أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: أَمَّا الَّذِي نَهَى عَنْهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَهُوَ الطَّعَامُ أَنْ يُبَاعَ حَتَّى يُقْبَضَ. قَالَ ابْنُ عَبَّاسٍ بِرَأْيِهِ: وَلا أَحْسِبُ كُلَّ شَيْءٍ إِلا مِثْلَهُ. أَخْرَجَ الأَرْبَعَةَ الأَحَادِيثَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ، وَالْخَامِسَ وَالسَّادِسَ وَقَوْلَ ابْنِ عَبَّاسٍ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَالسَّابِعَ وَقَوْلَ ابْنِ عَبَّاسٍ مِنْ كِتَابِ الرِّسَالَةِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ مَوْلَى الأَسْوَدِ بْنِ سُفْيَانَ: أَنَّ زَيْدًا أَبَا عَيَّاشٍ أَخْبَرَهُ: أَنَّهُ سَأَلَ سَعْدَ بْنَ أَبِي وَقَّاصٍ عَنِ الْبَيْضَاءِ بِالسُّلْتِ، فَقَالَ لَهُ سَعْدٌ: أَيُّهُمَا أَفْضَلُ؟ فَقَالَ: الْبَيْضَاءُ، فَنَهَى عَنْ ذَلِكَ، وَقَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَسْأَلُ عَنْ شِرَاءِ التَّمْرِ بِالرُّطَبِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَيَنْقُصُ الرُّطَبُ إِذَا يَبِسَ» ؟ فَقَالُوا: نَعَمْ. فَنَهَى عَنْ ذَلِكَ.

أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَالِمٍ، عَنْ أَبِيهِ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ التَّمْرِ حَتَّى يَبْدُوَ صَلاحُهُ وَعَنْ بَيْعِ التَّمْرِ بِالتَّمْرِ. قَالَ عَبْدُ اللَّهِ: وَحَدَّثَنَا زَيْدُ بْنُ ثَابِتٍ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَرْخَصَ فِي الْعَرَايَا.

Sufyan told us, on the authority of Al-Zuhri, on the authority of Salem, on the authority of his father: that the Prophet, may God’s prayers and peace be upon him, forbade the sale of the Druze of Thalam. Abdullah said: Zaid bin Thabit spoke to us: The Prophet, may God bless him and grant him peace, was cheaper in the nudity.

أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ إِسْمَاعِيلَ الشَّيْبَانِيِّ أَوْ غَيْرِهِ، قَالَ: بِعْتُ مَا فِي رُءُوسِ نَخْلِي بِمِائَةِ وَسْقٍ، إِنْ زَادَ فَلَهُمْ، وَإِنْ نَقَصَ فَعَلَيْهِمْ، فَسَأَلْتُ ابْنَ عُمَرَ، فَقَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ هَذَا إِلا أَنَّهُ أَرْخَصَ فِي بَيْعِ الْعَرَايَا.

Malik told us, on the authority of Nafi, on the authority of Abdullah bin Omar, on the authority of Zaid bin Thabit: that the Messenger of God, may God bless him

أَخْبَرَنَا مَالِكٌ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ، عَنْ أَبِي سُفْيَانَ مَوْلَى ابْنِ أَبِي أَحْمَدَ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَرْخَصَ فِي بَيْعِ الْعَرَايَا فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ أَوْ فِي خَمْسَةِ أَوْسُقٍ. شَكَّ دَاوُدُ، قَالَ: خَمْسَةُ أَوْسُقٍ أَوْ دُونَ خَمْسَةِ أَوْسُقٍ.

Tell us Malik Dawood ibn al-Husayn, from Abu Sufyan Ibn Abi Ahmad Mawla, from Abu Hurayrah may Allah be pleased with him: that the Prophet, peace be upon him cheaper in selling naked while below five wasqs or in five wasqs. David doubted, he said: Five piles or five pennies.

أَخْبَرَنَا سُفْيَانُ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ بَشِيرِ بْنِ يَسَارٍ، قَالَ: سَمِعْتُ سَهْلَ بْنَ أَبِي حَثْمَةَ، يَقُولُ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ بَيْعِ التَّمْرِ بِالتَّمْرِ إِلا أَنَّهُ أَرْخَصَ فِي الْعَرِيَّةِ أَنْ تُبَاعَ بِخَرْصِهَا تَمْرًا يَأْكُلُهَا أَهْلُهَا رَطْبًا.

