أَخْبَرَنَا مُحَمَّدُ بْنُ يَحْيَی قَالَ حَدَّثَنَا أَبُو مَعْمَرٍ قَالَ حَدَّثَنَا عَبْدُ الْوَارِثِ قَالَ حَدَّثَنَا قَطَنٌ أَبُو الْهَيْثَمِ قَالَ حَدَّثَنَا أَبُو يَزِيدَ الْمَدَنِيُّ عَنْ عِکْرِمَةَ عَنْ ابْنِ عَبَّاسٍ قَالَ أَوَّلُ قَسَامَةٍ کَانَتْ فِي الْجَاهِلِيَّةِ کَانَ رَجُلٌ مِنْ بَنِي هَاشِمٍ اسْتَأْجَرَ رَجُلًا مِنْ قُرَيْشٍ مِنْ فَخِذِ أَحَدِهِمْ قَالَ فَانْطَلَقَ مَعَهُ فِي إِبِلِهِ فَمَرَّ بِهِ رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدْ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَقَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لَا تَنْفِرُ الْإِبِلُ فَأَعْطَاهُ عِقَالًا يَشُدُّ بِهِ عُرْوَةَ جُوَالِقِهِ فَلَمَّا نَزَلُوا وَعُقِلَتْ الْإِبِلُ إِلَّا بَعِيرًا وَاحِدًا فَقَالَ الَّذِي اسْتَأْجَرَهُ مَا شَأْنُ هَذَا الْبَعِيرِ لَمْ يُعْقَلْ مِنْ بَيْنِ الْإِبِلِ قَالَ لَيْسَ لَهُ عِقَالٌ قَالَ فَأَيْنَ عِقَالُهُ قَالَ مَرَّ بِي رَجُلٌ مِنْ بَنِي هَاشِمٍ قَدْ انْقَطَعَتْ عُرْوَةُ جُوَالِقِهِ فَاسْتَغَاثَنِي فَقَالَ أَغِثْنِي بِعِقَالٍ أَشُدُّ بِهِ عُرْوَةَ جُوَالِقِي لَا تَنْفِرُ الْإِبِلُ فَأَعْطَيْتُهُ عِقَالًا فَحَذَفَهُ بِعَصًا کَانَ فِيهَا أَجَلُهُ فَمَرَّ بِهِ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ فَقَالَ أَتَشْهَدُ الْمَوْسِمَ قَالَ مَا أَشْهَدُ وَرُبَّمَا شَهِدْتُ قَالَ هَلْ أَنْتَ مُبَلِّغٌ عَنِّي رِسَالَةً مَرَّةً مِنْ الدَّهْرِ قَالَ نَعَمْ قَالَ إِذَا شَهِدْتَ الْمَوْسِمَ فَنَادِ يَا آلَ قُرَيْشٍ فَإِذَا أَجَابُوکَ فَنَادِ يَا آلَ هَاشِمٍ فَإِذَا أَجَابُوکَ فَسَلْ عَنْ أَبِي طَالِبٍ فَأَخْبِرْهُ أَنَّ فُلَانًا قَتَلَنِي فِي عِقَالٍ وَمَاتَ الْمُسْتَأْجَرُ فَلَمَّا قَدِمَ الَّذِي اسْتَأْجَرَهُ أَتَاهُ أَبُو طَالِبٍ فَقَالَ مَا فَعَلَ صَاحِبُنَا قَالَ مَرِضَ فَأَحْسَنْتُ الْقِيَامَ عَلَيْهِ ثُمَّ مَاتَ فَنَزَلْتُ فَدَفَنْتُهُ فَقَالَ کَانَ ذَا أَهْلَ ذَاکَ مِنْکَ فَمَکُثَ حِينًا ثُمَّ إِنَّ الرَّجُلَ الْيَمَانِيَّ الَّذِي کَانَ أَوْصَی إِلَيْهِ أَنْ يُبَلِّغَ عَنْهُ وَافَی الْمَوْسِمَ قَالَ يَا آلَ قُرَيْشٍ قَالُوا هَذِهِ قُرَيْشٌ قَالَ يَا آلَ بَنِي هَاشِمٍ قَالُوا هَذِهِ بَنُو هَاشِمٍ قَالَ أَيْنَ أَبُو طَالِبٍ قَالَ هَذَا أَبُو طَالِبٍ قَالَ أَمَرَنِي فُلَانٌ أَنْ أُبَلِّغَکَ رِسَالَةً أَنَّ فُلَانًا قَتَلَهُ فِي عِقَالٍ فَأَتَاهُ أَبُو طَالِبٍ فَقَالَ اخْتَرْ مِنَّا إِحْدَی ثَلَاثٍ إِنْ شِئْتَ أَنْ تُؤَدِّيَ مِائَةً مِنْ الْإِبِلِ فَإِنَّکَ قَتَلْتَ صَاحِبَنَا خَطَأً وَإِنْ شِئْتَ يَحْلِفْ خَمْسُونَ مِنْ قَوْمِکَ أَنَّکَ لَمْ تَقْتُلْهُ فَإِنْ أَبَيْتَ قَتَلْنَاکَ بِهِ فَأَتَی قَوْمَهُ فَذَکَرَ ذَلِکَ لَهُمْ فَقَالُوا نَحْلِفُ فَأَتَتْهُ امْرَأَةٌ مِنْ بَنِي هَاشِمٍ کَانَتْ تَحْتَ رَجُلٍ مِنْهُمْ قَدْ وَلَدَتْ لَهُ فَقَالَتْ يَا أَبَا طَالِبٍ أُحِبُّ أَنْ تُجِيزَ ابْنِي هَذَا بِرَجُلٍ مِنْ الْخَمْسِينَ وَلَا تُصْبِرْ يَمِينَهُ فَفَعَلَ فَأَتَاهُ رَجُلٌ مِنْهُمْ فَقَالَ يَا أَبَا طَالِبٍ أَرَدْتَ خَمْسِينَ رَجُلًا أَنْ يَحْلِفُوا مَکَانَ مِائَةٍ مِنْ الْإِبِلِ يُصِيبُ کُلَّ رَجُلٍ بَعِيرَانِ فَهَذَانِ بَعِيرَانِ فَاقْبَلْهُمَا عَنِّي وَلَا تُصْبِرْ يَمِينِي حَيْثُ تُصْبَرُ الْأَيْمَانُ فَقَبِلَهُمَا وَجَائَ ثَمَانِيَةٌ وَأَرْبَعُونَ رَجُلًا حَلَفُوا قَالَ ابْنُ عَبَّاسٍ فَوَالَّذِي نَفْسِي بِيَدِهِ مَا حَالَ الْحَوْلُ وَمِنْ الثَّمَانِيَةِ وَالْأَرْبَعِينَ عَيْنٌ تَطْرِفُ

