أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا يَرِثُ الْمُسْلِمُ الْكَافِرَ، وَلا الْكَافِرُ الْمُسْلِمَ» .

Tell us Shafei may Allah be pleased with him, he said: Tell us the son Uyaynah, syphilis, Ali bin Hussein, Amr bin Othman, Osama bin Zaid: that the Messenger of Allah peace be upon him, said: «do not inherit from a Muslim infidel, and the infidel Muslim».

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، قَالَ: إِنَّمَا وَرِثَ أَبَا طَالِبٍ عَقِيلٌ وَطَالِبٌ. وَلَمْ يَرِثْهُ عَلِيٌّ وَلا جَعْفَرٌ، قَالَ: فَلِذَلِكَ تَرَكْنَا نَصِيبَنَا مِنَ الشِّعْبِ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الرِّسَالَةِ، وَالثَّانِيَ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.

Al-Shafi’i said in his book: Malik, on the authority of Ibn Shihab, told us about Ali bin Hussein, he said: He inherited only Abel Tal. He did not inherit from Ali or Jaafar, he said: Therefore, our share of the people has left us. He brought the first out of the letter of the letter, and the second from the book of food, drink, and the architecture of the two lands, which the Spring did not hear from the Rabbi.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ: أَنَّ رَجُلا مِنْ بَنِي مُدْلِجٍ، يُقَالُ لَهُ: قَتَادَةُ، حَذَفَ ابْنَهُ أَوْ حَذَفَ بِسَيْفٍ، فَأَصَابَ سَاقَهُ فَنُزِيَ فِي جُرْحِهِ فَمَاتَ. فَقَدِمَ سُرَاقَةُ بْنُ جَعْشَمٍ عَلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَذَكَرَ ذَلِكَ لَهُ. فَقَالَ عُمَرُ: اعْدُدْ لِي عَلَى قُدَيْدٍ عِشْرِينَ وَمِائَةِ بَعِيرٍ حِينَ أَقْدَمُ عَلَيْكَ. فَلَمَّا قَدِمَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ أَخَذَ مِنْ تِلْكَ الإِبِلِ ثَلاثِينَ حِقَّةً وَثَلاثِينَ جَذَعَةً وَأَرْبَعِينَ خَلِفَةً، ثُمَّ قَالَ: أَيْنَ أَخُو الْمَقْتُولِ؟ قَالَ: هَأَنَا ذا، قَالَ: خُذْهَا؛ فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَيْسَ لِقَاتِلٍ شَيْءٌ» . أَخْرَجَهُ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ.

Tell us Shafei may Allah be pleased with him, he said: Tell us the owner, Yahya ibn Said from Amr ibn Shoaib: that a man of the sons Mudlij, said to him: Qatada, delete or delete his son with a sword, injuring his leg Vensa in his wound, and he died. So the robbery of Bin Jaishm was made to Omar Bin Al-Khattab, may God be pleased with him, and he mentioned that to him. Umar said: Come back to me for twenty and a hundred hundred camels when I am older than you. When Omar, may God be pleased with him, came from that camel thirty thirty, thirty trunk and forty caliphs, then he said: Then say: He said: Here we are, he said: Take it, for the Messenger of God, may God bless him and grant him peace, said: “There is nothing for a murderer.” Take it out of the mayor's book.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنِ ابْنِ الْمُسَيِّبِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ كَانَ يَقُولُ: الدِّيَةُ لِلْعَاقِلَةِ، وَلا تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا شَيْئًا، حَتَّى أَخْبَرَهُ الضَّحَّاكُ بْنُ سُفْيَانَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَيْهِ أَنْ يُورِثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَتِهِ، فَرَجَعَ إِلَيْهِ عُمَرُ رَضِيَ اللَّهُ عَنْهُ.

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَتَبَ إِلَى الضَّحَّاكِ بْنِ سُفْيَانَ أَنْ يُورِثَ امْرَأَةَ أَشْيَمَ الضِّبَابِيِّ مِنْ دِيَتِهِ. قَالَ ابْنُ شِهَابٍ: وَكَانَ أَشْيَمُ قُتِلَ خَطَأً. قَالَ ابْنُ شِهَابٍ: وَكَانَ أَشْيَمُ قُتِلَ خَطَأً.

Malik, on the authority of Ibn Shihab, told us that the Prophet, may God bless him and grant him peace, wrote to Al-Dahhak bin Sufyan that he inherited from the mother of Dahr, from the mother of Dhi, to the inheritance of the mother of Dhi. Ibn Shihab said: It was Ashim who was killed by mistake. Ibn Shihab said: It was Ashim who was killed by mistake.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ أَبِي رَوَّادٍ وَمُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ قَالَ: أَخْبَرَنِي ابْنُ أَبِي مُلَيْكَةَ: أَنَّهُ سَأَلَ ابْنَ الزُّبَيْرِ، عَنِ الرَّجُلِ يُطَلِّقُ الْمَرْأَةَ فَيَبُتُّهَا ثُمَّ يَمُوتُ وَهِيَ فِي عِدَّتِهَا، فَقَالَ عَبْدُ اللَّهِ بْنُ الزُّبَيْرِ: طَلَّقَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ تُمَاضِرَ بِنْتَ الأَصْبَغِ الْكَلْبِيَّةَ فَبَتَّهَا، ثُمَّ مَاتَ وَهِيَ فِي عِدَّتِهَا، فَوَرَّثَهَا عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ. قَالَ ابْنُ الزُّبَيْرِ: وَأَمَّا أَنَا فَلا أَرَى أَنْ تُوَرَّثَ مَبْتُوتَةٌ.

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ طَلْحَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، قَالَ: وَكَانَ أَعْلَمَهُمْ بِذَلِكَ. وَعَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ: أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ طَلَّقَ امْرَأَتَهُ أَلْبَتَّةَ وَهُوَ مَرِيضٌ، فَوَرَّثَهَا عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ مِنْهُ بَعْدَ انْقِضَاءِ عِدَّتُهَا. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الرَّجْعَةِ.

Malik, on the authority of Ibn Shihab, told us about Talhah ibn Abd al-Rahman bin Auf, he said: And he informed them of that. And Abu Salamah bin Abdul Rahman bin Auf: Abdul Rahman bin Auf divorced his wife, a bit patient, Furtha Osman may Allah be pleased with him after it promised. Take the two hadiths out of the Book of Return.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ سُلَيْمَانَ الأَحْوَلِ، عَنْ مُجَاهِدٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا وَصِيَّةَ لِوَارِثٍ» .

Al-Shafi’i, may God be pleased with him, told us, he said: Ibn Aynah told us about Suleiman al-Ahwal, on the authority of Mujahid: that the Messenger of God:

أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَطَاءٍ وَطَاوُسٍ: أَنَّهُمَا قَالا: الْحَجَّةُ الْوَاجِبَةُ مِنْ رَأْسِ الْمَالِ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الرِّسَالَةِ وَالثَّانِيَ مِنْ كِتَابِ الْمَنَاسِكِ.

Muslim Bin Khalid, on the authority of Ibn Jarij, told us about a gift and a peafowl: they said: The obligatory argument from the head of Al. Take the first out of the letter of the letter and the second of the ritual book.
