قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا عَبْدُ الرَّحْمَنِ بْنُ حَسَنِ بْنِ الْقَاسِمِ الأَزْرَقِيُّ، عَنْ أَبِيهِ، عَنْ عَلْقَمَةَ بْنِ نَضْلَةَ: أَنَّ أَبَا سُفْيَانَ بْنَ حَرْبٍ قَامَ بِفِنَاءِ دَارِهِ ثُمَّ ضَرَبَ بِرِجْلِهِ، وَقَالَ: سَنَامُ الأَرْضِ إِنَّ لَهَا سَنَامًا، زَعَمَ ابْنُ فَرْقَدٍ الأَسْلَمِيُّ أَنِّي لا أَعْرِفُ حَقِّي مِنْ حَقِّهِ لِي بَيَاضُ الْمَرْوَةِ وَلَهُ سَوَادُهَا، وَلِي مَا بَيْنَ كَذَا إِلَى كَذَا، فَبَلَغَ ذَلِكَ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: لَيْسَ لأَحَدٍ إِلا مَا أَحَاطَتْ عَلَيْهِ جُدْرَانُهُ، إِنَّ إِحْيَاءَ الْمَوَاتِ مَا يَكُونُ زَرْعًا أَوْ حَفْرًا أَوْ يُحَاطُ بِالْجُدُرَاتِ وَهُوَ مِثْلُ إِبْطَالِهِ التَّحْجِيرَ، يَعْنِي مَا يَعْمُرُ بِهِ مِثْلَ مَا يُحَجِّرُ. أَخْرَجَ الْحَدِيثَيْنِ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَإِلَى آخِرِ الْخَامِسِ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.

The two hadiths were included in the Book of the Disposition of Malik and al-Shafi’i, and to the last fifth of the Book of Food, Drinkers, and the Architecture of the Emerit.