It was narrated that Ibn ‘Abbas said: “The first instance of Qasamah during the Jahiliyyah involved a man from Banu Hashim who was employed by a man from Quraish, from another branch of the tribe. He went out with him, driving his camels, and another man from Banu Hashim passed by them. The leather rope of that man’s bag broke, so he said (to the hired worker): ‘Help me by giving me a rope with which to tie the handle of my bag, lest the camels run away from me.’ So he gave him a rope and he tied his bag with it. When they halted, all the camels’ legs were hobbled except one camel. The one who had hired him said: ‘Why is this camel, out of all of them, not hobbled?’ He said: ‘There is no rope for it.’ He said: ‘Where is its rope?’ He said: ‘A man from Banu Hashim passed by and the leather rope of his bag had broken, and he asked me to help him; he said: “Help me by giving me a rope with which to tie the handle of my bag lest the camels run away from me, so I gave him a rope.” He struck him with a stick, which led to his death. Then a man from Yemen passed by him (the man from Banu Hashim, just before he died) and he (the FlashimI man) said: ‘Are you going to attend the Pilgrimage?’ He said: ‘I do not think I will attend it, but perhaps I will attend it.’ He said: ‘Will you convey a message from me once in your lifetime?’ He said: ‘Yes.’ He said: ‘If you attend the Pilgrimage, then call out, family of Qurai If they respond, then call out, family of Hashim! If they respond, then ask for Abu Talib, and tell him that so and so killed me for a rope.’ Then the hired worker died. When the one who had hired him came, Abu Talib went to him and said: ‘What happened to our companion?’ He said: ‘He fell sick and I took good care of him, but he died, so I stopped and buried him.’ He said: ‘He deserved that from you.’ Some time passed, then the Yemeni man who had been asked to convey the message arrived at the time of the Pilgrimage. He said: ‘family of Qurai And they said: ‘Here is Qurai He said: ‘family of Banu Hashim!’ They said: ‘Here are Banu Hashim.’ He said: ‘Where is Abu Talib?’ He said: ‘Here is Abu Talib.’ He said: ‘so and so asked me to convey a message to you, that so and so killed him for a camel’s rope.’ Abu Talib went to him and said: ‘Choose one of three alternatives that we are offering you. If you wish, you may give us one hundred camels, because you killed our companion by mistake; or if you wish, fifty of your men may swear an oath that you did not kill him; or if you wish, we will kill you in retaliation.’ He went to his people and told them about that, and they said: ‘We will swear the oath.’ Then a woman from Banu Hashim, who was married to one of their men and had borne him a child, came to Abu Talib and said: ‘AbuTalib, I wish that my son, who is one of these fifty men, should be excused from having to take the oath.’ So he excused him. Then one of the men came to him and said: ‘Ab Talib, you want fifty men to take the oath in lieu of one hundred camels, which means that each man may give two camels instead, so here are two camels; take them from me, and do not make me take the oath So he accepted them, and did not make him take the oath. Then forty-eight men came and took the oath.” lbn ‘Abbas said: “By the One in Whose hand is my soul, by the time a year had passed, none of those forty- eight men remained alive.” (Sahih).

أَخْبَرَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ وَيُونُسُ بْنُ عَبْدِ الْأَعْلَی قَالَ أَنْبَأَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي يُونُسُ عَنْ ابْنِ شِهَابٍ قَالَ أَحْمَدُ بْنُ عَمْرٍو قَالَ أَخْبَرَنِي أَبُو سَلَمَةَ وَسُلَيْمَانُ بْنُ يَسَارٍ عَنْ رَجُلٍ مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ الْأَنْصَارِ أَنَّ رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَقَرَّ الْقَسَامَةَ عَلَی مَا کَانَتْ عَلَيْهِ فِي الْجَاهِلِيَّةِ

Abu Salamah and Sulaiman bin Yasar narrated from one of the Companions of the Messenger of Allah صلی اللہ علیہ وآلہ وسلم one of the Ansar, that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم approved of Qasamah as it had been during the Jahii. (Sahih)

أَخْبَرَنَا مُحَمَّدُ بْنُ هَاشِمٍ قَالَ حَدَّثَنَا الْوَلِيدُ قَالَ حَدَّثَنَا الْأَوْزَاعِيُّ عَنْ ابْنِ شِهَابٍ عَنْ أَبِي سَلَمَةَ وَسُلَيْمَانَ بْنِ يَسَارٍ عَنْ أُنَاسٍ مِنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ الْقَسَامَةَ کَانَتْ فِي الْجَاهِلِيَّةِ فَأَقَرَّهَا رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَی مَا کَانَتْ عَلَيْهِ فِي الْجَاهِلِيَّةِ وَقَضَی بِهَا بَيْنَ أُنَاسٍ مِنْ الْأَنْصَارِ فِي قَتِيلٍ ادَّعَوْهُ عَلَی يَهُودِ خَيْبَرَ خَالَفَهُمَا مَعْمَرٌ

It was narrated from Abu Salamah and Sulaiman bin Yasar, from some of the Companions of the Messenger of Allah صلی اللہ علیہ وآلہ وسلم that Qasamah existed during the Jahiliyyah and the Messenger of Allah صلی اللہ علیہ وآلہ وسلم approved of it as it had been during the Jahii and he ruled accordingly among some of the Ansar concerning a victim whom they claimed the Jews of Khaibar had killed. (Sahih) Ma’mar contradicted the two of them.

أَخْبَرَنَا مُحَمَّدُ بْنُ رَافِعٍ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَنْبَأَنَا مَعْمَرٌ عَنْ الزُّهْرِيِّ عَنْ ابْنِ الْمُسَيَّبِ قَالَ کَانَتْ الْقَسَامَةُ فِي الْجَاهِلِيَّةِ ثُمَّ أَقَرَّهَا رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْأَنْصَارِيِّ الَّذِي وُجِدَ مَقْتُولًا فِي جُبِّ الْيَهُودِ فَقَالَتْ الْأَنْصَارُ الْيَهُودُ قَتَلُوا صَاحِبَنَا

It was narrated that Ibn Al Masayyab said: “Qasamah existed during the Jahiliyyah, then the Messenger of Allah صلی اللہ علیہ وآلہ وسلم conffrmed it in the case of an Ansari who was found slain in the thy well of the Jews, and Ansdr said: ‘The Jews killed our companion” (Sahih).

أَخْبَرَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ قَالَ أَنْبَأَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي مَالِکُ بْنُ أَنَسٍ عَنْ أَبِي لَيْلَی بْنِ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ الْأَنْصَارِيِّ أَنَّ سَهْلَ بْنَ أَبِي حَثْمَةَ أَخْبَرَهُ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ خَرَجَا إِلَی خَيْبَرَ مِنْ جَهْدٍ أَصَابَهُمَا فَأُتِيَ مُحَيِّصَةُ فَأُخْبِرَ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَدْ قُتِلَ وَطُرِحَ فِي فَقِيرٍ أَوْ عَيْنٍ فَأَتَی يَهُودَ فَقَالَ أَنْتُمْ وَاللَّهِ قَتَلْتُمُوهُ فَقَالُوا وَاللَّهِ مَا قَتَلْنَاهُ ثُمَّ أَقْبَلَ حَتَّی قَدِمَ عَلَی رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَکَرَ ذَلِکَ لَهُ ثُمَّ أَقْبَلَ هُوَ وَحُوَيِّصَةُ وَهُوَ أَخُوهُ أَکْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ فَذَهَبَ مُحَيِّصَةُ لِيَتَکَلَّمَ وَهُوَ الَّذِي کَانَ بِخَيْبَرَ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ کَبِّرْ کَبِّرْ وَتَکَلَّمَ حُوَيِّصَةُ ثُمَّ تَکَلَّمَ مُحَيِّصَةُ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ إِمَّا أَنْ يَدُوا صَاحِبَکُمْ وَإِمَّا أَنْ يُؤْذَنُوا بِحَرْبٍ فَکَتَبَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِکَ فَکَتَبُوا إِنَّا وَاللَّهِ مَا قَتَلْنَاهُ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ تَحْلِفُونَ وَتَسْتَحِقُّونَ دَمَ صَاحِبِکُمْ قَالُوا لَا قَالَ فَتَحْلِفُ لَکُمْ يَهُودُ قَالُوا لَيْسُوا مُسْلِمِينَ فَوَدَاهُ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عِنْدِهِ فَبَعَثَ إِلَيْهِمْ بِمِائَةِ نَاقَةٍ حَتَّی أُدْخِلَتْ عَلَيْهِمْ الدَّارَ قَالَ سَهْلٌ لَقَدْ رَکَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَائُ

It was narrated from Sahl bin Abi Hathmah that ‘Abdullah bin Sahl and Muhayysah set out for Khaibar because of some problem that had arisen. Someone came to Muhayysah and he told him that ‘Abdullah bin Sahl had been killed and thrown into a pit, or a well. He came to the Jews and said: “By Allah, you killed him.” They said: “By Allah, we did not kill him.” Then he went back to the Messenger of Allah صلی اللہ علیہ وآلہ وسلم and told him about that. Then he and Huwayysah — his brother who was older than him — and ‘Abdulah bin SahI, came (to the Prophet صلی اللہ علیہ وآلہ وسلم ). Muhayysah who was the one who had been at Khaibar, began to speak, but the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Let the elder speak first.” So Huwayysah spoke, then Muhavysah spoke. The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Either (the Jews) will pay the Diyah for your companion, or war will be declared on them.” The Messenger Allah صلی اللہ علیہ وآلہ وسلم sent a letter to that effect (to the Jews) and they wrote back saying: “By Allah, we did not kill him.” The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said to Huwayysah, Muhayyasah and ‘Abdur-Rahman: “Will you swear an oath establishing your claim to the blood money of your companion? They said: No. He said: “Should the Jews swear an oath for you?” They said: “They are not Muslims.” So the Messenger of Allah صلی اللہ علیہ وآلہ وسلمpaid (the Diyah) himself, and he sent one hundred she-camels to their abodes. Sahl said: “A red she-camel from among them kicked me.” (Sahih)

أَخْبَرَنَا مُحَمَّدُ بْنُ سَلَمَةَ قَالَ أَنْبَأَنَا ابْنُ الْقَاسِمِ قَالَ حَدَّثَنِي مَالِکٌ عَنْ أَبِي لَيْلَی بْنِ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ سَهْلٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ أَنَّهُ أَخْبَرَهُ وَرِجَالٌ کُبَرَائُ مِنْ قَوْمِهِ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ خَرَجَا إِلَی خَيْبَرَ مِنْ جَهْدٍ أَصَابَهُمْ فَأَتَی مُحَيِّصَةُ فَأَخْبَرَ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَدْ قُتِلَ وَطُرِحَ فِي فَقِيرٍ أَوْ عَيْنٍ فَأَتَی يَهُودَ وَقَالَ أَنْتُمْ وَاللَّهِ قَتَلْتُمُوهُ قَالُوا وَاللَّهِ مَا قَتَلْنَاهُ فَأَقْبَلَ حَتَّی قَدِمَ عَلَی قَوْمِهِ فَذَکَرَ لَهُمْ ثُمَّ أَقْبَلَ هُوَ وَأَخُوهُ حُوَيِّصَةُ وَهُوَ أَکْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ فَذَهَبَ مُحَيِّصَةُ لِيَتَکَلَّمَ وَهُوَ الَّذِي کَانَ بِخَيْبَرَ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ لِمُحَيِّصَةَ کَبِّرْ کَبِّرْ يُرِيدُ السِّنَّ فَتَکَلَّمَ حُوَيِّصَةُ ثُمَّ تَکَلَّمَ مُحَيِّصَةُ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ إِمَّا أَنْ يَدُوا صَاحِبَکُمْ وَإِمَّا أَنْ يُؤْذَنُوا بِحَرْبٍ فَکَتَبَ إِلَيْهِمْ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِکَ فَکَتَبُوا إِنَّا وَاللَّهِ مَا قَتَلْنَاهُ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ أَتَحْلِفُونَ وَتَسْتَحِقُّونَ دَمَ صَاحِبِکُمْ قَالُوا لَا قَالَ فَتَحْلِفُ لَکُمْ يَهُودُ قَالُوا لَيْسُوا بِمُسْلِمِينَ فَوَدَاهُ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عِنْدِهِ فَبَعَثَ إِلَيْهِمْ بِمِائَةِ نَاقَةٍ حَتَّی أُدْخِلَتْ عَلَيْهِمْ الدَّارَ قَالَ سَهْلٌ لَقَدْ رَکَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَائُ

