أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْمُخَابَرَةِ وَالْمُحَاقَلَةِ وَالْمُزَابَنَةِ. وَالْمُحَاقَلَةُ: أَنْ يَبِيعَ الرَّجُلُ الزَّرْعَ بِمِائَةِ فَرَقِ حِنْطَةٍ وَالْمُزَابَنَةُ: أَنْ يَبِيعَ التَّمْرَ فِي رُءُوسِ النَّخْلِ بِمِائَةِ فَرَقٍ. وَالْمُخَابَرَةُ: كِرَاءُ الأَرْضِ بِالثُّلُثِ وَالرُّبُعِ.
مسند امام شافی · Hadith 1414
Ibn 'Uyaynah, on the authority of Ibn Jarij, on the authority of Ata, on the authority of Jaber, told us: The Messenger of God, may God bless him and grant him peace, said: And the discussion: for a man to sell the crops with 100 percent of wheat and al-Mazabanh: to sell the dates in the heads of palm trees. And intelligence: renting the land by a third and a quarter.
