أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، قَالَ: حَدَّثَنِي ابْنُ شِهَابٍ: أَنَّ سَهْلَ بْنَ سَعْدٍ السّ َاعِدِيَّ أَخْبَرَهُ: أَنَّ عُوَيْمِرًا الْعَجْلانِيَّ جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ الأَنْصَارِيِّ، فَقَالَ لَهُ: أَرَأَيْتَ يَا عَاصِمُ لَوْ أَنَّ رَجُلا وَجَدَ مَعَ امْرَأَتِهِ رَجُلا يَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ سَلْ لِي يَا عَاصِمُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ. فَسَأَلَ عَاصِمٌ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ ذَلِكَ فَكَرِهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ، فَقَالَ: يَا عَاصِمُ، مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؟ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ: لَمْ تَأْتِنِي بِخَيْرٍ، قَدْ كَرِهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسْأَلَةَ الَّتِي سَأَلْتَنِي عَنْهَا. فَقَالَ عُوَيْمِرٌ: وَاللَّهِ لا أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا، فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَسْطَ النَّاسِ، فَقَالَ: يَا رَسُولَ اللَّهِ، أَرَأَيْتَ رَجُلا وَجَدَ مَعَ امْرَأَتِهِ رَجُلا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «قَدْ أَنْزَلَ اللَّهُ فِيكَ وَفِي صَاحِبَتِكَ، فَاذْهَبْ فَأْتِ بِهَا» . فَقَالَ سَهْلُ بْنُ سَعْدٍ: فَتَلاعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. فَلَمَّا فَرَغَا مِنْ تَلاعُنِهِمَا، قَالَ عُوَيْمِرٌ: كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهِ إِنْ أَمْسَكْتُهَا، فَطَلَّقَهَا ثَلاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. قَالَ ابْنُ شِهَابٍ: فَكَانَتْ تِلْكَ سُنَّةَ الْمُتَلاعِنَيْنِ.

أَخْبَرَنَا إِبْرَاهِيمُ بْنُ سَعْدٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَهْلِ بْنِ سَعْدٍ أَخْبَرَهُ، قَالَ: جَاءَ عُوَيْمِرٌ الْعَجْلانِيُّ إِلَى عَاصِمِ بْنِ عَدِيٍّ، فَقَالَ: يَا عَاصِمُ بْنَ عَدِيٍّ: سَلْ لِي رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ رَجُلٍ وَجَدَ مَعَ امْرَأَتِهِ رَجُلا فَيَقْتُلُهُ أَيُقْتَلُ بِهِ؟ أَمْ كَيْفَ يَصْنَعُ؟ فَسَأَلَ عَاصِمٌ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَعَابَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسَائِلَ، فَلَقِيَهُ عُوَيْمِرٌ فَقَالَ: مَا صَنَعْتَ؟ قَالَ: صَنَعْتُ أَنَّكَ لَمْ تَأْتِنِي بِخَيْرٍ، سَأَلْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَعَابَ الْمَسَائِلَ. فَقَالَ عُوَيْمِرٌ: وَاللَّهِ لآتِيَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَلأَسْأَلَنَّهُ فَأَتَاهُ فَوَجَدَهُ قَدْ أُنْزِلَ عَلَيْهِ فِيهِمَا فَدَعَاهُمَا فَلاعَنَ بَيْنَهُمَا. فَقَالَ عُوَيْمِرٌ: إِنِ انْطَلَقْتُ بِهَا لَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. ثُمَّ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ عَظِيمَ الأَلْيَتَيْنِ، فَلا أَرَاهُ إِلا قَدْ صَدَقَ، وَإِنْ جَاءَتْ بِهِ أَحْمَرَ كَأَنَّهُ وَحَرَةٌ، فَلا أَرَاهُ إِلا كَاذِبًا» فَجَاءَتْ بِهِ عَلَى النَّعْتِ الْمَكْرُوهِ قَالَ ابْنُ شِهَابٍ: فَصَارَتْ سُنَّةَ الْمُتَلاعِنَيْنِ.

أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ نَافِعٍ، عَنِ ابْنِ أَبِي ذِئْبٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَهْلِ بْنِ سَعْدٍ: أَنَّ عُوَيْمِرًا جَاءَ إِلَى عَاصِمٍ، فَقَالَ: أَرَأَيْتَ لَوْ أَنَّ رَجُلا وَجَدَ مَعَ امْرَأَتِهِ رَجُلا فَيَقْتُلُهُ أَتَقْتُلُونَهُ بِهِ؟ سَلْ لِي يَا عَاصِمُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَسَأَلَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَكَرِهَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَسَائِلَ وَعَابَهَا فَرَجَعَ عَاصِمٌ إِلَى عُوَيْمِرٍ، فَأَخْبَرَهُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَرِهَ الْمَسَائِلَ وَعَابَهَا، فَقَالَ عُوَيْمِرٌ: وَاللَّهِ لآتِيَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَجَاءَ وَقَدْ نَزَلَ الْقُرْآنُ خِلافَ عَاصِمٍ، فَسَأَلَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: قَدْ نَزَلَ فِيكُمَا الْقُرْآنُ فَتَقَدَّمَا فَتَلاعَنَا، ثُمَّ قَالَ: كَذَبْتُ عَلَيْهَا إِنْ أَمْسَكْتُهَا فَفَارَقَهَا وَمَا أَمَرَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَمَضَتْ سُنَّةَ الْمُتَلاعِنَيْنِ، وَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ قَصِيرًا كَأَنَّهُ وَحَرَةٌ فَلا أَحْسَبُهُ إِلا قَدْ كَذَبَ عَلَيْهَا، وَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَعْيَنَ ذُو أَلْيَتَيْنِ فَلا أَحْسَبُهُ إِلا قَدْ صَدَقَ عَلَيْهَا فَجَاءَتْ بِهِ عَلَى النَّعْتِ الْمَكْرُوهِ.

أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَهْلِ بْنِ سَعْدٍ أَخِي بَنِي سَاعِدَةَ: أَنَّ رَجُلا مِنَ الأَنْصَارِ جَاءَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: يَا رَسُولَ اللَّهِ، أَرَأَيْتَ رَجُلا وَجَدَ مَعَ امْرَأَتِهِ رَجُلا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ فِي شَأْنِهِ مَا ذُكِرَ فِي الْقُرْآنِ مِنْ أَمْرِ الْمُتَلاعِنَيْنِ، قَالَ: فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: قَدْ قَضَى فِيكَ وَفِي امْرَأَتِكَ، قَالَ: فَتَلاعَنَا وَأَنَا شَاهِدٌ، ثُمَّ فَارَقَهَا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَكَانَتْ سُنَّةً بَعْدَهُمَا أَنْ يُفَرَّقَ بَيْنَ الْمُتَلاعِنَيْنِ. وَكَانَتْ حَامِلا فَأَنْكَرَهَا فَكَانَ ابْنُهَا يُدْعَى إِلَى أُمِّهِ.

أَخْبَرَنَا سُفْيَانُ، عَنْ أَبِي الزِّنَادِ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ قَالَ: شَهِدْتُ ابْنَ عَبَّاسٍ يُحَدِّثُ بِحَدِيثِ الْمُتَلاعِنَيْنِ، فَقَالَ لَهُ ابْنُ شَدَّادٍ: هِيَ الَّتِي قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَوْ كُنْتُ رَاجِمًا أَحَدًا بِغَيْرِ بَيِّنَةٍ رَجَمْتُهَا» . فَقَالَ ابْنُ عَبَّاسٍ: لا تِلْكَ امْرَأَةٌ كَانَتْ قَدْ أَعْلَنَتْ.

أَخْبَرَنَا إِبْرَاهِيمُ بْنُ سَعْدٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَهْلِ بْنِ سَعْدٍ وَذَكَرَ حَدِيثَ الْمُتَلاعِنَيْنِ، قَالَ: فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «ابْصُرُوهَا فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ الْعَيْنَيْنِ عَظِيمَ الأَلْيَتَيْنِ، فَلا أَرَاهُ إِلا قَدْ صَدَقَ، وَإِنْ جَاءَتْ بِهِ أَحْمَرَ كَأَنَّهُ وَحَرَةٌ، فَلا أَرَاهُ إِلا كَاذِبًا فَجَاءَتْ بِهِ عَلَى النَّعْتِ الْمَكْرُوهِ» .

