أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ أَبِي رَوَّادٍ وَمُسْلِمُ بْنُ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ قَالَ: أَخْبَرَنِي ابْنُ أَبِي مُلَيْكَةَ: أَنَّهُ سَأَلَ ابْنَ الزُّبَيْرِ، عَنِ الرَّجُلِ يُطَلِّقُ الْمَرْأَةَ فَيَبُتُّهَا ثُمَّ يَمُوتُ وَهِيَ فِي عِدَّتِهَا، فَقَالَ عَبْدُ اللَّهِ بْنُ الزُّبَيْرِ: طَلَّقَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ تُمَاضِرَ بِنْتَ الأَصْبَغِ الْكَلْبِيَّةَ فَبَتَّهَا، ثُمَّ مَاتَ وَهِيَ فِي عِدَّتِهَا، فَوَرَّثَهَا عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ. قَالَ ابْنُ الزُّبَيْرِ: وَأَمَّا أَنَا فَلا أَرَى أَنْ تُوَرَّثَ مَبْتُوتَةٌ.

مسند امام شافی · Hadith 1351
