حَدَّثَنَا سُوَيْدُ بْنُ سَعِيدٍ، وَالْحَسَنُ بْنُ عُثْمَانَ قَالَا: حَدَّثَنَا الْوَلِيدُ بْنُ مُحَمَّدٍ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّ فَاطِمَةَ بِنْتَ رَسُولِ اللَّهِ، صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَرْسَلَتْ إِلَى أَبِي بَكْرٍ رَضِيَ اللَّهُ عَنْهُ تَسْأَلُهُ مِيرَاثَهَا مِنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مِمَّا أَفَاءَ اللَّهُ عَلَى رَسُولِهِ، وَفَاطِمَةُ حِينَئِذٍ تَطْلُبُ صَدَقَةَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الَّتِي بِالْمَدِينَةِ وَفَدَكٍ وَمَا بَقِيَ مِنْ خُمُسِ خَيْبَرَ فَقَالَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: إِنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَا نُورَثُ، مَا تَرَكْنَا صَدَقَةٌ، إِنَّمَا يَأْكُلُ آلُ مُحَمَّدٍ مِنْ هَذَا الْمَالِ» ، وَإِنِّي لَا أُغَيِّرُ شَيْئًا مِنْ صَدَقَةِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنْ حَالِهَا الَّتِي كَانَتْ عَلَيْهَا فِي عَهْدِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَلَأَعْمَلَنَّ فِيهَا بِمَا عَمِلَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَأَبَى أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ أَنْ يَدْفَعَ إِلَى فَاطِمَةَ رَضِيَ اللَّهُ عَنْهَا مِنْهَا شَيْئًا، فَوَجَدَتْ [ص:197] فَاطِمَةُ عَلَى أَبِي بَكْرٍ رَضِيَ اللَّهُ عَنْهُ فِي ذَلِكَ، فَهَجَرَتْهُ فَلَمْ تُكَلِّمْهُ حَتَّى تُوُفِّيَتْ، وَعَاشَتْ بَعْدَ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ سِتَّةَ أَشْهُرٍ. فَلَمَّا تُوُفِّيَتْ دَفَنَهَا زَوْجُهَا عَلِيٌّ لَيْلًا، وَلَمْ يُؤْذِنْ بِهَا أَبَا بَكْرٍ، وَصَلَّى عَلَيْهَا عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ "

حَدَّثَنَا إِسْحَاقُ بْنُ إِدْرِيسَ قَالَ: حَدَّثَنَا مُحَمَّدُ بْنُ ثَوْرٍ، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّ فَاطِمَةَ، وَالْعَبَّاسَ رَضِيَ اللَّهُ عَنْهُمَا أَتَيَا أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ يَلْتَمِسَانِ مِيرَاثَهُمَا مِنْ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَهُمَا حِينَئِذٍ يَطْلُبَانِ أَرْضَهُ مِنْ فَدَكٍ، وَسَهْمَهُ مِنْ خَيْبَرَ فَقَالَ لَهُمَا أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: إِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «لَا نُورَثُ، مَا تَرَكْنَا صَدَقَةٌ، إِنَّمَا يَأْكُلُ آلُ مُحَمَّدٍ مِنْ هَذَا الْمَالِ» ، وَإِنِّي وَاللَّهِ لَا أُغَيِّرُ أَمْرًا رَأَيْتُ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَصْنَعُهُ إِلَّا صَنَعْتُهُ. قَالَ: فَهَجَرَتْهُ فَاطِمَةُ رَضِيَ اللَّهُ عَنْهَا، فَلَمْ تُكَلِّمْهُ فِي ذَلِكَ الْمَالِ حَتَّى مَاتَتْ "

