Musnad Imam Shafi

أَخْبَرَنَا سُفْيَانُ، عَنْ سَلَمَةَ بْنِ مُوسَى، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ قَالَ: ذَلِكَ الْمَعْرُوفُ أَنْ يَأْخُذَ بَعْضَهُ طَعَامًا وَبَعْضَهُ دَنَانِيرَ. أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ مِنْ كِتَابِ الْبُيُوعِ.

Sufyan told us, on the authority of Salamah Ibn Musa, on the authority of Saeed bin Jabir, on the authority of Ibn Abbas, may God be pleased with him, who said: Take the three hadiths out of the book of sale.

ابْنِ عَبَّاسٍ، ← سَعِيدِ بْنِ جُبَيْرٍ ← سَلَمَةَ بْنِ مُوسَى، ← سُفْيَانَ،

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنِ الْقَاسِمِ، قَالَ: سَمِعْتُ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ وَرَجُلٌ يَسْأَلُهُ عَنْ رَجُلٍ سَلَّفَ فِي سَبَائِكَ، قَالَ الرَّبِيعُ: سَبَائِكَ، فَأَرَادَ أَنْ يَبِيعَهَا قَبْلَ أَنْ يَقْبِضَهَا. قَالَ ابْنُ عَبَّاسٍ: تِلْكَ الْوَرِقُ بِالْوَرِقِ، وَكَرِهَ ذَلِكَ. وَقَالَ مَالِكٌ: وَذَلِكَ فِيمَا نَرَى لأَنَّهُ أَرَادَ أَنْ يَبِيعَهَا مِنْ صَاحِبِهِ الَّذِي اشْتَرَاهُ بِأَكْثَرَ مِنَ الثَّمَنِ الَّذِي ابْتَاعَهَا مِنْهُ، وَلَوْ بَاعَهَا مِنْ غَيْرِ الَّذِي اشْتَرَاهَا مِنْهُ لَمْ يَكُنْ بِبَيْعِهِ بَأْسٌ.

ابْنُ عَبَّاسٍ: تِلْكَ الْوَرِقُ بِالْوَرِقِ، وَكَرِهَ ذَلِكَ. ← الرَّبِيعُ: سَبَائِكَ، فَأَرَادَ أَنْ يَبِيعَهَا قَبْلَ أَنْ يَقْبِضَهَا. ← رَجُلٍ سَلَّفَ فِي سَبَائِكَ، ← عَبْدَ اللَّهِ بْنَ عَبَّاسٍ وَرَجُلٌ يَسْأَلُهُ ← الْقَاسِمِ، ← يَحْيَی بْنُ سَعِيدٍ ← مَالِكٍ، ← الشَّافِعِیُّ

أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ: أَنَّهُ سَمِعَ ابْنَ عَبَّاسٍ يَقُولُ: لا نَرَى فِي السَّلَفِ بَأْسًا لِلْوَرِقِ فِي شَيْءٍ مِنَ الْوَرِقِ نَقْدًا.

Saeed bin Salim told us from Ibn Jarij, on the authority of Ata ', that he heard Ibn Abbas saying: We do not see anything in this matter.

لا نَرَى فِي السَّلَفِ بَأْسًا لِلْوَرِقِ فِي شَيْءٍ مِنَ الْوَرِقِ نَقْدًا. ← ابْنِ عَبَّاسٍ، ← عَطَاءٌ، اَنَّہٗ ← ابْنُ جُرَيْجٍ، ← سَعِيدُ بْنُ سَالِمٍ،

أَخْبَرَنَا سَعِيدٌ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ دِينَارٍ: أَنَّ ابْنَ عُمَرَ كَانَ يُجِيزُهُ. أَخْرَجَ الأَوَّلَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَالثَّانِيَ وَالثَّالِثَ مِنْ كِتَابِ الْبُيُوعِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي رَافِعٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اسْتَسْلَفَ مِنْ رَجُلٍ بَكْرًا فَجَاءَتْهُ إِبِلٌ مِنْ إِبِلِ الصَّدَقَةِ، وَأَمَرَنِي أَنْ أُقْضِيَهُ إِيَّاهُ.

