Musnad Imam Shafi

أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، قَالَ: أَخْبَرَنَا ابْنُ جُرَيْجٍ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، أَنَّهُ قَالَ: «الشُّفْعَةُ فِيمَا لَمْ يُقْسَمْ فَإِذَا وَقَعَتِ الْحُدُودُ فَلا شُفْعَةَ» . أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ.

قَالَ الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ: قَالَ: سُفْيَانُ أَخْبَرَهُ، عَنْ إِبْرَاهِيمَ بْنِ مَيْسَرَةَ، عَنْ عَمْرِو بْنِ الشَّرِيدِ، عَنْ أَبِي رَافِعٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «الْجَارُ أَحَقُّ بِشُفْعَتِهِ» أَخْرَجَهُ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، أَنَّ مَالِكًا أَخْبَرَهُ، عَنْ عَمْرِو بْنِ يَحْيَى الْمَازِنِيِّ، عَنْ أَبِيهِ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا ضَرَرَ وَلا إِضْرَارَ» .

Al-Shafi’i, may God be pleased with him, told us that Malik told him, “On the authority of Omar Bin Yahya Al-Mazeni, on the authority of his father, that the Messenger of God be upon him.”

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا يَمْنَعْ أَحَدُكُمْ جَارَهُ أَنْ يَغْرِزْ خَشَبَهُ فِي جِدَارِهِ» ، قَالَ: ثُمَّ يَقُولُ أَبُو هُرَيْرَةَ: مَا لِي أَرَاكُمْ عَنْهَا مُعْرِضِينَ؟ وَاللَّهِ لأَرْمِيَنَّ بِهَا بَيْنَ أَكْتَافِكُمْ.

أَخْبَرَنَا مَالِكٌ، عَنْ عَمْرِو بْنِ يَحْيَى الْمَازِنِيِّ، عَنْ أَبِيهِ: أَنَّ الضَّحَّاكَ بْنَ خَلِيفَةَ سَاقَ خَلِيجًا لَهُ مِنَ الْعَرِيضِ، فَأَرَادَ أَنْ يَمُرَّ بِهِ فِي أَرْضٍ لِمُحَمَّدِ بْنِ مَسْلَمَةَ. فَأَبَى مُحَمَّدُ بْنُ مَسْلَمَةَ، فَكَلَّمَ فِيهِ الضَّحَّاكُ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ. فَدَعَا مُحَمَّدَ بْنَ مَسْلَمَةَ فَأَمَرَهُ أَنْ يُخَلِّيَ سَبِيلَهُ، قَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ: لا. فَقَالَ عُمَرُ: لِمَ تَمْنَعُ أَخَاكَ مَا يَنْفَعُهُ وَهُوَ لَكَ أَنْفَعُ تَشْرَبُ بِهِ أَوَّلا وَآخِرًا وَلا يَضُرُّكَ، فَقَالَ مُحَمَّدُ بْنُ مَسْلَمَةَ: لا. فَقَالَ عُمَرُ: وَاللَّهِ لَيَمُرَّنَّ بِهِ وَلَوْ عَلَى بَطْنِكَ.

Malik, on the authority of Amru Bin Yahya Al-Mazzani, told us about his father: that the laughing son of Khalifah, he gave a bay for him from Arid, from Ar-Arid. Muhammad ibn Masalamah refused, and the laugher spoke to him, Omar Bin Al-Khattab, may God be pleased with him. Muhammad called Musallamah and commanded him to release him. قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا مَالِكٌ، عَنْ أَبِي الزِّنَادِ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ مَنَعَ فَضْلَ الْمَاءِ لِيَمْنَعَ بِهِ الْكَلأَ مَنَعَهُ اللَّهُ تَعَالَى فَضْلَ رَحْمَتِهِ يَوْمَ الْقِيَامَةِ» . أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَالرَّابِعَ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سَالِمٍ، عَنْ أَبِيهِ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، قَالَ: مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ.

Malik, on the authority of Ibn Shihab, told us on the authority of Salem, on the authority of his father: that Umar ibn Al-Khattab, may God be pleased with him, said: “Whoever lives in it.”

مَنْ أَحْيَا أَرْضًا مَيْتَةً فَهِيَ لَهُ. ← أَبِيهِ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ ← سَالِمٍ ← ابْنِ شِهَابٍ، ← مَالِكٍ،

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا سُفْيَانُ، عَنِ ابْنِ طَاوُسٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ أَحْيَا مَوَاتًا مِنَ الأَرْضِ فَهُوَ لَهُ، وَعَادِيُّ الأَرْضِ للَّهِ وَرَسُولِهِ ثُمَّ هِيَ لَكُمْ مِنِّي» .

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا مَالِكٌ، عَنْ هِشَامٍ، عَنْ أَبِيهِ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ أَحْيَا مَوَاتًا فَهُوَ لَهُ، وَلَيْسَ لِعِرْقِ ظَالِمٍ حَقٌّ» .

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ حَسَنِ بْنِ الْقَاسِمِ الأَزْرَقِيُّ، عَنْ أَبِيهِ، عَنْ عَلْقَمَةَ بْنِ نَضْلَةَ: أَنَّ أَبَا سُفْيَانَ بْنَ حَرْبٍ قَامَ بِفِنَاءِ دَارِهِ ثُمَّ ضَرَبَ بِرِجْلِهِ، وَقَالَ: سَنَامُ الأَرْضِ إِنَّ لَهَا سَنَامًا، زَعَمَ ابْنُ فَرْقَدٍ الأَسْلَمِيُّ أَنِّي لا أَعْرِفُ حَقِّي مِنْ حَقِّهِ لِي بَيَاضُ الْمَرْوَةِ وَلَهُ سَوَادُهَا، وَلِي مَا بَيْنَ كَذَا إِلَى كَذَا، فَبَلَغَ ذَلِكَ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: لَيْسَ لأَحَدٍ إِلا مَا أَحَاطَتْ عَلَيْهِ جُدْرَانُهُ، إِنَّ إِحْيَاءَ الْمَوَاتِ مَا يَكُونُ زَرْعًا أَوْ حَفْرًا أَوْ يُحَاطُ بِالْجُدُرَاتِ وَهُوَ مِثْلُ إِبْطَالِهِ التَّحْجِيرَ، يَعْنِي مَا يَعْمُرُ بِهِ مِثْلَ مَا يُحَجِّرُ. أَخْرَجَ الْحَدِيثَيْنِ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَإِلَى آخِرِ الْخَامِسِ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ يَحْيَى بْنِ جَعْدَةَ، قَالَ: لَمَّا قَدِمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَدِينَةَ أَقْطَعَ النَّاسَ الدُّورَ، فَقَالَ حَيٌّ مِنْ بَنِي زُهْرَةَ، يُقَالُ لَهُمْ: بَنُو عَبْدِ بْنِ زُهْرَةَ: نَكِّبْ عَنَّا ابْنَ أُمِّ عَبْدٍ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فَلِمَ ابْتَعَثَنِي اللَّهُ إِذَنْ؟ إِنَّ اللَّهَ لا يُقَدِّسُ أُمَّةً لا يُؤْخَذُ لِلضَّعِيفِ فِيهِمْ حَقُّهُ» .
