أَخْبَرَنَا مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّهَا قَالَتْ: جَاءَتْنِي بَرِيرَةُ، فَقَالَتْ: إِنِّي كَاتَبْتُ أَهْلِي عَلَى تِسْعِ أَوَاقٍ فِي كُلِّ عَامٍ أُوقِيَّةٌ فَأَعِينِينِي، فَقَالَتْ لَهَا عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا: إِنْ أَحَبَّ أَهْلُكَ أَنْ أَعُدَّهَا لَهُمْ وَيَكُونُ وَلاؤُكِ لِي فَعَلْتُ، فَذَهَبَتْ بَرِيرَةُ إِلَى أَهْلِهَا وَرَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ جَالِسٌ فَقَالَتْ: إِنِّي عَرَضْتُ عَلَيْهِمْ فَأَبَوْا إِلا أَنْ يَكُونَ الْوَلاءُ لَهُمْ فَسَمِعَ ذَلِكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَهَا فَأَخْبَرَتْهُ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «خُذِيهَا وَاشْتَرِطِي لَهُمُ الْوَلاءَ، فَإِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ» .فَفَعَلَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا، ثُمَّ قَامَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي النَّاسِ فَحَمِدَ اللَّهَ تَعَالَى ثُمَّ قَالَ: «أَمَّا بَعْدُ، فَمَا بَالُ رِجَالٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللَّهِ تَعَالَى، فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ، قَضَاءُ اللَّهِ أَحَقُّ وَشَرْطُهُ أَوْثَقُ، وَإِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ» .

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا: أَنَّهَا أَرَادَتْ أَنْ تَشْتَرِيَ جَارِيَةً تُعْتِقُهَا فَقَالَ أَهْلُهَا: نَبِيعُكِهَا عَلَى أَنَّ وَلاءَهَا لَنَا، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «لا يَمْنَعُكِ ذَلِكَ إِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ» .

أَخْبَرَنَا مَالِكٌ، قَالَ: حَدَّثَنِي يَحْيَى بْنُ سَعِيدٍ، عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ: أَنَّ بَرِيرَةَ جَاءَتْ تَسْتَعِينُ.فَقَالَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا: إِنْ أَحَبَّ أَهْلُكِ أَنْ أَصُبَّ لَهُمْ ثَمَنَكِ صَبَّةً وَاحِدَةً وَأُعْتِقَكِ فَعَلْتُ، فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لأَهْلِهَا، فَقَالُوا: لا، إِلا أَنْ يَكُونَ وَلاؤُكِ لَنَا. قَالَ مَالِكٌ: قَالَ يَحْيَى: فَزَعَمَتْ عَمْرَةُ أَنَّ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «لا يَمْنَعُكِ ذَلِكَ اشْتَرِيهَا وَأَعْتِقِيهَا، إِنَّمَا الْوَلاءُ لِمَنْ أَعْتَقَ» .أَخْرَجَ الْحَدِيثَيْنِ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ، وَالثَّالِثَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَإِلَى آخِرِ السَّادِسِ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ، وَالسَّابِعَ وَالثَّامِنَ مِنْ كِتَابِ الْبَحِيرَةِ وَالسَّائِبَةِ وَهُمَا أَوَّلُ مَا فِيهِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سُنَيْنِ بْنِ أَبِي جَمِيلَةَ رَجُلٍ مِنْ بَنِي سُلَيْمٍ: أَنَّهُ وَجَدَ مَنْبُوذًا فِي زَمَانِ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَجَاءَ بِهِ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: مَا حَمَلَكَ عَلَى أَخْذِ هَذِهِ النَّسَمَةِ؟ قَالَ: وَجَدْتُهَا ضَائِعَةً فَأَخَذْتُهَا، فَقَالَ لَهُ عَرِيفِي: يَا أَمِيرَ الْمُؤْمِنِينَ، إِنَّهُ رَجُلٌ صَالِحٌ، قَالَ: أَكَذَلِكَ؟ قَالَ: نَعَمْ، قَالَ عُمَرُ: اذْهَبْ فَهُوَ حُرٌّ وَلَكَ وَلاؤُهُ وَعَلَيْنَا نَفَقَتُهُ.أَخْرَجَهُ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، عَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ، عَنْ أَبِيهِ: أَنَّهُ أَخْبَرَهُ أَنَّ الْعَاصَ بْنَ هِشَامٍ هَلَكَ وَتَرَكَ بَنِينَ لَهُ ثَلاثَةً: ابْنَيْنِ لأُمٍّ، وَرَجُلا لِعِلَّةٍ فَهَلَكَ أَحَدُ اللَّذَيْنِ لأُمٍّ، وَتَرَكَ مَالا وَمَوَالِيَ، فَوَرِثَهُ أَخُوهُ الَّذِي لأُمِّهِ وَلأَبِيهِ مَالَهُ وَوَلاءَ مَوَالِيهِ ثُمَّ هَلَكَ الَّذِي وَرِثَ الْمَالَ وَوَلاءَ الْمَوَالِي وَتَرَكَ ابْنَهُ وَأَخَاهُ لأَبِيهِ، فَقَالَ ابْنُهُ: قَدْ أَحْرَزْتُ مَا كَانَ أَبِي أَحْرَزَ مِنَ الْمَالِ وَوَلاءَ الْمَوَالِي، وَقَالَ أَخُوهُ: لَيْسَ كَذَلِكَ إِنَّمَا أَحْرَزْتُ الْمَالَ فَأَمَّا وَلاءُ الْمَوَالِي فَلا، أَرَأَيْتَ لَوْ هَلَكَ أَخِي الْيَوْمَ أَلَسْتُ أَرِثُهُ أَنَا؟ فَاخْتَصَمَا إِلَى عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ فَقَضَى لأَخِيهِ بِوَلاءِ الْمَوَالِي.أَخْرَجَهُ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ: أَنَّ طَارِقَ بْنَ الْمُرَقَّعِ أَعْتَقَ أَهْلَ بَيْتٍ سَوَائِبَ وَأَتَى بِمِيرَاثِهِمْ، فَقَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: أَعْطُوهُ وَرَثَةَ طَارِقٍ فَأَبَوْا أَنْ يَأْخُذُوهُ، فَقَالَ عُمَرُ: فَاجْعَلُوهُ فِي مِثْلِهِمْ مِنَ النَّاسِ.