حَدَّثَنَا عَمْرُو بْنُ عَاصِمٍ، وَمُوسَى بْنُ إِسْمَاعِيلَ قَالَا: حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، عَنِ الْكَلْبِيِّ، عَنْ أَبِي صَالِحٍ، عَنْ أُمِّ هَانِئٍ أَنَّ [ص:198] فَاطِمَةَ رَضِيَ اللَّهُ عَنْهَا قَالَتْ لِأَبِي بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: مَنْ يَرِثُكَ إِذَا مُتَّ؟ قَالَ: وَلَدِي وَأَهْلِي قَالَتْ: فَمَا لَكَ تَرِثُ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ دُونَنَا؟ قَالَ: يَا بِنْتَ رَسُولِ اللَّهِ، مَا وَرِثْتُ أَبَاكِ دَارًا وَلَا مَالًا وَلَا ذَهَبًا وَلَا فِضَّةً قَالَتْ: بَلَى، سَهْمُ اللَّهِ الَّذِي جَعَلَهُ لَنَا، وَصَافِيَتُنَا الَّتِي بِفَدَكٍ فَقَالَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: سَمِعْتُ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «إِنَّمَا هِيَ طُعْمَةٌ أَطْعَمَنَا اللَّهُ، فَإِذَا مُتُّ كَانَتْ بَيْنَ الْمُسْلِمِينَ»

حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ قَالَ: حَدَّثَنَا مُحَمَّدُ بْنُ فُضَيْلٍ، عَنِ الْوَلِيدِ بْنِ جُمَيْعٍ، عَنْ أَبِي الطُّفَيْلِ قَالَ: أَرْسَلَتْ فَاطِمَةُ بِنْتُ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ إِلَى أَبِي بَكْرٍ رَضِيَ اللَّهُ عَنْهُ قَالَتْ: يَا خَلِيفَةَ رَسُولِ اللَّهِ، أَنْتَ وَرِثْتَ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَمْ أَهْلُهُ؟ قَالَ: لَا، بَلْ أَهْلُهُ، قَالَتْ: فَمَا بَالُ سَهْمِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ؟ قَالَ: إِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «إِنَّ اللَّهَ عَزَّ وَجَلَّ إِذَا أَطْعَمَ نَبِيًّا طُعْمَةً ثُمَّ قَبَضَهُ جَعَلَهُ لِلَّذِي يَقُومُ مِنْ بَعْدِهِ» ، فَرَأَيْتُ أَنَا بَعْدُ أَنْ أَرُدَّهُ عَلَى الْمُسْلِمِينَ قَالَتْ: أَنْتَ وَمَا سَمِعْتَ مِنَ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَعْلَمُ "

إِنِّي ← فَمَا بَالُ سَهْمِ رَسُولِ اللَّهِ ← لا بل أهله ← يا خليفة رسول الله أنت ورثت رسول الله أم أهله ← أَرْسَلَتْ فَاطِمَةُ بِنْتُ رَسُولِ اللَّهِ إِلَى أَبِي بَكْرٍ ← أَبِي الطُّفَيْلِ، ← الْوَلِيدِ بْنِ جُمَيْعٍ ← مُحَمَّدُ بْنُ فُضَيْلٍ ← أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ،

حَدَّثَنَا الْقَعْنَبِيُّ قَالَ: حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو، وَعَنْ أَبِي سَلَمَةَ، أَنَّ فَاطِمَةَ بِنْتَ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَتَتْ أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ فَذَكَرَتْ لَهُ مَا أَفَاءَ اللَّهُ عَلَى رَسُولِهِ بِفَدَكٍ فَقَالَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: إِنِّي سَمِعْتُ النَّبِيَّ صلّى الله [ص:199] عليه وسلم يَقُولُ: «إِنَّ النَّبِيَّ لَا يُورَثُ» ، مَنْ كَانَ النَّبِيُّ يَعُولُهُ، فَأَنَا أَعُولُهُ، وَمَنْ كَانَ يُنْفِقُ عَلَيْهِ فَأَنَا أُنْفِقُ عَلَيْهِ قَالَتْ: يَا أَبَا بَكْرٍ، أَتَرِثُكَ بَنَاتُكَ وَلَا تَرِثُ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ بَنَاتُهُ؟ ‍‍ قَالَ: هُوَ ذَاكَ "

