أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا تُعْمِرُوا وَلا تُرْقِبُوا، فَمَنْ أَعْمَرَ شَيْئًا أَوْ أَرْقَبَهُ فَهُوَ سَبِيلُ الْمِيرَاثِ» .

أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ طَاوُسٍ، عَنْ حُجْرٍ الْمَدَرِيِّ، عَنْ زَيْدِ بْنِ ثَابِتٍ، عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: أَنَّهُ قَالَ: «الْعُمْرَى لِلْوَارِثِ» .أَخْرَجَ الأَرْبَعَةَ الأَحَادِيثَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَالْخَامِسَ وَالسَّادِسَ مِنْ كِتَابِ الصَّيْدِ وَالذَّبَائِحِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ أَعْتَقَ شِرْكًا لَهُ فِي عَبْدٍ، وَكَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَ الْعَبْدِ، قُوِّمَ عَلَيْهِ قِيمَةَ الْعَدْلِ، وَأُعْطِيَ شُرَكَاؤُهُ حِصَصَهُمْ وَعَتَقَ عَلَيْهِ الْعَبْدُ، وَإِلا فَقَدْ عَتَقَ مِنْهُ مَا عَتَقَ» .

أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ، عَنْ أَبِيهِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «أَيُّمَا عَبْدٍ كَانَ بَيْنَ اثْنَيْنِ فَأَعْتَقَ أَحَدُهُمَا نَصِيبَهُ، فَإِنْ كَانَ مُوسِرًا فَإِنَّهُ يَقُومُ عَلَيْهِ بِأَعْلَى الْقِيمَةِ أَوْ قِيمَةِ الْعَدْلِ لَيْسَتْ بِوَكْسٍ وَلا شَطَطٍ ثُمَّ يَغْرَمُ لِهَذَا حِصَّتَهُ» ۔أَخْرَجَ الْحَدِيثَيْنِ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا عَبْدُ الْمَجِيدِ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: أَخْبَرَنِي قَيْسُ بْنُ سَعْدٍ: أَنَّهُ سَمِعَ مَكْحُولا، يَقُولُ: سَمِعْتُ ابْنَ الْمُسَيِّبِ، يَقُولُ: أَعْتَقَتِ امْرَأَةٌ أَوْ رَجُلٌ سِتَّةَ أَعْبُدٍ لَهَا، وَلَمْ يَكُنْ لَهَا مَالٌ غَيْرُهُ فَأُتِيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ، فَأَقْرَعَ بَيْنَهُمْ فَأَعْتَقَ ثُلُثَهُمْ.قَالَ الشَّافِعِيُّ: كَانَ ذَلِكَ فِي مَرَضِ الْمُعْتِقِ الَّذِي مَاتَ فِيهِ.

أَخْبَرَنَا عَبْدُ الْوَهَّابِ، عَنْ أَيُّوبَ، عَنْ أَبِي قِلابَةَ، عَنْ أَبِي الْمُهَلَّبِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ: أَنَّ رَجُلا مِنَ الأَنْصَارِ أَوْصَى عِنْدَ مَوْتِهِ فَأَعْتَقَ سِتَّةَ مَمَالِيكَ، وَلَيْسَ لَهُ مَالٌ غَيْرَهُمْ، أَوْ قَالَ: أَعْتَقَ عِنْدَ مَوْتِهِ سِتَّةَ مَمَالِيكَ وَلَيْسَ لَهُ شَيْءٌ غَيْرَهُمْ، فَبَلَغَ ذَلِكَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ فِيهِ قَوْلا شَدِيدًا ثُمَّ دَعَاهُمْ فَجَزَّأَهُمْ ثَلاثَةَ أَجْزَاءٍ، فَأَقْرَعَ بَيْنَهُمْ فَأَعَتْقَ اثْنَيْنِ وَأَرَقَّ أَرْبَعَةً.أَخْرَجَ الْحَدِيثَيْنِ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا: أَنَّهَا قَالَتْ: جَاءَتْنِي بَرِيرَةُ، فَقَالَتْ: إِنِّي كَاتَبْتُ أَهْلِي عَلَى تِسْعِ أَوَاقٍ فِي كُلِّ عَامٍ أُوقِيَّةٌ فَأَعِينِينِي، فَقَالَتْ لَهَا عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا: إِنْ أَحَبَّ أَهْلُكِ أَنْ أَعُدَّهَا لَهُمْ عَدَدْتُهَا، وَيَكُونَ وَلاؤُكِ لِي فَعَلْتُ، فَذَهَبَتْ بَرِيرَةُ إِلَى أَهْلِهَا، فَقَالَتْ لَهُمْ ذَلِكَ فَأَبَوْا عَلَيْهَا فَجَاءَتْ مِنْ عِنْدِ أَهْلِهَا وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ جَالِسٌ، فَقَالَتْ: إِنِّي عَرَضْتُ عَلَيْهِمْ فَأَبَوْا إِلا أَنْ يَكُونَ لَهُمُ الْوَلاءُ، فَسَمِعَ ذَلِكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَخْبَرَتْهُ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا، فَقَالَ لَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «خُذِيهَا وَاشْتَرِطِي لَهُمُ الْوَلاءَ، فَإِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ» .فَفَعَلَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا، ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي النَّاسِ فَحَمِدَ اللَّهَ تَعَالَى وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ: «أَمَّا بَعْدُ، فَمَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ تَعَالَى، مَا كَانَ مِنْ شَرْطٍ لَيْسَ فِي كِتَابِ اللَّهِ فَهُوَ بَاطِلٌ، وَإِنْ كَانَ مِائَةَ شَرْطٍ، قَضَاءُ اللَّهِ أَحَقُّ، وَشَرْطُهُ أَوْثَقُ، وَإِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ» .

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ جَارِيَةً تُعْتِقُهَا.فَقَالَ أَهْلُهَا: نَبِيعُكِهَا عَلَى أَنَّ وَلاءَهَا لَنَا، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «لا يَمْنَعُكِ ذَلِكَ فَإِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ» .

أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَمْرَةَ لَمْ يَقُلْ: عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، وَذَلِكَ مُرْسَلٌ.
