مسند امام شافی #1537

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ إِسْحَاقَ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي طَلْحَةَ، عَنْ أَنَسِ بْنِ مَالِكٍ رَضِيَ اللَّهُ عَنْهُ، قَالَ: كُنْتُ أَسْقِي أَبَا عُبَيْدَةَ بْنَ الْجَرَّاحِ وَأَبَا طَلْحَةَ الأَنْصَارِيَّ وَأُبَيَّ بْنَ كَعْبٍ رَضِيَ اللَّهُ عَنْهُمْ شَرَابًا مِنْ فَضِيخٍ وَتَمْرٍ، فَجَاءَهُمْ آتٍ، فَقَالَ: إِنَّ الْخَمْرَ قَدْ حُرِّمَتْ. فَقَالَ أَبُو طَلْحَةَ: يَا أَنَسُ، قُمْ إِلَى هَذِهِ الْجِرَارِ فَاكْسِرْهَا، قَالَ أَنَسٌ: فَقُمْتُ إِلَى مِهْرَاسٍ لَنَا فَضَرَبْتُهَا بِأَسْفَلِهِ حَتَّى تَكَسَّرَتْ.

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ شَرِبَ الْخَمْرَ فِي الدُّنْيَا ثُمَّ لَمْ يَتُبْ مِنْهَا، حُرِمَهَا فِي الآخِرَةِ» . أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الأَشْرِبَةِ.

أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، قَالَتْ: سُئِلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْبِتْعِ فَقَالَ: «كُلُّ شَرَابٍ أَسْكَرَ فَهُوَ حَرَامٌ» .

أَخْبَرَنَا سُفْيَانُ، عَنِ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ: أَنَّ أَبَا وَهْبٍ الْجَيْشَانِيَّ سَأَلَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْبِتْعِ، فَقَالَ: «كُلُّ مُسْكِرٍ حَرَامٌ» .

أَخْبَرَنَا سُفْيَانُ، قَالَ: سَمِعْتُ أَبَا الْجُوَيْرِيَةِ الْجَرْمِيَّ، يَقُولُ: إِنِّي لأَوَّلُ الْعَرَبِ سَأَلَ ابْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ، وَهُوَ مُسْنَدٌ ظَهْرَهُ إِلَى الْكَعْبَةِ، فَسَأَلْتُهُ عَنِ الْبَاذِقِ. فَقَالَ: سَبَقَ مُحَمَّدٌ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْبَاذِقُ وَمَا أَسْكَرَ فَهُوَ حَرَامٌ.

سَمِعْتُ الرَّبِيعَ يَقُولُ: سَمِعْتُ الشَّافِعِيَّ يَقُولُ، وَهُوَ يَحْتَجُّ فِي ذِكْرِ الْمُسْكِرِ، وَكَانَ كَلامًا قَدْ تَقَدَّمَ لا أَحْفَظُهُ، فَقَالَ: أَرَأَيْتَ إِنْ شَرِبَ عَشَرَةً وَلَمْ يَسْكَرْ؟ فَإِنْ قَالَ: حَلالٌ. قِيلَ. أَفَرَأَيْتَ إِنْ خَرَجَ فَأَصَابَتْهُ الرِّيحُ فَسَكِرَ، فَإِنْ قَالَ: حَرَامٌ، فَقُلْ لَهُ: أَفَرَأَيْتَ شَيْئًا قَطُّ شَرِبَهُ فَصَارَ إِلَى جَوْفِهِ حَلالٌ ثُمَّ صَيَّرَتْهُ الرِّيحُ حَرَامًا. قَالَ الشَّافِعِيُّ: مَا أَسْكَرَ كَثِيرُهُ فَقَلِيلُهُ حَرَامٌ.

أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سُئِلَ عَنِ الْغُبَيْرَاءِ، فَقَالَ: لا خَيْرَ فِيهَا، وَنَهَى عَنْهَا. قَالَ مَالِكٌ: قَالَ زَيْدُ بْنُ أَسْلَمَ هِيَ السُّكُرْكَةُ. أَخْرَجَ السِّتَّةَ الأَحَادِيثَ وَقَوْلَ الشَّافِعِيِّ مِنْ كِتَابِ الأَشْرِبَةِ.

حَدَّثَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ، عَنْ وَاقِدِ بْنِ عَمْرِو بْنِ سَعِيدِ بْنِ مُعَاذٍ، وَعَنْ سَلَمَةَ بْنِ عَوْفِ بْنِ سَلامَةَ أَخْبَرَاهُ، عَنْ مَحْمُودِ بْنِ لَبِيدٍ الأَنْصَارِيِّ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ حِينَ قَدِمَ الشَّامَ، فَشَكَا إِلَيْهِ أَهْلُ الشَّامِ وَبَالَ الأَرْضِ وَثِقَلَهَا، وَقَالُوا: لا يُصْلِحُنَا إِلا هَذَا الشَّرَابُ. فَقَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: اشْرَبُوا الْعَسَلَ. فَقَالُوا: لا يُصْلِحُنَا الْعَسَلُ. فَقَالَ رَجُلٌ مِنْ أَهْلِ الأَرْضِ: هَلْ لَكَ أَنْ نَجْعَلَ مِنْ هَذَا الشَّرَابِ شَيْئًا لا يُسْكِرُ؟ فَقَالَ: نَعَمْ، فَطَبَخُوهُ حَتَّى ذَهَبَ مِنْهُ الثُّلُثَانِ، وَبَقِيَ الثُّلُثُ، فَأَتَوْا بِهِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ، فَأَدْخَلَ عُمَرُ فِيهِ إِصْبَعَهُ ثُمَّ رَفَعَ يَدَهُ، فَتَبِعَهَا يَتَمَطَّطُ فَقَالَ: هَذَا الطِّلاءُ هَذَا مِثْلُ طِلاءِ الإِبِلِ. فَأَمَرَهُمْ عُمَرُ رَضِيَ اللَّهُ عَنْهُ أَنْ يَشْرَبُوهُ. فَقَالَ لَهُ عُبَادَةُ بْنُ الصَّامِتِ: أَحْلَلْتَهَا وَاللَّهِ. فَقَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: كَلا وَاللَّهِ، اللَّهُمَّ إِنِّي لا أُحِلُّ لَهُمْ شَيْئًا حَرَّمْتَهُ عَلَيْهِمْ، وَلا أُحَرِّمُ عَلَيْهِمْ شَيْئًا أَحْلَلْتَهُ لَهُمْ. أَخْرَجَهُ مِنْ كِتَابِ الأَشْرِبَةِ.

حَدَّثَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، عَنْ مَعْبَدِ بْنِ كَعْبٍ، عَنْ أُمِّهِ وَكَانَتْ قَدْ صَلَّتِ الْقِبْلَتَيْنِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الْخَلِيطَيْنِ، وَقَالَ: انْتَبِذُوا كُلَّ وَاحِدٍ مِنْهُمَا عَلَى حِدَتِهِ.

أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى أَنْ يُنْبَذَ التَّمْرُ وَالْبُسْرُ جَمِيعًا وَالتَّمْرُ وَالزَّهْوُ جَمِيعًا. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الأَشْرِبَةِ.