It was narrated from Abu Laila bin ‘Abdullah bin ‘Abdur Rahman bin Sahl, from Sahl bin Abi Hathmah, that he informed him, and some men among the elders of his people, that ‘Abdullah bin Sahl and Muhayysah set out for Khaibar because of some problem that had arisen. Someone came to Muhayy and he told him that ‘Abdullah bin Sahl had been killed and thrown into a pit or well. He came to the Jews and said: “By Allah, you killed him.” They said: “By Allah, we did not kill him.” Then he went back to his people and told them about that. Then he and his brother Huwayysah, who was older than him, and ‘Abdur Rahman bin Sahi, came (to the Prophet صلی اللہ علیہ وآلہ وسلم Muhayysah, who was the one who had been at Khaibar, began to speak, but the Messenger of Allah صلی اللہ علیہ وآلہ وسلم i said: “Let the elder speak first.” So Uuwayysah spoke, then Muhayysah spoke. The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Either (the Jews) will pay the Diyah for your companion, or war will be declared on them.” The Messenger of Allah صلی اللہ علیہ وآلہ وسلم sent a letter to that effect (to the Jews) and they wrote back saying: “By Allah, we did not kill him.” The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said to Huwayysah, Muhayysah and ‘Abdur-Rahman: “Will you swear an oath establishing your claim to the blood money of your companion?” They said: “No.” He said: “Should the Jews swear an oath for you?” They said: “They are not Muslims.” So the Messenger of Allah صلی اللہ علیہ وآلہ وسلم paid it himself, and he sent one hundred she-camels to their abodes. Sahl said: “A red she-camel from among them kicked me.” (Sahih)

أَخْبَرَنَا قُتَيْبَةُ قَالَ حَدَّثَنَا اللَّيْثُ عَنْ يَحْيَی عَنْ بُشَيْرِ بْنِ يَسَارٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ قَالَ وَحَسِبْتُ قَالَ وَعَنْ رَافِعِ بْنِ خَدِيجٍ أَنَّهُمَا قَالَا خَرَجَ عَبْدُ اللَّهِ بْنُ سَهْلِ بْنِ زَيْدٍ وَمُحَيِّصَةُ بْنُ مَسْعُودٍ حَتَّی إِذَا کَانَا بِخَيْبَرَ تَفَرَّقَا فِي بَعْضِ مَا هُنَالِکَ ثُمَّ إِذَا بِمُحَيِّصَةَ يَجِدُ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَتِيلًا فَدَفَنَهُ ثُمَّ أَقْبَلَ إِلَی رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ هُوَ وَحُوَيِّصَةُ بْنُ مَسْعُودٍ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَکَانَ أَصْغَرَ الْقَوْمِ فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَکَلَّمُ قَبْلَ صَاحِبَيْهِ فَقَالَ لَهُ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ کَبِّرْ الْکُبْرَ فِي السِّنِّ فَصَمَتَ وَتَکَلَّمَ صَاحِبَاهُ ثُمَّ تَکَلَّمَ مَعَهُمَا فَذَکَرُوا لِرَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مَقْتَلَ عَبْدِ اللَّهِ بْنِ سَهْلٍ فَقَالَ لَهُمْ أَتَحْلِفُونَ خَمْسِينَ يَمِينًا وَتَسْتَحِقُّونَ صَاحِبَکُمْ أَوْ قَاتِلَکُمْ قَالُوا کَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ قَالَ فَتُبَرِّئُکُمْ يَهُودُ بِخَمْسِينَ يَمِينًا قَالُوا وَکَيْفَ نَقْبَلُ أَيْمَانَ قَوْمٍ کُفَّارٍ فَلَمَّا رَأَی ذَلِکَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَعْطَاهُ عَقْلَهُ