أَخْبَرَنَا مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، وَجَاءَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْعَجْلانِيُّ وَهُوَ أُحَيْمِرُ سَبْطٌ نِضْوُ الْخَلْقِ، فَقَالَ: يَا رَسُولَ اللَّهِ، أَرَأَيْتَ شَرِيكَ بْنَ السَّحْمَاءِ، يَعْنِي: ابْنَ عَمِّهِ، وَهُوَ رَجُلٌ عَظِيمُ الأَلْيَتَيْنِ أَدْعَجُ الْعَيْنَيْنِ حَالُ الْخَلْقِ يُصِيبُ فُلانَةَ، يَعْنِي: امْرَأَتَهُ، وَهِيَ حُبْلَى، وَمَا قَرِبْتُهَا مُنْذُ كَذَا، فَدَعَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ شَرِيكًا فَجَحَدَهُ وَدَعَا الْمَرْأَةَ فَجَحَدَتْ، فَلاعَنَ بَيْنَهَا وَبَيْنَ زَوْجِهَا وَهِيَ حُبْلَى، ثُمَّ قَالَ: «تُبْصِرُوهَا فَإِنْ جَاءَتْ بِهِ أَدْعَجَ عَظِيمَ الأَلْيَتَيْنِ فَلا أَرَاهُ إِلا قَدْ صَدَقَ عَلَيْهَا، وَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ كَأَنَّهُ وَحَرَةٌ فَلا أَرَاهُ إِلا قَدْ كَذَبَ عَلَيْهَا» . فَجَاءَتْ بِهِ أَدْعَجَ عَظِيمَ الأَلْيَتَيْنِ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِيمَا بَلَغَنَا: «إِنَّ أَمْرَهُ لَبَيِّنٌ لَوْلا مَا قَضَى اللَّهُ» . يَعْنِي: أَنَّهُ لِمَنْ زَنَى لَوْلا مَا قَضَى اللَّهُ مِنْ أَنْ لا يُحْكَمَ عَلَى أَحَدٍ إِلا بِإِقْرَارٍ أَوِ اعْتِرَافٍ عَلَى نَفْسِهِ، لا يَحِلُّ بِدَلالَةِ غَيْرِ وَاحِدٍ مِنْهُمَا وَإِنْ كَانَتْ بَيِّنَةً، فَلَوْلا مَا قَضَى اللَّهُ لَكَانَ لِي فِيهَا قَضَاءٌ غَيْرُهُ وَلَمْ يَعْرِضْ لِشَرِيكٍ وَلا لِلْمَرْأَةِ. وَاللَّهُ أَعْلَمُ، وَأَنَفْذَ لِلْحُكْمِ وَهُوَ يَعْلَمُ أَنَّ أَحَدَهُمَا كَاذِبٌ. ثُمَّ عَلِمَ بَعْدُ أَنَّ الزَّوْجَ هُوَ الصَّادِقُ.

أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، أَنَّ يَحْيَى بْنَ سَعِيدٍ حَدَّثَهُ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَجُلا جَاءَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: يَا رَسُولِ اللَّهِ، وَاللَّهِ مَا لِي عَهْدٌ بِأَهْلِي مُنْذُ عِفَارِ النَّخْلِ، قَالَ: وَعِفَارُهَا أَنَّهَا إِذَا كَانَتْ تُؤَبَّرُ أَرْبَعِينَ يَوْمًا لا تُسْقَى بَعْدَ الإِبَارِ، قَالَ: وَقَدْ وَجَدْتُ مَعَ امْرَأَتِي رَجُلا، قَالَ: وَكَانَ زَوْجُهَا مُصَفَّرًا حَمْشَ السَّاقَيْنِ سَبْطَ الشَّعَرِ، وَالَّذِي رُمِيَتْ بِهِ خَدْلا إِلَى السَّوَادِ جَعْدًا قَطَطًا مُسْتَهًا، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «اللَّهُمَّ بَيِّنْ» . ثُمَّ لاعَنَ بَيْنَهُمَا، فَجَاءَتْ بِرَجُلٍ يُشْبِهُ الَّذِي رُمِيَتْ بِهِ.

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ عَاصِمِ بْنِ كُلَيْبٍ، عَنْ أَبِيهِ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حِينَ لاعَنَ بَيْنَ الْمُتَلاعِنَيْنِ أَمَرَ رَجُلا أَنْ يَضَعَ يَدَهُ عَلَى فِيهِ عِنْدَ الْخَامِسَةِ، وَقَالَ: «إِنَّمَا هِيَ مُوجِبَةٌ» .

حَدَّثَنَاهُ سُفْيَانُ، عَنِ ابْنِ شِهَابٍ، عَنْ سَهْلِ بْنِ سَعْدٍ قَالَ: شَهِدْتُ الْمُتَلاعِنَيْنِ عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَنَا ابْنُ خَمْسَ عَشْرَةَ سَنَةً، ثُمَّ سَاقَ الْحَدِيثَ فَلَمْ يُتْقِنْهُ إِتْقَانَ هَؤُلاءِ. أَخْرَجَ السِّتَّةَ الأَحَادِيثَ مِنْ كِتَابِ الظِّهَارِ وَاللِّعَانِ، وَالسَّابِعَ وَالثَّامِنَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ، وَالتَّاسِعَ مِنْ كِتَابِ إِبْطَالِ الاسْتِحْسَانِ وَهُوَ أَوَّلُ حَدِيثٍ فِيهِ، وَإِلَى آخِرِ الثَّانِي عَشَرَ مِنْ كِتَابِ أَحْكَامِ الْقُرْآنِ.
