أَخْبَرَنَا الثِّقَةُ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، عَنْ جُبَيْرِ بْنِ مُطْعِمٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَ مَعْنَاهُ. قَالَ الشَّافِعِيُّ: فَذَكَرْتُ ذَلِكَ لِمُطَرِّفِ بْنِ مَازِنٍ: أَنَّ يُونُسَ وَابْنَ إِسْحَاقَ رَوَيَا حَدِيثِ ابْنِ شِهَابٍ، عَنِ ابْنِ الْمُسَيِّبِ، قَالَ: حَدَّثَنَا مَعْمَرٌ كَمَا وَصَفْتُ، فَلَعَلَّ ابْنَ شِهَابٍ رَوَاهُ عَنْهُمَا مَعًا

أَخْبَرَنَا الثِّقَةُ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ الْمُسَيِّبِ، عَنْ جُبَيْرِ بْنِ مُطْعِمٍ، قَالَ: قَسَمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ سَهْمَ ذِي الْقُرْبَى بَيْنَ بَنِي هَاشِمٍ وَبَنِي الْمُطَّلِبِ وَلَمْ يُعْطِ مِنْهُ أَحَدًا مِنْ بَنِي عَبْدِ شَمْسٍ وَلا بَنِي نَوْفَلٍ شَيْئًا.

أَخْبَرَنَا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ، عَنْ مَطَرٍ الْوَرَّاقِ وَرَجُلٍ لَمْ يُسَمِّهِ، كِلاهُمَا عَنِ الْحَكَمِ بْنِ عُتَيْبَةَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى، قَالَ: لَقِيتُ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ عِنْدَ أَحْجَارِ الزَّيْتِ، فَقُلْتُ لَهُ: بِأَبِي وَأُمِّي مَا فَعَلَ أَبُو بَكْرٍ وَعُمَرُ رَضِيَ اللَّهُ عَنْهُمَا فِي حَقِّكُمْ أَهْلَ الْبَيْتِ مِنَ الْخُمُسِ؟ فَقَالَ: عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: أَمَّا أَبُو بَكْرٍ، رَحِمَهُ اللَّهُ، فَلَمْ يَكُنْ فِي زَمَانِهِ أَخْمَاسٌ، وَمَا كَانَ فَقَدْ أَوْفَانَاهُ. وَأَمَّا عُمَرُ رَضِيَ اللَّهُ عَنْهُ فَلَمْ يَزَلْ يُعْطِينَاهُ حَتَّى جَاءَهُ مَالُ السُّوسِ وَالأَهْوَازِ، أَوْ قَالَ: الأَهْوَازِ، أَوْ قَالَ: فَارِسَ، أَنَا أَشُكُّ، يَعْنِي الشَّافِعِيَّ، فَقَالَ: فِي حَدِيثِ مَطَرٍ أَوْ حَدِيثِ الآخَرِ، فَقَالَ: فِي الْمُسْلِمِينَ خَلَّةٌ، فَإِنْ أَحْبَبْتُمْ تَرَكْتُمْ حَقَّكُمْ فَجَعَلْنَاهُ فِي خَلَّةِ الْمُسْلِمِينَ حَتَّى يَأْتِيَنَا مَالٌ فَنُوَفِّيكُمْ حَقَّكُمْ مِنْهُ، فَقَالَ الْعَبَّاسُ لِعَلِيٍّ: أَتُطْمِعُهُ فِي حَقِّنَا، فَقُلْتُ لَهُ: يَا أَبَا الْفَضْلِ أَلَسْنَا أَحَقَّ مَنْ أَجَابَ أَمِيرَ الْمُؤْمِنِينَ وَرَفَعَ خَلَّةَ الْمُسْلِمِينَ؟ فَتُوُفِّيَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ قَبْلَ أَنْ يَأْتِيَهُ مَالٌ فَيَقْضِينَاهُ. وَقَالَ: الْحَكَمُ فِي حَدِيثِ مَطَرٍ وَالآخَرِ: إِنَّ عُمَرَ قَالَ: لَكُمْ حَقٌّ: وَلا يَبْلُغُ عِلْمِي إِذْ كَثُرَ أَنْ يَكُونَ لَكُمْ كُلُّهُ فَإِنْ شِئْتُمْ أَعْطَيْتُكُمْ مِنْهُ بِقَدَرِ مَا أَرَى لَكُمْ، فَأَبَيْنَا عَلَيْهِ إِلا كُلَّهُ فَأَبَى أَنْ يُعْطِيَنَا.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَعَثَ سَرِيَّةً فِيهَا عَبْدُ اللَّهِ بْنُ عُمَرَ قِبَلَ نَجْدٍ، فَغَنِمُوا إِبِلا كَثِيرَةً فَكَانَتْ سُهْمَانُهُمُ اثْنَيْ عَشَرَ بَعِيرًا أَوْ أَحَدَ عَشَرَ بَعِيرًا، ثُمَّ نُفِّلُوا بَعِيرًا بَعِيرًا. أَخْرَجَهُ مِنْ كِتَابِ قِسْمَةِ الْفَيْءِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ: عُرِضْتُ عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَامَ أُحُدٍ، وَأَنَا ابْنُ أَرْبَعَ عَشْرَةَ سَنَةً فَرَدَّنِي، ثُمَّ عُرِضْتُ عَلَيْهِ عَامَ الْخَنْدَقِ وَأَنَا ابْنُ خَمْسَ عَشْرَةَ سَنَةً فَأَجَازَنِي قَالَ نَافِعٌ: فَحَدَّثْتُ بِهَذَا الْحَدِيثِ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ، فَقَالَ: هَذَا فَرْقٌ بَيْنَ الْمُقَاتِلَةِ وَالذُّرِّيَّةِ، وَكَتَبَ أَنْ يَفْرِضَ لابْنِ خَمْسَ عَشْرَةَ فِي الْمُقَاتِلَةِ، وَمَنْ لَمْ يَبْلُغْهَا فِي الذُّرِّيَّةِ. أَخْرَجَهُ مِنْ كِتَابِ قِسْمَةِ الْفَيْءِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: وَسَمِعْتُ ابْنَ عُيَيْنَةَ يُحَدِّثُ، عَنِ الزُّهْرِيِّ: أَنَّهُ سَمِعَ مَالِكَ بْنَ أَوْسِ بْنِ الْحَدَثَانِ، يَقُولُ: سَمِعْتُ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، وَالْعَبَّاسَ، وَعَلِيَّ بْنَ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُمَا يَخْتَصِمَانِ إِلَيْهِ فِي أَمْوَالِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ عُمَرُ: كَانَتْ أَمْوَالُ بَنِي النَّضِيرِ مِمَّا أَفَاءَ اللَّهُ عَلَى رَسُولِهِ مِمَّا لَمْ يُوجِفْ عَلَيْهِ الْمُسْلِمُونَ بِخَيْلٍ وَلا رِكَابٍ، فَكَانَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَالِصًا دُونَ الْمُسْلِمِينَ، فَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يُنْفِقُ مِنْهَا عَلَى أَهْلِهِ نَفَقَةَ سَنَةٍ، فَمَا فَضَلَ جَعَلَهُ فِي الْكُرَاعِ وَالسِّلاحِ عُدَّةً فِي سَبِيلِ اللَّهِ تَعَالَى، ثُمَّ تُوُفِّيَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَوَلِيَهَا أَبُو بَكْرٍ الصِّدِّيقُ رَضِيَ اللَّهُ عَنْهُ بِمِثْلِ مَا وَلِيَهَا بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ثُمَّ وَلِيتُهَا بِمِثْلِ مَا وَلِيَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَبُو بَكْرٍ، ثُمَّ سَأَلْتُمَانِي أَنْ أُولِيكُمَاهَا فَوَلَّيْتُكُمَاهَا عَلَى أَنْ تَعْمَلا فِيهِ بِمِثْلِ مَا وَلِيَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَبُو بَكْرٍ ثُمَّ وَلِيتُهَا فَجِئْتُمَانِي تَخْتَصِمَانِ أَتُرِيدَانِ أَنْ أَدْفَعَ إِلَى كُلِّ وَاحِدٍ مِنْكُمَا نِصْفًا؟ أَتُرِيدَانِ مِنِّي قَضَاءَ غَيْرِ مَا قَضَيْتُ بِهِ بَيْنَكُمَا أَوَّلا؟ فَلا وَالَّذِي بِإِذْنِهِ تَقُومُ السَّمَوَاتُ وَالأَرْضُ، لا أَقْضِي بَيْنَكُمَا قَضَاءً غَيْرَ ذَلِكَ، فَإِنْ عَجَزْتُمَا عَنْهَا فَادْفَعَاهَا إِلَيَّ أَكْفِكُمَاهَا. قَالَ الشَّافِعِيُّ: فَقَالَ لِي سُفْيَانُ: لَمْ أَسْمَعْهُ مِنَ الزُّهْرِيِّ، وَلَعَلَّ أَخْبَرَنِيهِ عَمْرُو بْنُ دِينَارٍ، عَنِ الزُّهْرِيِّ. قُلْتُ: كَمَا قَصَصْتَ؟ قَالَ: نَعَمْ. أَخْرَجَهُ مِنْ كِتَابِ قِسْمَةِ الْفَيْءِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ رَضِيَ اللَّهُ عَنْهُ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَوْ جَاءَنِي مَالُ الْبَحْرَيْنِ أَعْطَيْتُكَ هَكَذَا وَهَكَذَا» . فَتُوُفِّيَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَمْ يَأْتِهِ، فَجَاءَ أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ، فَأَعْطَانِي حِينَ جَاءَهُ. قَالَ الرَّبِيعُ: بَقِيَّةُ الْحَدِيثِ حَدَّثَنِي غَيْرُ الشَّافِعِيِّ مِنْ قَوْلِهِ: «لَوْ جَاءَنِي. . .» . أَخْرَجَهُ مِنْ كِتَابِ قِسْمَةِ الْفَيْءِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ يَزِيدَ بْنِ هُرْمُزَ: أَنَّ نَجْدَةَ كَتَبَ إِلَى ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا: هَلْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَغْزُو بِالنِّسَاءِ؟ وَهَلْ كَانَ يَضْرِبُ لَهُنَّ بِسَهْمٍ؟ فَقَالَ: قَدْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَغْزُو بِالنِّسَاءِ فَيُدَاوِينَ الْجَرْحَى، وَلَمْ يَكُنْ يُضْرَبُ لَهُنَّ بِسَهْمٍ، وَلَكِنْ يُحْذَيْنَ مِنَ الْغَنِيمَةِ.