أَبِي رَافِعٍ ← عَطَاءِ بْنِ يَسَارٍ ← زَيْدِ بْنِ أَسْلَمَ، ← مالک بن أنس ← الشَّافِعِیُّ

أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي رَافِعٍ مَوْلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالَ: اسْتَسْلَفَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَكْرًا فَجَاءَتْهُ إِبِلُ الصَّدَقَةِ، قَالَ أَبُو رَافِعٍ: فَأَمَرَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ أَقْضِيَ الرَّجُلَ بَكْرَهُ، فَقُلْتُ: يَا رَسُولَ اللَّهِ، إِنِّي لَمْ أَجِدْ فِي الإِبِلِ إِلا جَمَلا خِيَارًا رَبَاعِيًّا. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَعْطِهِ إِيَّاهُ، فَإِنَّ خِيَارَ النَّاسِ أَحْسَنُهُمْ قَضَاءً» .

أَبُو رَافِعٍ: فَأَمَرَنِي رَسُولُ اللَّهِ أَنْ أَقْضِيَ الرَّجُلَ بَكْرَهُ، فَقُلْتُ: ← اسْتَسْلَفَ رَسُولُ اللَّهِ بَكْرًا فَجَاءَتْهُ إِبِلُ الصَّدَقَةِ، ← أَبِي رَافِعٍ، مَوْلَى رَسُولِ اللَّهِ ← عَطَاءِ بْنِ يَسَارٍ ← زَيْدِ بْنِ أَسْلَمَ، ← مَالِكٍ،

أَخْبَرَنَا الثِّقَةُ، عَنْ سُفْيَانَ الثَّوْرِيِّ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمِثْلِ مَعْنَاهُ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الزَّكَاةِ، وَالثَّانِيَ وَالثَّالِثَ مِنْ كِتَابِ الْبُيُوعِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا الثِّقَةُ، عَنِ اللَّيْثِ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ: جَاءَ عَبْدٌ فَبَايَعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الْهِجْرَةِ، وَلَمْ يَسْمَعْ أَنَّهُ عَبْدٌ فَجَاءَ سَيِّدُهُ يُرِيدُهُ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «بِعْهُ» ، فَاشْتَرَاهُ بِعَبْدَيْنِ أَسْوَدَيْنِ، وَلَمْ يُبَايِعْ أَحَدًا بَعْدَهُ حَتَّى يَسْأَلَهُ: أَعَبْدٌ هُوَ أَوْ حُرٌّ.

جَابِرٍ ← أَبِي الزُّبَيْرِ ← اللَّيْثُ ← الثِّقَۃُ ← الشَّافِعِیُّ

أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَبْدِ الْكَرِيمِ الْجَزَرِيِّ أَخْبَرَهُ، أَنَّ زِيَادَ بْنَ أَبِي تَمِيمٍ مَوْلَى عُثْمَانَ بْنِ عَفَّانَ أَخْبَرَهُ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعَثَ مُصَدِّقًا لَهُ فَجَاءَ بِظَهْرٍ مُسِنَّاتٍ، فَلَمَّا رَآهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «هَلَكْتَ وَأَهْلَكْتَ» . فَقَالَ: يَا رَسُولَ اللَّهِ، إِنِّي قَدْ كُنْتُ أَبِيعُ الْبَكْرَيْنِ وَالثَّلاثَ بِالْبَعِيرِ الْمُسِنِّ يَدًا بِيَدٍ، وَعَلِمْتُ مِنْ حَاجَةِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى الظَّهْرِ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فَذَلِكَ إِذَنْ» .

أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ ابْنِ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ سُئِلَ عَن بَعِيرٍ بِبَعِيرَيْنِ، قَالَ: قَدْ يَكُونُ الْبَعِيرُ خَيْرًا مِنَ الْبَعِيرَيْنِ.

قَدْ يَكُونُ الْبَعِيرُ خَيْرًا مِنَ الْبَعِيرَيْنِ. ← بَعِيرٍ بِبَعِيرَيْنِ، ← ابْنِ عَبَّاسٍ أَنَّہُ سُئِلَ ← ابْنِ طَاوُسٍ، ← سُفْيَانُ بْنُ عُيَيْنَةَ،

أَخْبَرَنَا مَالِكٌ، عَنْ صَالِحِ بْنِ كَيْسَانَ، عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ عَلِيٍّ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ أَنَّهُ بَاعَ جَمَلا لَهُ يُدْعَى عُصَيْفِيرًا بِعِشْرِينَ بَعِيرًا إِلَى أَجَلٍ.

الحسن بن محمد بن علي ← صَالِحِ بْنِ كَيْسَانَ، ← مَالِكٍ،

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ أَنَّهُ اشْتَرَى رَاحِلَةً بِأَرْبَعِ أَبْعِرَةٍ مَضْمُونَةٍ عَلَيْهِ يُوَفِّيهَا صَاحِبُهَا بِالرَّبَذَةِ.