أَخْبَرَنَا سُفْيَانُ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ الْمُزَابَنَةِ. وَالْمُزَابَنَةُ: بَيْعُ التَّمْرِ بِالتَّمْرِ إِلا أَنَّهُ أَرْخَصَ فِي الْعَرَايَا. أَخْرَجَ السَّبْعَةَ الأَحَادِيثَ مِنْ كِتَابِ الْبُيُوعِ.

Sufyan told us, on the authority of Ibn Jarij, on the authority of Ata, on the authority of Jaber: that the Messenger of God, may God bless him and grant him peace, forbade him. Almazabanh: Selling dates with dates, except that it is cheaper in the naked eye. Take the seven hadiths out of the book of sale.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُزَابَنَةِ. وَالْمُزَابَنَةُ: بَيْعُ التَّمْرِ بِالتَّمْرِ كَيْلا، وَبَيْعُ الْكَرْمِ بِالزَّبِيبِ كَيْلا.

Al-Shafi’i, may God be pleased with him, told us, he said: Malik told us, on the authority of Nafi`, on the authority of Ibn Omar: that the Messenger of God, may God’s prayers and peace be upon God. Al-Muzabanah: Selling dates with dates, and selling vineyards with raisins at all.

أَخْبَرَنَا مَالِكٌ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ، عَنْ أَبِي سُفْيَانَ مَوْلَى ابْنِ أَبِي أَحْمَدَ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، أَوْ عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُمَا: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ. وَالْمُزَابَنَةُ: اشْتِرَاءُ التَّمْرِ بِالتَّمْرِ فِي رُءُوسِ النَّخْلِ. وَالْمُحَاقَلَةُ: اسْتِكْرَاءُ الأَرْضِ بِالْحِنْطَةِ.

Tell us Malik Dawood ibn al-Husayn, from Abu Sufyan Ibn Abi Ahmad Mawla, from Abu Sa'eed, or from Abu Hurayrah, may Allah be pleased with them: that the Messenger of Allah peace be upon him and forbade Almzabnh Almhaklh. Almazabanh: the purchase of dates in dates in the heads of palm trees. The ritualization: the consumption of the earth by wheat.

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُزَابَنَةِ وَالْمُحَاقَلَةِ. وَالْمُزَابَنَةُ: اشْتِرَاءُ التَّمْرِ بِالتَّمْرِ. وَالْمُحَاقَلَةُ: اشْتِرَاءُ الزَّرْعِ بِالْحِنْطَةِ. قَالَ ابْنُ شِهَابٍ: فَسَأَلْتُ عَنِ اسْتِكْرَاءِ الأَرْضِ بِالذَّهَبِ وَالْفِضَّةِ، فَقَالَ: لا بَأْسَ بِذَلِكَ.

Malik, on the authority of Ibn Shihab, told us on the authority of Saeed Bin Al-Musayyib: The Messenger of God, may God bless him and grant him peace, forbade Nahem Al-Nahm. Almazabanh: the purchase of dates by dates. Convergence: the purchase of wheat by wheat. Ibn Shihab said: I asked about the consumption of the land in gold and silver, and he said: There is no wrong in that.

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُخَابَرَةِ وَالْمُحَاقَلَةِ وَالْمُزَابَنَةِ. وَالْمُحَاقَلَةُ: أَنْ يَبِيعَ الرَّجُلُ الزَّرْعَ بِمِائَةِ فَرَقِ حِنْطَةٍ وَالْمُزَابَنَةُ: أَنْ يَبِيعَ التَّمْرَ فِي رُءُوسِ النَّخْلِ بِمِائَةِ فَرَقٍ. وَالْمُخَابَرَةُ: كِرَاءُ الأَرْضِ بِالثُّلُثِ وَالرُّبُعِ.

Ibn 'Uyaynah, on the authority of Ibn Jarij, on the authority of Ata, on the authority of Jaber, told us: The Messenger of God, may God bless him and grant him peace, said: And the discussion: for a man to sell the crops with 100 percent of wheat and al-Mazabanh: to sell the dates in the heads of palm trees. And intelligence: renting the land by a third and a quarter.
