12904 - فَكَانَتْ سُنَّةُ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي قُرَى عُرَيْنَةَ، الَّتِي أَفَاءَ اللَّهُ تَعَالَى عَلَيْهِ أَنَّ أَرْبَعَةَ أَخْمَاسِهَا لِرَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ خَاصَّةً دُونَ الْمُسْلِمِينَ، يَضَعُهَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ حَيْثُ أَرَاهُ اللَّهُ عَزَّ وَجَلَّ.

12905 - أَخْبَرَنَا أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحُسَيْنِ، وَأَبُو زَكَرِيَّا يَحْيَى بْنُ إِبْرَاهِيمَ قَالَا: حَدَّثَنَا أَبُو الْعَبَّاسِ الْأَصَمُّ، أَخْبَرَنَا الرَّبِيعُ بْنُ سُلَيْمَانَ، أَخْبَرَنَا الشَّافِعِيُّ قَالَ: سَمِعْتُ ابْنَ عُيَيْنَةَ، يُحَدِّثُ عَنِ الزُّهْرِيِّ، أَنَّهُ سَمِعَ مَالِكَ بْنَ أَوْسِ بْنِ الْحَدَثَانِ، يَقُولُ: سَمِعْتُ عُمَرَ بْنَ الْخَطَّابِ، وَالْعَبَّاسَ، وَعَلِيَّ بْنَ أَبِي طَالِبٍ، يَخْتَصِمَانِ إِلَيْهِ فِي أَمْوَالِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ عُمَرُ: كَانَتْ أَمْوَالُ بَنِي النَّضِيرِ مِمَّا أَفَاءَ اللَّهُ عَلَى رَسُولِهِ مِمَّا لَمْ يُوجِفْ عَلَيْهِ الْمُسْلِمُونَ بِخَيْلٍ وَلَا رِكَابٍ، فَكَانَتْ لِرَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ خَالِصَةً دُونَ الْمُسْلِمِينَ، فَكَانَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يُنْفِقُ مِنْهَا عَلَى أَهْلِهِ نَفَقَةَ سَنَةٍ، فَمَا فَضَلَ جَعَلَهُ فِي الْكُرَاعِ وَالسِّلَاحِ عُدَّةً فِي سَبِيلِ اللَّهِ، ثُمَّ تُوُفِّي رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَوَلِيَهَا أَبُو بَكْرٍ الصِّدِّيقُ بِمِثْلِ مَا وَلِيَهَا بِهِ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ وَلِيتُهَا بِمِثْلِ مَا وَلِيَهَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَأَبُو بَكْرٍ الصِّدِّيقُ، ثُمَّ سَأَلْتُمَانِي أَنْ أُولِّيَكُمَاهَا، فَوَلَّيْتُكُمَاهَا، عَلَى أَنْ تَعْمَلَا فِيهِ بِمِثْلِ مَا وَلِيَهَا بِهِ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ وَلِيَهَا بِهِ أَبُو بَكْرٍ، ثُمَّ وَلِيتُهَا بِهِ [ص:214]، فَجِئْتُمَانِي تَخْتَصِمَانِ، أَتُرِيدَانِ أَنْ أَدْفَعَ إِلَى كُلِّ وَاحِدٍ مِنْكُمَا نِصْفًا؟ أَتُرِيدَانِ مِنِّي قَضَاءً؟ أَتُرِيدَانِ غَيْرَ مَا قَضَيْتُ بِهِ بَيْنَكُمَا أَوَّلًا، فَلَا وَالَّذِي بِإِذْنِهِ تَقُومُ السَّمَوَاتُ وَالْأَرْضُ، لَا أَقْضِي بَيْنَكُمَا قَضَاءً غَيْرَ ذَلِكَ، فَإِنْ عَجَزْتُمَا عَنْهَا فَادْفَعَاهَا إِلَيَّ أَكْفِيكُمَاهَا ".

الْعَبَّاسَ، وَعَلِيَّ بْنَ أَبِي طَالِبٍ، يَخْتَصِمَانِ إِلَيْهِ فِي أَمْوَالِ النَّبِيِّ ← عُمَرَ بْنِ الْخَطَّابِ، ← مَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ، ← الزهري أنه ← ابْنُ عُيَيْنَةَ، ← الشَّافِعِیُّ ← الرَّبِيعُ بْنُ سُلَيْمَانَ، ← أَبُو الْعَبَّاسِ الْأَصَمُّ ← أبو زكريا يحيى بن إبراهيم، ← أَبُو بَكْرٍ أَحْمَدُ بْنُ الْحُسَيْنِ

12906 - قَالَ الشَّافِعِيُّ: فَقَالَ لِي سُفْيَانُ: لَمْ أَسْمَعْهُ مِنَ الزُّهْرِيِّ، وَلَكِنْ أَخْبَرَنِيهِ عَمْرُو بْنُ دِينَارٍ، عَنِ الزُّهْرِيِّ، قُلْتُ: كَمَا قَصَصْتَ؟ قَالَ: نَعَمْ.

نَعَمْ ← الزُّهْرِيِّ، قُلْتُ: كَمَا قَصَصْتَ؟ ← لِي سُفْيَانُ: لَمْ أَسْمَعْهُ مِنَ الزُّهْرِيِّ، وَلَكِنْ أَخْبَرَنِيهِ عَمْرُو بْنُ دِينَارٍ، ← الشَّافِعِیُّ

12909 - قَالَ الشَّافِعِيُّ: وَقَدْ مَضَى مَنْ كَانَ يُنْفِقُ عَلَيْهِ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فَلَمْ أَعْلَمْ أَنَّ أَحَدًا مِنْ أَهْلِ الْعِلْمِ قَالَ لِوَرَثَتِهِمْ تِلْكَ النَّفَقَةُ الَّتِي كَانَتْ لَهُمْ، وَلَا خِلَافَ فِي أَنْ يُجْعَلَ تِلْكَ النَّفَقَاتُ حَيْثُ كَانَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَجْعَلُ فُضُولَ غَلَّاتِ تِلْكَ الْأَمْوَالِ مِمَّا فِيهِ صَلَاحُ الْإِسْلَامِ وَأَهْلِهِ