أَخْبَرَنَا حَاتِمُ بْنُ إِسْمَاعِيلَ، عَنْ جَعْفَرٍ، يَعْنِي: ابْنَ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ يَزِيدَ بْنِ هُرْمُزَ: أَنَّ نَجْدَةَ كَتَبَ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنْ خِلالٍ. فَقَالَ ابْنُ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ: إِنَّ نَاسًا يَقُولُونَ: إِنَّ ابْنَ عَبَّاسٍ يُكَاتِبُ الْحَرُورِيَّةَ، وَلَوْلا أَنِّي أَخَافُ أَنْ أَكْتُمَ عِلْمًا لَمْ أَكْتُبْ إِلَيْهِ، فَكَتَبَ نَجْدَةُ إِلَيْهِ: أَمَّا بَعْدُ، فَأَخْبِرْنِي هَلْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَغْزُو بِالنِّسَاءِ؟ وَهَلْ كَانَ يَضْرِبُ لَهُنَّ بِسَهْمٍ؟ وَهَلْ كَانَ يَقْتُلُ الصِّبْيَانَ؟ وَمَتَى يَنْقَضِي يُتْمُ الْيَتِيمِ؟ وَعَنِ الْخُمُسِ لِمَنْ هُوَ؟ فَكَتَبَ إِلَيْهِ ابْنُ عَبَّاسٍ: إِنَّكَ كَتَبْتَ إِلَيَّ تَسْأَلُنِي: هَلْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَغْزُو بِالنِّسَاءِ؟ وَقَدْ كَانَ يَغْزُو بِهِنَّ فَيُدَاوِينَ الْمَرْضَى وَيُحْذَيْنَ مِنَ الْغَنِيمَةِ. وَأَمَّا السَّهْمُ فَلَمْ يَضْرِبْ لَهُنَّ بِسَهْمٍ، وَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمْ يَقْتُلِ الْوِلْدَانَ فَلا تَقْتُلْهُمْ، إِلا أَنْ تَكُونَ تَعْلَمُ مِنْهُمْ مَا عَلِمَ الْخَضِرُ مِنَ الصَّبِيِّ الَّذِي قُتِلَ فَتُمَيِّزَ بَيْنَ الْمُؤْمِنِ وَالْكَافِرِ، فَتَقْتُلَ الْكَافِرَ وَتَدَعَ الْمُؤْمِنَ وَكَتَبْتَ مَتَى يَنْقَضِي يُتْمُ الْيَتِيمِ؟ وَلَعَمْرِي إِنَّ الرَّجُلَ لَتَشِيبُ لِحْيَتُهُ وَإِنَّهُ لَضَعِيفُ الأَخْذِ ضَعِيفُ الإِعْطَاءِ، فَإِذَا أَخَذَ لِنَفْسِهِ مِنْ صَالِحِ مَا يَأْخُذُ النَّاسُ فَقَدْ ذَهَبَ عَنْهُ الْيُتْمُ. وَكَتَبْتَ تَسْأَلُنِي عَنِ الْخُمُسِ، وَإِنَّا نَقُولُ هُوَ لَنَا، فَأَبَى ذَلِكَ عَلَيْنَا قَوْمُنَا فَصَبَرْنَا عَلَيْهِ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ الْجِزْيَةِ، وَهُوَ أَوَّلُ حَدِيثٍ فِيهِ، وَالثَّانِي مِنْ كِتَابِ الأُسَارَى والْغُلُولِ.