It was narrated from Yahya, from Bushair bin Yasá, from Sahl bin Abi Hathmah who said — and I think he said: and from Rafi’ bin Khadij, the two of them said — “Abdullah bin Sahl bin Zaid and Mubayy bin Mas’ud went out until when they reached Khaibar, they went their separate ways. Then Mu found ‘Abdullah bin Sahl slain, so he buried him. Then he came to the Messenger of Allah صلی اللہ علیہ وآلہ وسلم along with uwayy bin Mas’ud and ‘Abdur-Rahman bin Sahl, who was the youngest of them. ‘Abdur Rahman started to speak before his two companions, but the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said to him: “Let the elder speak first.” So he fell silent and his two companions spoke, then he spoke with them. They told the Messenger of Allah صلی اللہ علیہ وآلہ وسلم about the killing of ‘Abdullah bin Sahi, and he said to them: “Will you swear fifty oaths, then you will receive compensation, or be entitled to retaliate?” They said: “How can we swear an oath when we did not witness what happened?” He said: “Then can the Jews swear fifty oaths declaring their innocence?” They said: “How can we accept the oath of a disbelieving people?” When the Messenger of Allah صلی اللہ علیہ وآلہ وسلم saw that, he paid the blood money (himself). أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدَةَ قَالَ أَنْبَأَنَا حَمَّادٌ قَالَ حَدَّثَنَا يَحْيَی بْنُ سَعِيدٍ عَنْ بُشَيْرِ بْنِ يَسَارٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ وَرَافِعِ بْنِ خَدِيجٍ أَنَّهُمَا حَدَّثَاهُ أَنَّ مُحَيِّصَةَ بْنَ مَسْعُودٍ وَعَبْدَ اللَّهِ بْنَ سَهْلٍ أَتَيَا خَيْبَرَ فِي حَاجَةٍ لَهُمَا فَتَفَرَّقَا فِي النَّخْلِ فَقُتِلَ عَبْدُ اللَّهِ بْنُ سَهْلٍ فَجَائَ أَخُوهُ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَحُوَيِّصَةُ وَمُحَيِّصَةُ ابْنَا عَمِّهِ إِلَی رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَتَکَلَّمَ عَبْدُ الرَّحْمَنِ فِي أَمْرِ أَخِيهِ وَهُوَ أَصْغَرُ مِنْهُمْ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ الْکُبْرَ لِيَبْدَأْ الْأَکْبَرُ فَتَکَلَّمَا فِي أَمْرِ صَاحِبِهِمَا فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ وَذَکَرَ کَلِمَةً مَعْنَاهَا يُقْسِمُ خَمْسُونَ مِنْکُمْ فَقَالُوا يَا رَسُولَ اللَّهِ أَمْرٌ لَمْ نَشْهَدْهُ کَيْفَ نَحْلِفُ قَالَ فَتُبَرِّئُکُمْ يَهُودُ بِأَيْمَانِ خَمْسِينَ مِنْهُمْ قَالُوا يَا رَسُولَ اللَّهِ قَوْمٌ کُفَّارٌ فَوَدَاهُ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ قِبَلِهِ قَالَ سَهْلٌ فَدَخَلْتُ مِرْبَدًا لَهُمْ فَرَکَضَتْنِي نَاقَةٌ مِنْ تِلْکَ الْإِبِلِ

It was narrated from Sahl bin Abi Hathmah and Rafi’ bin Khadij that Muhayysah bin Mas’ud and ‘Abdullah bin Sahl went to Khaibar for some need they had there, and they parted among the palm trees. ‘Abdullah bin Sahl was killed, and his brother ‘Abdur-Rahman bin SahI, and iluwayysah, and Muhis paternal cousins, came to the Messenger of Allah صلی اللہ علیہ وآلہ وسلم ‘Abdur-Ral spoke about his brother’s case, but he was the youngest of them, so the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Let the elders speak first.” So they spoke about their companion, and the Messenger of Allah صلی اللہ علیہ وآلہ وسلم th said: “Let fifty of you swear an oath.” They said: “Messenger of Allah صلی اللہ علیہ وآلہ وسلم, it is something that we did not witness; how can we swear an oath?” He said: “Then let the Jews swear fifty oaths to their innocence.” They said: “Messenger of Allah صلی اللہ علیہ وآلہ وسلم, (they are) a disbelieving people.” So the Messenger of Allah صلی اللہ علیہ وآلہ وسلم paid the blood money himself. Sahl said: “I entered a Mirbad of theirs, and one of those camels kicked me.” (Sahih)

