13090 - قَالَ: وَقَدْ يَحْتَمِلُ عَطِيَّةُ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الْأَقْرَعَ وَأَصْحَابَهُ، أَنْ تَكُونَ مِنْ خُمُسِ الْخُمُسِ.

وَقَدْ يَحْتَمِلُ عَطِيَّةُ النَّبِيِّ الْأَقْرَعَ وَأَصْحَابَهُ، أَنْ تَكُونَ مِنْ خُمُسِ الْخُمُسِ.

13091 - وَقَدْ قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي الْخُمُسِ: «هُوَ لِي، ثُمَّ هُوَ مَرْدُودٌ فِيكُمْ»، فَلَمَّا أَعْطَاهُ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الْأَبْعَدِينَ، أَنْكَرَتْ ذَلِكَ الْأَنْصَارُ الَّذِينَ هُمْ أَوْلِيَاؤُهُ، وَقَالُوا: يُعْطِي غَنَائِمَنَا قَوْمًا تَقْطُرُ دِمَاؤُهُمْ مِنْ سُيُوفِنَا.

الشَّافِعِيُّ: وَقَدْ يَجُوزُ أَنْ يَقُولُوا: أَيُعْطِيهِمْ خُمُسَ غَنَائِمِنَا، وَفِينَا مَنْ يَسْتَحِقُّهَا؟.

13094 - قَالَ الشَّافِعِيُّ: وَأَخْبَرَنَا بَعْضُ أَصْحَابِنَا، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ «أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَعْطَى الْأَقْرَعَ وَأَصْحَابَهُ مِنْ خُمُسِ الْخُمُسِ».

13095 - فَقَوْلُهُ بَعْدَ الْخُمُسِ، فَذَلِكَ لَهُمْ، عَلَى ذَلِكَ غَزَوْا، وَذَهَبُوا فِي هَذَا إِلَى أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ يَوْمَ بَدْرٍ: «مَنْ أَخَذَ شَيْئًا فَهُوَ لَهُ»، وَذَلِكَ قَبْلَ نُزُولِ الْخُمُسِ، وَاللَّهُ أَعْلَمُ.

13097 - قَالَ أَحْمَدُ: قَدْ رُوِيَ، عَنْ عُبَادَةَ بْنِ الصَّامِتِ، أَنَّهُ سُئِلَ عَنِ الْأَنْفَالِ، فَقَالَ: «فِينَا أَصْحَابَ بَدْرٍ قَدْ نَزَلَتْ، وَذَلِكَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حِينَ الْتَقَى النَّاسُ بِبَدْرٍ، نَفَّلَ كُلَّ امْرِئٍ مَا أَصَابَ»، ثُمَّ ذَكَرَ نُزُولَ الْآيَةِ وَالْقِسْمَةَ بَيْنَهُمْ

الْأَنْفَالِ، فَقَالَ: «فِينَا أَصْحَابَ بَدْرٍ قَدْ نَزَلَتْ، وَذَلِكَ ← عُبَادَةَ بْنِ الصَّامِتِ، أَنَّهُ سُئِلَ ← أَحْمَدُ: قَدْ رُوِيَ

13098 - وَرُوِيَ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ يَوْمَ بَدْرٍ: «مَنْ قَتَلَ قَتِيلًا فَلَهُ كَذَا وَكَذَا، وَمَنْ أَسَرَ أَسِيرًا فَلَهُ كَذَا وَكَذَا»، ثُمَّ ذَكَرَ تَنَازُعَهُمْ وَنُزُولَ الْآيَةِ فِي الْأَنْفَالِ، وَقِسْمَةَ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الْغَنِيمَةَ بَيْنَهُمْ.

13100 - قَالَ أَحْمَدُ: وَقَدْ كَانَ ذَلِكَ قَبْلَ وَقْعَةِ بَدْرٍ، وَقَدْ صَارَ الْأَمْرُ بَعْدَ نُزُولِ الْآيَةِ إِلَى مَا اخْتَارَهُ الشَّافِعِيُّ فِي قِسْمَةِ أَرْبَعَةِ أَخْمَاسٍ الْغَنِيمَةِ بَيْنَ وَقْعَةِ بَدْرٍ، وَقَدْ صَارَ الْأَمْرُ بَعْدَ نُزُولِ الْآيَةِ مِنْ حِصَّةِ الْقِتَالِ، وَأَرْبَعَةُ أَخْمَاسٍ عَلَى أَهْلِهِ، وَأَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ كَانَ يَضَعُ سَهْمَهُ حَيْثُ أَرَاهُ اللَّهُ وَهُوَ
