قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ حَسَنِ بْنِ الْقَاسِمِ الأَزْرَقِيُّ، عَنْ أَبِيهِ، عَنْ عَلْقَمَةَ بْنِ نَضْلَةَ: أَنَّ أَبَا سُفْيَانَ بْنَ حَرْبٍ قَامَ بِفِنَاءِ دَارِهِ ثُمَّ ضَرَبَ بِرِجْلِهِ، وَقَالَ: سَنَامُ الأَرْضِ إِنَّ لَهَا سَنَامًا، زَعَمَ ابْنُ فَرْقَدٍ الأَسْلَمِيُّ أَنِّي لا أَعْرِفُ حَقِّي مِنْ حَقِّهِ لِي بَيَاضُ الْمَرْوَةِ وَلَهُ سَوَادُهَا، وَلِي مَا بَيْنَ كَذَا إِلَى كَذَا، فَبَلَغَ ذَلِكَ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: لَيْسَ لأَحَدٍ إِلا مَا أَحَاطَتْ عَلَيْهِ جُدْرَانُهُ، إِنَّ إِحْيَاءَ الْمَوَاتِ مَا يَكُونُ زَرْعًا أَوْ حَفْرًا أَوْ يُحَاطُ بِالْجُدُرَاتِ وَهُوَ مِثْلُ إِبْطَالِهِ التَّحْجِيرَ، يَعْنِي مَا يَعْمُرُ بِهِ مِثْلَ مَا يُحَجِّرُ. أَخْرَجَ الْحَدِيثَيْنِ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَإِلَى آخِرِ الْخَامِسِ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ يَحْيَى بْنِ جَعْدَةَ، قَالَ: لَمَّا قَدِمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَدِينَةَ أَقْطَعَ النَّاسَ الدُّورَ، فَقَالَ حَيٌّ مِنْ بَنِي زُهْرَةَ، يُقَالُ لَهُمْ: بَنُو عَبْدِ بْنِ زُهْرَةَ: نَكِّبْ عَنَّا ابْنَ أُمِّ عَبْدٍ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فَلِمَ ابْتَعَثَنِي اللَّهُ إِذَنْ؟ إِنَّ اللَّهَ لا يُقَدِّسُ أُمَّةً لا يُؤْخَذُ لِلضَّعِيفِ فِيهِمْ حَقُّهُ» .

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ هِشَامٍ، عَنْ أَبِيهِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَقْطَعَ الزُّبَيْرَ أَرْضًا وَأَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ أَقْطَعَ الْعَقِيقَ أَجْمَعَ، وَقَالَ: أَيْنَ الْمُسْتَقْطِعُونَ؟ وَالْعَقِيقُ قَرِيبٌ مِنَ الْمَدِينَةِ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ، عَنِ ابْنِ عَبَّاسٍ، عَنِ الصَّعْبِ بْنِ جَثَّامَةَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا حِمَى إِلا للَّهِ وَرَسُولِهِ» .

قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ أَبِيهِ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، اسْتَعْمَلَ مَوْلًى لَهُ يُقَالُ لَهُ: هُنَيٌّ عَلَى الْحِمَى، فَقَالَ لَهُ: يَا هُنَيُّ، ضُمَّ جَنَاحَكَ، وَاتَّقِ دَعْوَةَ الْمَظْلُومِ، فَإِنَّ دَعْوَةَ الْمَظْلُومِ مُجَابَةٌ. وَأَدْخِلْ رَبَّ الصُّرَيْمَةِ وَالْغُنَيْمَةِ. وَإِيَّايَ وَنَعَمَ ابْنِ عَفَّانَ وَنَعَمَ ابْنِ عَوْفٍ، فَإِنَّهُمَا إِنْ تَهْلِكْ مَاشِيَتُهُمَا يَرْجِعَانِ إِلَى نَخْلٍ وَزَرْعٍ، وَإِنَّ رَبَّ الْغُنَيْمَةِ يَأْتِي بِعِيَالِهِ فَيَقُولُ: يَا أَمِيرَ الْمُؤْمِنِينَ، يَا أَمِيرَ الْمُؤْمِنِينَ، أَفَتَارِكُهُمْ أَنَا؟ لا أَبَا لَكَ، فَالْمَاءُ وَالْكَلأُ أَهْوَنُ مِنَ الدَّنَانِيرِ وَالدَّرَاهِمِ، وَايْمُ اللَّهِ لَعَلَّ ذَلِكَ أَنَّهُمْ لَيَرَوْنُ أَنِّي قَدْ ظَلَمْتُهُمْ إِنَّهَا لَبِلادُهَا قَاتَلُوا عَلَيْهَا فِي الْجَاهِلِيَّةِ، وَأَسْلَمُوا عَلَيْهَا فِي الإِسْلامِ. وَلَوْلا الْمَالُ الَّذِي أَحْمِلُ عَلَيْهِ فِي سَبِيلِ اللَّهِ تَعَالَى مَا حَمَيْتُ عَلَى الْمُسْلِمِينَ مِنْ بِلادِهِمْ شَيْئًا. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.
