أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الشِّغَارِ. وَالشِّغَارُ: أَنْ يُزَوِّجَ الرَّجُلُ ابْنَتَهُ عَلَى أَنْ يُزَوِّجَهُ الآخَرُ ابْنَتَهُ، وَلَيْسَ بَيْنَهُمَا صَدَاقٌ.

Al-Shafi’i, may God be pleased with him, told us, he said: Malik told us, on the authority of Nafi`, on the authority of Ibn Omar: that the Messenger of God, may God’s prayers and peace be upon God. The ritual is for a man to marry his daughter, but for the other to marry his daughter to her, and there is no friendship between them.

أَخْبَرَنَا عَبْدُ الْمَجِيدِ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: أَخْبَرَنَا أَبُو الزُّبَيْرِ: أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ يَقُولُ: إِنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الشِّغَارِ.

Ibn Ayna, on the authority of Ibn Abi Najeh, told us about Mujahid: that the Prophet, may God bless him and grant him peace, said: “There is no vacancy in Islam.”

أَخْبَرَنَا الرَّبِيعُ، قَالَ: حَدَّثَنَا الشَّافِعِيُّ مُحَمَّدُ بْنُ إِدْرِيسَ بْنِ الْعَبَّاسِ بْنِ عُثْمَانَ بْنِ شَافِعِ بْنِ السَّائِبِ بْنِ عُبَيْدِ بْنِ عَبْدِ يَزِيدَ بْنِ هَاشِمِ بْنِ عَبْدِ الْمُطَّلِبِ بْنِ عَبْدِ مَنَافِ بْنِ قُصَيِّ بْنِ كِلابِ بْنِ مُرَّةَ بْنِ كَعْبِ بْنِ لُؤَيِّ بْنِ غَالِبِ بْنِ فِهْرِ بْنِ مَالِكِ بْنِ النَّضْرِ بْنِ كِنَانَةَ بْنِ خُزَيْمَةَ بْنِ مُدْرَكَةَ بْنِ إِلْيَاسَ بْنِ مُضَرَ بْنِ نِزَارِ بْنِ مَعْدِ بْنِ عَدْنَانَ، ابْنِ عَمِّ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، وَمُسْلِمِ بْنِ خَالِدٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ كِلاهُمَا، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ نَهَى عَنِ الشِّغَارِ وَزَادَ مَالِكٌ فِي حَدِيثِهِ: وَالشِّغَارُ: أَنْ يُزَوِّجَ الرَّجُلُ الرَّجُلَ ابْنَتَهُ عَلَى أَنْ يُزَوِّجَهُ ابْنَتَهُ. أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ مِنْ بَابِ الشِّغَارِ وَالرَّابِعَ مِنْ كِتَابِ النِّكَاحِ مِنَ الإِمْلاءِ وَهُوَ أَوَّلُ حَدِيثٍ فِيهِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ: أَنَّ رَجُلا سَأَلَ عُثْمَانَ بْنَ عَفَّانَ رَضِيَ اللَّهُ عَنْهُ عَنِ الأُخْتَيْنِ مِنْ مِلْكِ الْيَمِينِ: هَلْ يَجْمَعُ بَيْنَهُمَا؟ فَقَالَ عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ: أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا آيَةٌ، وَأَمَّا أَنَا فَلا أُحِبُّ أَنْ أَصْنَعَ هَذَا، قَالَ: قَالَ مَالِكٌ: وَبَلَغَنِي عَنِ الزُّبَيْرِ بْنِ الْعَوَّامِ مِثْلُ ذَلِكَ. فَخَرَجَ مِنْ عِنْدَهُ فَلَقِيَ رَجُلا مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: لَوْ كَانَ لِي مِنَ الأَمْرِ شَيْءٌ، ثُمَّ وَجَدْتُ أَحَدًا فَعَلَ ذَلِكَ لَجَعَلْتُهُ نَكَالا. قَالَ مَالِكٌ: قَالَ ابْنُ شِهَابٍ: أَرَاهُ عَلِيَّ بْنَ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ.

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ، عَنْ أَبِيهِ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ سُئِلَ عَنِ الْمَرْأَةِ وَابْنَتِهَا مِنْ مِلْكِ الْيَمِينِ: هَلْ تُوطَأُ إِحْدَاهُمَا بَعْدَ الأُخْرَى؟ فَقَالَ عُمَرُ: مَا أُحِبُّ أَنْ أُجِيزَهُمَا جَمِيعًا.

Tell us Malik from Ibn Shihab from Obaidullah bin Abdullah bin threshold, from his father: that Omar ibn al-Khattab may Allah be pleased with him asked about the woman and her daughter of the king of right: Is the consummation of one after the other? Omar said: I would not like to be allowed to all of them.

أَخْبَرَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ، عَنْ أَبِيهِ قَالَ: سُئِلَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ عَنِ الأُمِّ وَابْنَتِهَا مِنْ مِلْكِ الْيَمِينِ، فَقَالَ: مَا أُحِبُّ أَنْ نُجِيزَهُمَا جَمِيعًا. قَالَ عُبَيْدُ اللَّهِ: قَالَ أبي: فَوَدِدْتُ أَنَّ عُمَرَ كَانَ أَشَدَّ فِي ذَلِكَ مِمَّا هُوَ.

أَخْبَرَنَا مُسْلِمٌ وَعَبْدُ الْمَجِيدِ، عَنِ ابْنِ جُرَيْجٍ، قَالَ: سَمِعْتُ ابْنَ أَبِي مُلَيْكَةَ يُخْبِرُ: أَنَّ مُعَاذَ بْنَ عَبْدِ اللَّهِ بْنِ عُبَيْدِ اللَّهِ بْنِ مَعْمَرٍ جَاءَ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا، فَقَالَ لَهَا: إِنَّ لِي سُرِّيَّةً أَصَبْتُهَا، وَإِنَّهَا قَدْ بَلَغَتْ لَهَا ابْنَةٌ جَارِيَةٌ لِي فَأَسْتَسِرُّ ابْنَتَهَا؟ فَقَالَتْ: لا. قَالَ: فَإِنِّي لا أَدَعُهَا إِلا أَنْ تَقُولِي: حَرَّمَهَا اللَّهُ تَعَالَى، فَقَالَتْ: لا يَفْعَلُهُ أَحَدٌ مِنْ أَهْلِي، وَلا أَحَدٌ أَطَاعَنِي.

أَخْبَرَنَا مَالِكٌ، عَنْ أَبِي الزِّنَادِ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: لا يَجْمَعُ الرَّجُلُ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا وَلا بَيْنَ الْمَرْأَةِ وَخَالَتِهَا. أَخْرَجَ الأَرْبَعَةَ الأَحَادِيثَ مِنْ كِتَابِ عِشْرَةِ النِّسَاءِ، وَالْخَامِسَ مِنْ كِتَابِ أَحْكَامِ الْقُرْآنِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا أَنَسُ بْنُ عِيَاضٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ زَيْنَبَ بِنْتِ أَبِي سَلَمَةَ، عَنْ أُمِّ حَبِيبَةَ بِنْتِ أَبِي سُفْيَانَ، قَالَتْ: يَا رَسُولَ اللَّهِ، هَلْ لَكَ فِي أُخْتِي ابْنَةِ أَبِي سُفْيَانَ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فَاعِلٌ مَاذَا» ؟ قَالَتْ: تَنْكِحُهَا. قَالَ: «أُخْتَكِ» ! قَالَتْ: نَعَمْ. قَالَ: «أَتُحِبِّينَ ذَلِكَ» ؟ قَالَتْ: نَعَمْ، لَسْتُ لَكَ بِمُخْلِيَةٍ، وَأَحَبُّ مَنْ شَرِكَنِي فِي خَيْرٍ أُخْتِي، قَالَ: «فَإِنَّهَا لا تَحِلُّ لِي» . قَالَتْ: فَقُلْتُ: وَاللَّهِ لَقَدْ أُخْبِرْتُ بِأَنَّكَ تَخْطُبُ بِنْتَ أَبِي سَلَمَةَ. قَالَ: «بِنْتَ أَبِي سَلَمَةَ» ؟ قَالَتْ: نَعَمْ، قَالَ: «وَاللَّهِ لَوْ لَمْ تَكُنْ رَبِيبَتِي فِي حِجْرِي مَا حَلَّتْ لِي إِنَّهَا لابْنَةُ أَخِي مِنَ الرَّضَاعَةِ أَرْضَعَتْنِي وَأَبَاهَا ثُوَيْبَةُ، فَلا تَعْرِضْنَ عَلَيَّ بَنَاتِكُنَّ وَلا أَخَوَاتِكُنَّ» .

أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «تُحَرِّمُ الرَّضَاعَةُ مَا تُحَرِّمُ الْوِلادَةُ» .

Tell us Malik from Abdullah ibn Dinar, Suleiman bin left, Urwah ibn al-Zubayr, Aisha, may Allah be pleased that the Messenger of Allah, peace be upon him said: «deprive breastfeeding is deprived of birth».

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، قَالَ: سَمِعْتُ ابْنَ جُدْعَانَ، قَالَ: سَمِعْتُ ابْنَ الْمُسَيِّبِ يُحَدِّثُ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ، أَنَّهُ قَالَ: يَا رَسُولَ اللَّهِ، هَلْ لَكَ فِي بِنْتِ عَمِّكَ بِنْتِ حَمْزَةَ فَإِنَّهَا أَجْمَلُ فَتَاةٍ فِي قُرَيْشٍ، فَقَالَ: «أَمَا عَلِمْتَ أَنَّ حَمْزَةَ أَخِي مِنَ الرَّضَاعَةِ، وَأَنَّ اللَّهَ حَرَّمَ مِنَ الرَّضَاعَةِ مَا حَرَّمَ مِنَ النَّسَبِ» .
