وَبِهِ عَنِ ابْنِ عُمَرَ: أَنَّهُ اشْتَرَى رَاحِلَةً بِأَرْبَعِ أَبْعِرَةٍ مَضْمُونَةٍ عَلَيْهِ بِالرَّبَذَةِ. أَخْرَجَ الْخَمْسَةَ الأَحَادِيثَ مِنْ كِتَابِ الْبُيُوعِ، وَالسَّادِسَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ شَبِيبِ بْنِ غَرْقَدَةَ، أَنَّهُ سَمِعَ الْحَيَّ يُحَدِّثُونَ، عَنْ عُرْوَةَ بْنِ الْجَعْدِ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَعْطَاهُ دِينَارًا لِيَشْتَرِيَ لَهُ بِهِ شَاةً أَوْ أُضْحِيَةً، فَاشْتَرَى لَهُ شَاتَيْنِ، فَبَاعَ إِحْدَاهُمَا بِدِينَارٍ وَأَتَاهُ بِشَاةٍ وَدِينَارٍ، فَدَعَا لَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي بَيْعِهِ بِالْبَرَكَةِ، فَكَانَ لَوِ اشْتَرَى تُرَابًا لَرَبِحَ فِيهِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنِ ابْنِ وَعْلَةَ الْمِصْرِيِّ: أَنَّهُ سَأَلَ ابْنَ عَبَّاسٍ عَمَّا يُعْصَرُ مِنَ الْعِنَبِ، فَقَالَ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ: أَهْدَى رَجُلٌ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَاوِيَةَ خَمْرٍ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَمَا عَلِمْتَ أَنَّ اللَّهَ حَرَّمَهَا؟» . فَقَالَ: لا، فَسَارَّ إِنْسَانًا إِلَى جَنْبِهِ. فَقَالَ: «بِمَ سَارَرْتَهُ» ؟ فَقَالَ: أَمَرْتُهُ بِبَيْعِهَا، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِنَّ الَّذِي حَرَّمَ شُرْبَهَا حَرَّمَ بَيْعَهَا» . فَفَتَحَ الْمَزَادَتَيْنِ حَتَّى ذَهَبَ مَا فِيهِمَا.

أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ قَالَ: بَلَغَ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَجُلا بَاعَ خَمْرًا. فَقَالَ: قَاتَلَ اللَّهُ فُلانًا بَاعَ الْخَمْرَ، أَمَا عَلِمَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «قَاتَلَ اللَّهُ يَهُودَ حُرِّمَتْ عَلَيْهِمُ الشُّحُومُ فَجَمَلُوهَا فَبَاعُوهَا» .

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّ رِجَالا مِنْ أَهْلِ الْعِرَاقِ، قَالُوا: إِنَّا نَبْتَاعُ مِنْ تَمْرِ النَّخْلِ وَالْعِنَبِ، فَنَعْصِرُهُ خَمْرًا فَنَبِيعُهَا. فَقَالَ عَبْدُ اللَّهِ: إِنِّي أُشْهِدُ اللَّهَ عَلَيْكُمْ وَمَلائِكَتَهُ وَمَنْ يَسْمَعُ مِنَ الْجِنِّ وَالإِنْسِ أَنِّي لا آمُرُكُمْ بِبَيْعِهَا وَلا تَبْتَاعُوهَا وَلا تَعْصِرُوهَا وَلا تَسْقُوهَا؛ فَإِنَّهُ رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ. أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ مِنْ كِتَابِ الأَشْرِبَةِ.

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ، عَنْ أَبِي مَسْعُودٍ الأَنْصَارِيِّ رَضِيَ اللَّهُ عَنْهُ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ ثَمَنِ الْكَلْبِ، وَمَهْرِ الْبَغِيِّ وَحُلْوَانِ الْكَاهِنِ. قَالَ مَالِكٌ: وَإِنَّمَا كُرِهَ بَيْعُ الْكِلابِ الضَّوَارِي وَغَيْرِ الضَّوَارِي لِنَهْيِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ثَمَنِ الْكَلْبِ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الْبُيُوعِ، وَالثَّانِيَ وَقَوْلَ مَالِكٍ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.

Tell us Malik from Ibn Shihab from Abu Bakr bin Abdul Rahman bin Harith bin Hisham, from Abu Masood Ansari may Allah be pleased with him: that the Prophet, peace be upon him forbade the price of a dog, and the wages of a prostitute and the priest Helwan. أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ حَنْظَلَةَ بْنِ قَيْسٍ: أَنَّهُ سَأَلَ رَافِعَ بْنَ خَدِيجٍ عَنْ كِرَى الأَرْضِ، فَقَالَ: نَهَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ كِرَاءِ الأَرْضِ فَقَالَ: أَبِالذَّهَبِ وَالْوَرِقِ؟ فَقَالَ: أَمَّا بِالذَّهَبِ وَالْوَرِقِ فَلا بَأْسَ بِهِ.
