قَالَ الشَّافِعِيُّ فِي كِتَابِهِ: أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ: أَنَّ عَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ اشْتَرَى مِنْ عَاصِمِ بْنِ عَدِيٍّ جَارِيَةً فَأُخْبِرَ أَنَّ لَهَا زَوْجًا فَرَدَّهَا. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الرِّسَالَةِ، وَالثَّانِيَ وَالثَّالِثَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ، وَالرَّابِعَ مِنْ كِتَابِ اخْتِلافِ عَلِيٍّ وَعَبْدِ اللَّهِ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ أَبِي الزِّنَادِ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا تُصَرُّوا الإِبِلَ وَالْغَنَمَ، وَإِنِ ابْتَاعَهَا بَعْدَ ذَلِكَ فَهُوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْلُبَهَا، إِنْ رَضِيَهَا أَمْسَكَهَا، وَإِنْ سَخِطَهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ» .

أَخْبَرَنَا سُفْيَانُ، عَنْ أَبِي الزِّنَادِ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لا تُصَرُّوا الإِبِلَ وَالْغَنَمَ، فَمَنِ ابْتَاعَهَا بَعْدَ ذَلِكَ فَهُوَ بِخَيْرِ النَّظَرَيْنِ بَعْدَ أَنْ يَحْلِبَهَا، إِنْ رَضِيَهَا أَمْسَكَهَا، وَإِنْ سَخِطَهَا رَدَّهَا وَصَاعًا مِنْ تَمْرٍ» .

أَخْبَرَنَا سُفْيَانُ، عَنْ أَيُّوبَ، عَنِ ابْنِ سِيرِينَ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَهُ إِلا أَنَّهُ قَالَ: «رَدَّهَا وَصَاعًا مِنْ تَمْرٍ لا سَمْرَاءَ» . أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ.

Tell us Sufian, Ayoub, Ibn Sirin, from Abu Hurayrah, may Allah be pleased with him, the Prophet peace be upon him like him, but he said: «refunded saa not pass from Brown». Take the three hadiths out from the second part of the hadeeth difference.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلا مِثْلا بِمِثْلٍ وَلا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ، لا تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلا مِثْلا بِمِثْلٍ يَدًا بِيَدٍ وَلا تُشِفُّوا بَعْضَهُ عَلَى بَعْضٍ، وَلا تَبِيعُوا مِنْهَا غَائِبًا بِنَاجِزٍ» .

Tell us Shafei may Allah be pleased with him, he said: Tell us Malik from Nafi, from Abu Sa'eed al-may Allah be pleased with him: that the Messenger of Allah, peace be upon him said: «then, do not gold with gold such only, for example, not healed each other, then, do not paper paper only For example, like a hand in hand, and do not heal one another, and do not sell from it, absent with a handler.

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلا مِثْلا بِمِثْلٍ، وَلا تَبِيعُوا غَائِبًا بِنَاجِزٍ» .

Tell us Malik from Nafi, from Abu Sa'eed al-may Allah be pleased with him: that the Messenger of Allah, peace be upon him said: «gold with gold then, do not only like for like, and Etbiawa absent Bnadz».

أَخْبَرَنَا مَالِكٌ: أَنَّهُ بَلَغَهُ عَنْ جَدِّهِ مَالِكِ بْنِ عَامِرٍ، عَنْ عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لا تَبِيعُوا الدِّينَارَ بِالدِّينَارَيْنِ، وَلا الدِّرْهَمَ بِالدِّرْهَمَيْنِ» .

Tell us the owner: that he heard from his grandfather, Malik bin Amer, Osman may Allah be pleased with him, he said: The Messenger of Allah peace be upon him: «then, do not dinar Baldanarin, nor the dirham Baldarhaman».

أَخْبَرَنَا مَالِكٌ، عَنْ مُوسَى بْنِ أَبِي تَمِيمٍ، عَنْ سَعِيدِ بْنِ يَسَارٍ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ لا فَضْلَ بَيْنَهُمَا»

Tell us the owner, Musa ibn Abi Tamim bin Said left, from Abu Hurayrah, may Allah be pleased with him, that the Messenger of Allah, peace be upon him said: «dinar dinar and dirham dirham is not preferred between them»

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ: لا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلا مِثْلا بِمِثْلٍ وَلا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ، وَلا تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلا مِثْلا بِمِثْلٍ وَلا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ.

أَخْبَرَنَا مَالِكٌ، عَنْ حُمَيْدِ بْنِ قَيْسٍ، عَنْ مُجَاهِدٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ قَالَ: الدِّينَارُ بِالدِّينَارِ، وَالدِّرْهَمُ بِالدِّرْهَمِ لا فَضْلَ بَيْنَهُمَا هَذَا عَهْدُ نَبِيِّنَا صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَيْنَا وَعَهْدُنَا إِلَيْكُمْ.

Tell us the owner, Hamid bin Qais, the Mujahid, the son of Omar, he said, the dinar dinar and dirham dirham is not preferred between them this era of our Prophet, peace be upon him to us and our pledge to you.

أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، أَنَّ مُعَاوِيَةَ بْنِ أَبِي سُفْيَانَ بَاعَ سِقَايَةً مِنْ ذَهَبٍ أَوْ وَرِقٍ بِأَكْثَرَ مِنْ وَزْنِهَا، فَقَالَ لَهُ أَبُو الدَّرْدَاءِ رَضِيَ اللَّهُ عَنْهُ: سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَنْهَى عَنْ مِثْلِ هَذَا. فَقَالَ مُعَاوِيَةُ: مَا أَرَى بِهَذَا بَأْسًا. فَقَالَ أَبُو الدَّرْدَاءِ: مَنْ يَعْذِرُنِي مِنْ مُعَاوِيَةَ، أُخْبِرُهُ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَيُخْبِرُنِي عَنْ رَأْيِهِ لا أُسَاكِنُكَ بِأَرْضٍ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الْبُيُوعِ، وَإِلَى آخِرِ الرَّابِعِ مِنَ الْجُزْءِ الثَّانِي مِنَ اخْتِلافِ الْحَدِيثِ، وَالْخَامِسَ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ، وَالسَّادِسَ وَالسَّابِعَ مِنْ كِتَابِ الرِّسَالَةِ.
