَكَرَ ذَلِكَ لَهُمْ، فَأَقْبَلَ هُوَ وَأَخُوهُ حُوَيِّصَةُ وَهُوَ أَكْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ أَخُو الْمَقْتُولِ فَذَهَبَ مُحَيِّصَةُ يَتَكَلَّمُ وَهُوَ الَّذِي كَانَ بِخَيْبَرَ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِمُحَيِّصَةَ: «كَبِّرْ كَبِّرْ» ، يُرِيدُ السِّنَّ. فَتَكَلَّمَ حُوَيِّصَةُ، ثُمَّ تَكَلَّمَ مُحَيِّصَةُ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِمَّا أَنْ يَدُوا صَاحِبَكُمْ وَإِمَّا أَنْ يُؤْذِنُوا بِحَرْبٍ» . فَكَتَبَ إِلَيْهِمْ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ. فَكَتَبُوا: إِنَّا وَاللَّهِ مَا قَتَلْنَاهُ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ: «تَحْلِفُونَ وَتَسْتَحِقُّونَ دَمَ صَاحِبِكُمْ؟» . قَالُوا: لا، قَالَ: «فَتَحْلِفُ يَهُودُ» . قَالُوا: لا لَيْسُوا بِمُسْلِمِينَ، فَوَدَاهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عِنْدِهِ فَبَعَثَ إِلَيْهِمْ بِمِائَةِ نَاقَةٍ حَتَّى أُدْخِلَتْ عَلَيْهِمُ الدَّارَ، فَقَالَ سَهْلٌ: لَقَدْ رَكَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَاءُ.

أَخْبَرَنَا عَبْدُ الْوَهَّابِ بْنُ عَبْدِ الْمَجِيدِ الثَّقَفِيُّ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ بَشِيرِ بْنِ يَسَارٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ: أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ بْنَ مَسْعُودٍ خَرَجَا إِلَى خَيْبَرَ فَتَفَرَّقَا لِحَاجَتِهِمَا فَقُتِلَ عَبْدُ اللَّهِ بْنُ سَهْلٍ، فَانْطَلَقَ هُوَ وَعَبْدُ الرَّحْمَنِ أَخُو الْمَقْتُولِ وَحُوَيِّصَةُ بْنُ مَسْعُودٍ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرُوا لَهُ قَتْلَ عَبْدِ اللَّهِ بْنِ سَهْلٍ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «تَحْلِفُونَ خَمْسِينَ يَمِينًا وَتَسْتَحِقُّونَ دَمَ قَاتِلِكُمْ أَوْ صَاحِبِكُمْ» ، فَقَالُوا: يَا رَسُولَ اللَّهِ، لَمْ نَشْهَدْ وَلَمْ نَحْضُرْ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فَتُبْرِئُكُمْ يَهُودُ خَمْسِينَ يَمِينًا» . قَالُوا: يَا رَسُولَ اللَّهِ، كَيْفَ نَقْبَلُ أَيْمَانَ قَوْمٍ كُفَّارٍ، فَزَعَمَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَقَلَهُ مِنْ عِنْدِهِ. قَالَ بَشِيرُ بْنُ يَسَارٍ، قَالَ سَهْلٌ: لَقَدْ رَكَضَتْنِي فَرِيضَةٌ مِنْ تِلْكَ الْفَرَائِضِ فِي مِرْبَدٍ لَهَا.

بَشِيرِ بْنِ يَسَارٍ ← يَحْيَى ← مَالِكٍ،

أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ: أَنَّ رَجُلا مِنْ بَنِي سَعْدِ بْنِ لَيْثٍ أَجْرَى فَرَسًا فَوَطِئَ عَلَى أُصْبُعِ رَجُلٍ مِنْ جُهَيْنَةَ فَنَزَى فِيهَا فَمَاتَ، فَقَالَ عُمَرُ لِلَّذِي ادَّعَى عَلَيْهِمْ: تَحْلِفُونُ خَمْسِينَ يَمِينًا مَا مَاتَ مِنْهَا؟ فَأَبَوْا أَنْ يَخْرُجُوا مِنَ الأَيْمَانِ، فَقَالَ لِلآخَرِينَ: احْلِفُوا أَنْتُمْ فَأَبَوْا وَتَحَرَّجُوا. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ السَّبْقِ وَالرَّمْيِ وَالْقَسَامَةِ وَالْكُسُوفِ، وَالثَّانِيَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ، وَإِلَى آخِرِ السَّادِسِ مِنْ كِتَابِ الْيَمِينِ مَعَ الشَّاهِدِ، وَهِيَ آخِرُ مَا فِيهِ.
