Musnad Imam Shafi

أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ، عَنِ ابْنِ أَبِي ذِئْبٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا يَغْلَقُ الرَّهْنُ مِنْ صَاحِبِهِ الَّذِي رَهَنَهُ، لَهُ غُنْمُهُ وَعَلَيْهِ غُرْمُهُ» .

Mohammed bin Ismail told us, from Ibn Abi wolf, Ibn Shihab from Said ibn al-Musayyib: that the Messenger of Allah peace be upon him said: «does not close the mortgage from the owner, who mortgaged his flock and it Grema».

وَقَدْ أَخْبَرَنِي غَيْرُ وَاحِدٍ مِنْ أَهْلِ الْعِلْمِ، عَنْ يَحْيَى بْنِ أَبِي أُنَيْسَةَ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ الْمُسَيِّبِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَ حَدِيثِ ابْنِ أَبِي ذِئْبٍ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الرَّهْنِ، وَالثَّالِثَ وَالرَّابِعَ مِنْ كِتَابِ الرُّهُونِ وَالإِجَارَاتِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ أَبِيهِ: أَنَّ عَبْدَ اللَّهِ وَعُبَيْدَ اللَّهِ ابْنَيْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ خَرَجَا فِي جَيْشٍ إِلَى الْعِرَاقِ، فَلَمَّا قَفَلا، مَرَّا بِعَامِلٍ لِعُمَرَ رَضِيَ اللَّهُ عَنْهُمَا فَرَحَّبَ بِهِمَا وَسَهَّلَ وَهُوَ أَمِيرُ الْبَصْرَةِ، وَقَالَ: وَلَوْ أَقْدِرُ لَكُمَا عَلَى أَمْرٍ أَنْفَعُكُمَا بِهِ، لَفَعَلْتُ، ثُمَّ قَالَ: بَلَى إِنَّ هَهُنَا مَالا مِنْ مَالِ اللَّهِ تَعَالَى أُرِيدُ أَنْ أَبْعَثَ بِهِ إِلَى أَمِيرِ الْمُؤْمِنِينَ، فَأُسْلِفُكُمَاهُ فَتَبْتَاعَانِ بِهِ مَتَاعًا مِنْ مَتَاعِ الْعِرَاقِ، ثُمَّ تَبِيعَانِهِ بِالْمَدِينَةِ، فَتُؤَدِّيَانِ رَأْسَ الْمَالَ إِلَى أَمِيرِ الْمُؤْمِنِينَ، وَيَكُونُ لَكُمَا الرِّبْحُ، فَقَالا: وَدِدْنَا تَفْعَلُ، فَكَتَبَ لَهُمَا إِلَى عُمَرَ رَضِيَ اللَّهُ عَنْهُ أَنْ يَأْخُذَ مِنْهُمَا الْمَالَ، فَلَمَّا قَدِمَا الْمَدِينَةَ بَاعَا، فَرَبِحَا، فَلَمَّا دَفَعَا إِلَى عُمَرَ قَالَ لَهُمَا: أَكُلَّ الْجَيْشِ قَدْ أَسْلَفَهُ كَمَا أَسْلَفَكُمَا؟ فَقَالا: لا. فَقَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: ابْنَا أَمِيرِ الْمُؤْمِنِينَ فَأَسْلَفَكُمَا. أَدِّيَا الْمَالَ وَرِبْحَهُ فَأَمَّا عَبْدُ اللَّهِ، فَسَكَتَ، وَأَمَّا عُبَيْدُ اللَّهِ، فَقَالَ: مَا يَنْبَغِي لَكَ هَذَا يَا أَمِيرَ الْمُؤْمِنِينَ، لَوْ هَلَكَ الْمَالُ أَوْ نَقُصَ، لَضَمِنَّاهُ، فَقَالَ: أَدِّيَاهُ، فَسَكَتَ عَبْدُ اللَّهِ وَرَاجَعَهُ عُبَيْدُ اللَّهِ. فَقَالَ رَجُلٌ مِنْ جُلَسَاءِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ: يَا أَمِيرَ الْمُؤْمِنِينَ لَوْ جَعَلْتَهُ قِرَاضًا، فَأَخَذَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ رَأْسَ الْمَالِ وَنِصْفَ رِبْحِهِ، وَأَخَذَ عَبْدُ اللَّهِ وَعُبَيْدُ اللَّهِ نِصْفَ رِبْحِ ذَلِكَ الْمَالِ. أَخْرَجَهُ مِنْ كِتَابِ الرُّهُونِ وَالإِجَارَاتِ.