حَدَّثَنَا ابْنُ أَبِي شَيْبَةَ قَالَ: حَدَّثَنَا مَالِكُ بْنُ إِسْمَاعِيلَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ حُمَيْدٍ الرُّوَاسِيِّ قَالَ: حَدَّثَنَا سُلَيْمَانُ يَعْنِي الْأَعْمَشَ، عَنْ إِسْمَاعِيلَ بْنِ رَجَاءٍ، عَنْ عُمَيْرٍ مَوْلَى ابْنِ عَبَّاسٍ قَالَ: " اخْتَصَمَ عَلِيٌّ وَالْعَبَّاسُ رَضِيَ اللَّهُ عَنْهُمَا إِلَى أَبِي بَكْرٍ فِي مِيرَاثِ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «مَا كُنْتُ لِأُحَوِّلَهُ عَنْ مَوْضِعِهِ الَّذِي وَضَعَهُ فِيهِ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ»

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الزُّبَيْرِ قَالَ: حَدَّثَنَا فُضَيْلُ بْنُ مَرْزُوقٍ قَالَ: حَدَّثَنِي النُّمَيْرِيُّ بْنُ حَيَّانَ قَالَ: قُلْتُ لِزَيْدِ بْنِ عَلِيٍّ رَحْمَةُ اللَّهِ عَلَيْهِ: وَأَنَا أُرِيدُ أَنْ أُهَجِّنَ أَمْرَ أَبِي بَكْرٍ: إِنَّ أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ انْتَزَعَ مِنْ فَاطِمَةَ رَضِيَ اللَّهُ عَنْهَا فَدَكَ. فَقَالَ: إِنَّ أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ كَانَ رَجُلًا رَحِيمًا، وَكَانَ يَكْرَهُ أَنْ يُغَيِّرَ شَيْئًا تَرَكَهُ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَأَتَتْهُ فَاطِمَةُ رَضِيَ اللَّهُ عَنْهَا فَقَالَتْ: إِنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَعْطَانِي فَدَكَ فَقَالَ لَهَا: هَلْ لَكِ عَلَى هَذَا بَيِّنَةٌ؟ فَجَاءَتْ بِعَلِيٍّ رَضِيَ اللَّهُ عَنْهُ فَشَهِدَ لَهَا، ثُمَّ جَاءَتْ بِأُمِّ أَيْمَنَ فَقَالَتْ: أَلَيْسَ تَشْهَدُ أَنِّي مِنْ أَهْلِ الْجَنَّةِ؟ قَالَ: بَلَى، قَالَ أَبُو أَحْمَدَ: يَعْنِي أَنَّهَا قَالَتْ ذَاكَ لِأَبِي بَكْرٍ وَعُمَرَ رَضِيَ اللَّهُ عَنْهُمَا قَالَتْ: فَأَشْهَدُ أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَعْطَاهَا فَدَكَ

قُلْتُ لِزَيْدِ بْنِ عَلِيٍّ عَلَيْهِ: ← النُّمَيْرِيُّ بْنُ حَيَّانَ ← فُضَيْلُ بْنُ مَرْزُوقٍ، ← مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الزُّبَيْرِ

فَقَالَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: فَبِرَجُلٍ وَامْرَأَةٍ تَسْتَحِقِّينَهَا، أَوْ تَسْتَحِقِّينَ، بِهَا الْقَضِيَّةَ؟ قَالَ زَيْدُ بْنُ عَلِيٍّ: وَايْمُ اللَّهِ، لَوْ رَجَعَ الْأَمْرُ إِلَيَّ لَقَضَيْتُ فِيهَا بِقَضَاءِ أَبِي بَكْرٍ رَضِيَ اللَّهُ عَنْهُ "

ايْمُ اللَّهِ، لَوْ رَجَعَ الْأَمْرُ إِلَيَّ لَقَضَيْتُ فِيهَا بِقَضَاءِ أَبِي بَكْرٍ ← زَيْدِ بْنِ عَلِيٍّ ← أَبُو بَكْرٍ فَبِرَجُلٍ وَامْرَأَةٍ تَسْتَحِقِّينَهَا، أَوْ تَسْتَحِقِّينَ، بِهَا الْقَضِيَّةَ؟