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا بِشْرٌ وَهُوَ ابْنُ الْمُفَضَّلِ قَالَ حَدَّثَنَا يَحْيَی بْنُ سَعِيدٍ عَنْ بُشَيْرِ بْنِ يَسَارٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ بْنَ مَسْعُودِ بْنِ زَيْدٍ أَنَّهُمَا أَتَيَا خَيْبَرَ وَهُوَ يَوْمَئِذٍ صُلْحٌ فَتَفَرَّقَا لِحَوَائِجِهِمَا فَأَتَی مُحَيِّصَةُ عَلَی عَبْدِ اللَّهِ بْنِ سَهْلٍ وَهُوَ يَتَشَحَّطُ فِي دَمِهِ قَتِيلًا فَدَفَنَهُ ثُمَّ قَدِمَ الْمَدِينَةَ فَانْطَلَقَ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَحُوَيِّصَةُ وَمُحَيِّصَةُ إِلَی رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَکَلَّمُ وَهُوَ أَحْدَثُ الْقَوْمِ سِنًّا فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ کَبِّرْ الْکُبْرَ فَسَکَتَ فَتَکَلَّمَا فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ أَتَحْلِفُونَ بِخَمْسِينَ يَمِينًا مِنْکُمْ فَتَسْتَحِقُّونَ دَمَ صَاحِبِکُمْ أَوْ قَاتِلِکُمْ قَالُوا يَا رَسُولَ اللَّهِ کَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ وَلَمْ نَرَ قَالَ تُبَرِّئُکُمْ يَهُودُ بِخَمْسِينَ يَمِينًا قَالُوا يَا رَسُولَ اللَّهِ کَيْفَ نَأْخُذُ أَيْمَانَ قَوْمٍ کُفَّارٍ فَعَقَلَهُ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عِنْدِهِ

It was narrated from Sahl bin Abi Hathmah that ‘Abdullah bin Sahl and Mul bin Mas’ud bin Zaid went to Khaibar, and at that time there was a peace treaty. They went their separate ways to go about their business, then Muliayy came upon ‘Abdullah bin Sahl lying dead in a pool of blood. He buried him, then he came to Al-Madinah. ‘Abdur Rahnian bin Sahl, Huwayysah, and Mubayy came to the Messenger of Allah صلی اللہ علیہ وآلہ وسلم and ‘Abdur-Rahman to speak, but he was the youngest of them, so the essenger of Allah said: “Let the elders speak first.” So he fell silent and they (the other two) spoke. The Messenger of Allah صلی اللہ علیہ وآلہ وسلم i said: “Will you swear fifty oaths, then you will receive compensation or be entitled to retaliate?” They said: “Messenger of Allah صلی اللہ علیہ وآلہ وسلم, how can we swear an oath when we did not witness, and did not see (what happened)?” He said: “Then can the Jews swear fifty oaths declaring their innocence?” They said: “Messenger of Allah صلی اللہ علیہ وآلہ وسلم, how can we accept the oath of a disbelieving people?” So the Messenger of Allah صلی اللہ علیہ وآلہ وسلم paid the blood money himself. أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ قَالَ حَدَّثَنَا عَبْدُ الْوَهَّابِ قَالَ سَمِعْتُ يَحْيَی بْنَ سَعِيدٍ يَقُولُ أَخْبَرَنِي بُشَيْرُ بْنُ يَسَارٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ الْأَنْصَارِيَّ وَمُحَيِّصَةَ بْنَ مَسْعُودٍ خَرَجَا إِلَی خَيْبَرَ فَتَفَرَّقَا فِي حَاجَتِهِمَا فَقُتِلَ عَبْدُ اللَّهِ بْنُ سَهْلٍ الْأَنْصَارِيُّ فَجَائَ مُحَيِّصَةُ وَعَبْدُ الرَّحْمَنِ أَخُو الْمَقْتُولِ وَحُوَيِّصَةُ بْنُ مَسْعُودٍ حَتَّی أَتَوْا رَسُولَ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَکَلَّمُ فَقَالَ لَهُ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ الْکُبْرَ الْکُبْرَ فَتَکَلَّمَ مُحَيِّصَةُ وَحُوَيِّصَةُ فَذَکَرُوا شَأْنَ عَبْدِ اللَّهِ بْنِ سَهْلٍ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ تَحْلِفُونَ خَمْسِينَ يَمِينًا فَتَسْتَحِقُّونَ قَاتِلَکُمْ قَالُوا کَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ وَلَمْ نَحْضُرْ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَتُبَرِّئُکُمْ يَهُودُ بِخَمْسِينَ يَمِينًا قَالُوا يَا رَسُولَ اللَّهِ کَيْفَ نَقْبَلُ أَيْمَانَ قَوْمٍ کُفَّارٍ قَالَ فَوَدَاهُ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ بُشَيْرٌ قَالَ لِي سَهْلُ بْنُ أَبِي حَثْمَةَ لَقَدْ رَکَضَتْنِي فَرِيضَةٌ مِنْ تِلْکَ الْفَرَائِضِ فِي مِرْبَدٍ لَنَا