قَالَ الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ فِي كِتَابِهِ: قُلْتُ: أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ أَوْ غَيْرُهُ مِنْ أَهْلِ الصِّدْقِ فِي الْحَدِيثِ أَوْ هُمَا، عَنْ يَعْقُوبَ بْنِ إِبْرَاهِيمَ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ قَالَ: ابْتَاعَ عَبْدُ اللَّهِ بْنُ جَعْفَرٍ بَيْعًا، فَقَالَ عَلِيٌّ: لآتِيَنَّ عُثْمَانُ فَلأَحْجُرَنَّ عَلَيْكَ وَأَعْلَمَ ذَلِكَ ابْنُ جَعْفَرٍ الزُّبَيْرَ، فَقَالَ: أَنَا شَرِيكُكَ فِي بَيْعِكَ، فَأَتَى عُثْمَانَ، فَقَالَ: احْجُرْ عَلَى هَذَا. فَقَالَ الزُّبَيْرُ: أَنَا شَرِيكُهُ، فَقَالَ: عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ: أَحْجُرُ عَلَى رَجُلٍ شَرِيكُهُ الزُّبَيْرُ؟ أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، عَنْ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «أَيُّمَا رَجُلٍ أَفْلَسَ، فَأَدْرَكَ الرَّجُلُ مَالَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ» .

أَخْبَرَنَا عَبْدُ الْوَهَّابِ بْنُ عَبْدِ الْمَجِيدِ الثَّقَفِيُّ، أَنَّهُ سَمِعَ يَحْيَى بْنَ سَعِيدٍ، يَقُولُ: أَخْبَرَنِي أَبُو بَكْرِ بْنُ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ حَدَّثَهُ، أَنَّ أَبَا بَكْرِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ حَدَّثَهُ، أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، يَقُولُ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ أَدْرَكَ مَالَهُ بِعَيْنِهِ عِنْدَ رَجُلٍ قَدْ أَفْلَسَ، فَهُوَ أَحَقُّ بِهِ مِنْ غَيْرِهِ» .

عَبْدُ الْوَهَّابِ بْنُ عَبْدِ الْمَجِيدِ الثَّقَفِيُّ،

أَخْبَرَنَا ابْنُ أَبِي فُدَيْكٍ، عَنِ ابْنِ أَبِي ذِئْبٍ، قَالَ: حَدَّثَنِي ابْنُ الْمُعْتَمِرِ بْنُ عَمْرِو بْنِ رَافِعٍ، عَنْ أَبِي خَلْدَةَ الزُّرَقِيِّ وَكَانَ قَاضِيَ الْمَدِينَةِ، أَنَّهُ قَالَ: جِئْنَا أَبَا هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ فِي صَاحِبٍ لَنَا قَدْ أَفْلَسَ، فَقَالَ: هَذَا الَّذِي قَضَى فِيهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَيُّمَا رَجُلٍ مَاتَ أَوْ أَفْلَسَ، فَصَاحِبُ الْمَتَاعِ أَحَقُّ بِمَتَاعِهِ إِذَا وَجَدَهُ بِعَيْنِهِ» . أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ مِنْ كِتَابِ التَّفْلِيسِ، وَهِيَ مَا فِيهِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ زَيْدٍ مَوْلَى الْمُنْبَعِثِ، عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، أَنَّهُ قَالَ: جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَسَأَلَهُ عَنِ اللُّقَطَةِ، فَقَالَ: «اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ عَرِّفْهَا سَنَةً، فَإِنْ جَاءَ صَاحِبُهَا وَإِلا فَشَأْنُكَ بِهَا» .

زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ ← زَيْدٍ مَوْلَى الْمُنْبَعِثِ، ← رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ ← مَالِكٍ، ← الشَّافِعِیِّ،

أَخْبَرَنَا مَالِكٌ، عَنْ أَيُّوبَ بْنِ مُوسَى، عَنْ مُعَاوِيَةَ بْنِ عُبَيْدِ اللَّهِ بْنِ بَدْرٍ: أَنَّ أَبَاهُ أَخْبَرَهُ أَنَّهُ نَزَلَ مَنْزِلا بِطَرِيقِ الشَّامِ، فَوَجَدَ صُرَّةً فِيهَا ثَمَانُونَ دِينَارًا، فَذَكَرَ ذَلِكَ لِعُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ عُمَرُ: عَرِّفْهَا عَلَى أَبْوَابِ الْمَسْجِدِ، وَاذْكُرْهَا لِمَنْ يَقْدَمُ مِنَ الشَّامِ سَنَةً، فَإِذَا مَضَتِ السَّنَةُ فَشَأْنُكَ بِهَا.

مُعَاوِيَةَ بْنِ عُبَيْدِ اللَّهِ بْنِ بَدْرٍ: ← أَيُّوبَ بْنِ مُوسَی ← مَالِكٍ،

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ: أَنَّ رَجُلا وَجَدَ لَقُطَةً، فَجَاءَ إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ، فَقَالَ: إِنِّي وَجَدْتُ لُقَطَةً، فَمَاذَا تَرَى؟ فَقَالَ لَهُ ابْنُ عُمَرَ: عَرِّفْهَا. قَالَ: قَدْ فَعَلْتُ. قَالَ: زِدْ. قَالَ: قَدْ فَعَلْتُ. قَالَ: لا آمُرُكَ أَنْ تَأْكُلَهَا، وَلَوْ شِئْتَ لَمْ تَأْخُذْهَا. أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.س

أَخْبَرَنَا الثِّقَةُ، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَهُ، أَوْ مِثْلَ مَعْنَاهُ لا يُخَالِفُهُ.