أَخْبَرَنَا مُسْلِمٌ وَسَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ: أَنَّ طَارِقَ بْنَ الْمُرَقَّعِ أَعْتَقَ أَهْلَ أَبْيَاتٍ مِنْ أَهْلِ الْيَمَنِ سَوَائِبَ، فَانْقَلَعُوا عَنْ بِضْعَةَ عَشَرَ أَلْفًا، فَذَكَرَ ذَلِكَ لِعُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ فَأَمَرَنِي أَنْ أَدْفَعَ إِلَى طَارِقٍ، أَوْ وَرَثَةِ طَارِقٍ أَنَا شَكَكْتُ فِي الْحَدِيثِ هَكَذَا.أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ، وَهُوَ آخِرُ حَدِيثٍ فِيهِ، وَالثَّانِيَ مِنْ كِتَابِ صِفَةِ أَمْرِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَهُوَ آخِرُ حَدِيثٍ فِيهِ.

أَخْبَرَنَا سُفْيَانُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ مُجَاهِدٍ: أَنَّ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ قَالَ: الْوَلاءُ بِمَنْزِلَةِ الْحِلْفِ، أُقِرُّهُ حَيْثُ جَعَلَهُ اللَّهُ تَعَالَى.

أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ الْوَلاءِ وَعَنْ هِبَتِهِ.

أَخْبَرَنَا مَالِكٌ، وَابْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنِ ابْنِ عُمَرَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ بَيْعِ الْوَلاءِ وَعَنْ هِبَتِهِ.

أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ، عَنْ يَعْقُوبَ بْنِ إِبْرَاهِيمَ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنِ ابْنِ عُمَرَ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «الْوَلاءُ لُحْمَةٌ كَلُحْمَةِ النَّسَبِ لا تُبَاعُ وَلا تُوهَبُ» .أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ، وَالثَّالِثَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَالرَّابِعَ وَالْخَامِسَ مِنْ كِتَابِ الْبَحِيرَةِ وَالسَّائِبَةِ.