It was narrated from Sahl bin Abi Hathmah that ‘Abdullah bin Sahl Al-Ansari and Muha bin Mas’ud went out to Khaibar and went their separate ways to go about their business. ‘Abdullah bin Sahl Al-Ansari was killed, and Muhayysah, ‘Abdur-Rahman, who was the brother of the victim, and Huwayysah, came to the Messenger of Allah صلی اللہ علیہ وآلہ وسلم‘Abdur-Rahman started to speak, but the Prophet صلی اللہ علیہ وآلہ وسلم said to him: “Let the elders speak first.” So Mu and IIuwayy spoke and told him about the case of ‘Abdullah bin Sahl. The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Will you swear fifty oaths, then you will receive compensation or be entitled to retaliate?” They said: “How can we swear an oath when we did not witness (what happened) and we were not there?” The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Then can the Jews swear fifty oaths declaring their innocence?” They said: “Messenger of Allah صلی اللہ علیہ وآلہ وسلم, how can we accept the oath of a disbelieving people?” So the Messenger of Allah صلی اللہ علیہ وآلہ وسلم paid the blood money himself. (One of the narrators) Bushair said: “Sahl bin Abi Hathmah told me: ‘One of those camels kicked me in a Mirbad of ours.” (Sahih)

أَخْبَرَنَا مُحَمَّدُ بْنُ مَنْصُورٍ قَالَ حَدَّثَنَا سُفْيَانُ قَالَ حَدَّثَنَا يَحْيَی بْنُ سَعِيدٍ عَنْ بُشَيْرِ بْنِ يَسَارٍ عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ قَالَ وُجِدَ عَبْدُ اللَّهِ بْنُ سَهْلٍ قَتِيلًا فَجَائَ أَخُوهُ وَعَمَّاهُ حُوَيِّصَةُ وَمُحَيِّصَةُ وَهُمَا عَمَّا عَبْدِ اللَّهِ بْنِ سَهْلٍ إِلَی رَسُولِ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَکَلَّمُ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ الْکُبْرَ الْکُبْرَ قَالَا يَا رَسُولَ اللَّهِ إِنَّا وَجَدْنَا عَبْدَ اللَّهِ بْنَ سَهْلٍ قَتِيلًا فِي قَلِيبٍ مِنْ بَعْضِ قُلُبِ خَيْبَرَ فَقَالَ النَّبِيُّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ تَتَّهِمُونَ قَالُوا نَتَّهِمُ الْيَهُودَ قَالَ أَفَتُقْسِمُونَ خَمْسِينَ يَمِينًا أَنَّ الْيَهُودَ قَتَلَتْهُ قَالُوا وَکَيْفَ نُقْسِمُ عَلَی مَا لَمْ نَرَ قَالَ فَتُبَرِّئُکُمْ الْيَهُودُ بِخَمْسِينَ أَنَّهُمْ لَمْ يَقْتُلُوهُ قَالُوا وَکَيْفَ نَرْضَی بِأَيْمَانِهِمْ وَهُمْ مُشْرِکُونَ فَوَدَاهُ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ مِنْ عِنْدِهِ أَرْسَلَهُ مَالِکُ بْنُ أَنَسٍ

It was narrated that Sahl bin Abi Hathmah said: “Abdullah bin Sahl was found slain, and his brother, and two paternal uncles, uwayy and Huwayisah, who were the paternal uncles of ‘Abdullah bin Sahl, came to the Messenger of Allah صلی اللہ علیہ وآلہ وسلم‘Abdur Rahman started to speak, but the Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Let the elders speak first.” They said: “Messenger of Allah صلی اللہ علیہ وآلہ وسلم, we found ‘Abdullah bin Sahl slain in one of the dry wells of Khaibar.” The Prophet صلی اللہ علیہ وآلہ وسلم said: “Whom do you suspect?” They said: “We suspect the Jews.” He said: “Will you swear fifty oaths saying that the Jews killed him?” They said: “How can we swear an oath about something that we did not see?” He said: “Then can the Jews swear fifty oaths declaring that they did not kill him?” They said: “How can we accept their oaths, when they are Mushriki So the Messenger of Allah صلی اللہ علیہ وآلہ وسلم paid the blood money himself. (Sahih) Malik narrated this in Mursal form.
