أَخْبَرَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ عَمْرِو بْنِ أَوْسٍ الثَّقَفِيِّ، عَنْ رَجُلٍ مِنْ ثَقِيفٍ: أَنَّهُ سَمِعَ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ يَقُولُ: لَوِ اسْتَطَعْتُ لَجَعَلْتُهَا حَيْضَةً وَنِصْفًا، فَقَالَ رَجُلٌ: فَاجْعَلْهَا شَهْرًا وَنِصْفًا. فَسَكَتَ عُمَرُ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ ابْنِ الْمُسَيِّبِ وَسُلَيْمَانَ بْنِ يَسَارٍ: أَنَّ طُلَيْحَةَ كَانَتْ تَحْتَ رُشَيْدٍ الثَّقَفِيِّ فَطَلَّقَهَا أَلْبَتَّةَ، فَنَكَحَتْ فِي عِدَّتِهَا. فَضَرَبَهَا عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ وَضَرَبَ زَوْجَهَا بِالْمِخْفَقَةِ ضَرَبَاتٍ، وَفَرَّقَ بَيْنَهُمَا، ثُمَّ قَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: أَيُّمَا امْرَأَةٍ نَكَحَتْ فِي عِدَّتِهَا، فَإِنْ كَانَ زَوْجُهَا الَّذِي تَزَوَّجَهَا لَمْ يَدْخُلْ بِهَا، فُرِّقَ بَيْنَهُمَا، ثُمَّ اعْتَدَّتْ بَقِيَّةَ عِدَّتِهَا مِنْ زَوْجِهَا الأَوَّلِ، وَكَانَ خَاطِبًا مِنَ الْخُطَّابِ، وَإِنْ كَانَ دَخَلَ بِهَا فُرِّقَ بَيْنَهُمَا ثُمَّ اعْتَدَّتْ بَقِيَّةَ عِدَّتِهَا مِنَ الأَوَّلِ، ثُمَّ اعْتَدَّتْ مِنَ الآخَرِ ثُمَّ لَمْ يَنْكِحْهَا أَبَدًا. قَالَ سَعِيدٌ: وَلَهَا مَهْرُهَا بِمَا اسْتَحَلَّ مِنْهَا.

أَخْبَرَنَا يَحْيَى بْنُ حَسَّانٍ، عَنْ جَرِيرٍ، عَنْ عَطَاءِ بْنِ السَّائِبِ، عَنْ زَاذَانَ أَبِي عُمَرَ، عَنْ عَلِيٍّ، أَنَّهُ قَضَى فِي الَّتِي تَزَوَّجُ فِي عِدَّتِهَا أَنْ يُفَرَّقَ بَيْنَهُمَا، وَلَهَا الصَّدَاقُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا، وَتُكْمِلُ مَا أَفْسَدَتْ مِنْ عِدَّةٍ، وَتَعْتَدُّ مِنَ الآخَرِ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْعِدَدِ.

أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ رَبِّهِ بْنِ سَعِيدِ بْنِ قَيْسٍ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، قَالَ: سُئِلَ ابْنُ عَبَّاسٍ وَأَبُو هُرَيْرَةَ عَنِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا وَهِيَ حَامِلٌ، فَقَالَ ابْنُ عَبَّاسٍ: آخِرَ الأَجَلَيْنِ، وَقَالَ أَبُو هُرَيْرَةَ: إِذَا وَلَدَتْ فَقَدْ حَلَّتْ. فَدَخَلَ أَبُو سَلَمَةَ عَلَى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَهَا عَنْ ذَلِكَ، فَقَالَتْ: وَلَدَتْ سُبَيْعَةُ الأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِنِصْفِ شَهْرٍ. فَدَخَلَ أَبُو سَلَمَةَ عَلَى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَهَا عَنْ ذَلِكَ، فَقَالَتْ: وَلَدَتْ سُبَيْعَةُ الأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِنِصْفِ شَهْرٍ.

أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ: أَنَّ ابْنَ عَبَّاسٍ وَأَبَا سَلَمَةَ اخْتَلَفَا فِي الْمَرْأَةِ تَنْفَسُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ، فَقَالَ ابْنُ عَبَّاسٍ: آخِرَ الأَجَلَيْنِ، وَقَالَ أَبُو سَلَمَةَ: إِذَا نَفِسَتْ فَقَدْ حَلَّتْ. قَالَ: فَجَاءَ أَبُو هُرَيْرَةَ، فَقَالَ: أَنَا مَعَ ابْنِ أَخِي، يَعْنِي: أَبَا سَلَمَةَ، فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ، فَسَأَلَهَا عَنْ ذَلِكَ، فَجَاءَهُمْ فَأَخْبَرَهُمْ أَنَّهَا قَالَتْ: وَلَدَتْ سُبَيْعَةُ الأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ، فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَهَا: «قَدْ حَلَلْتِ فَانْكِحِي» .

أَخْبَرَنَا مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ: أَنَّ سُبَيْعَةَ الأَسْلَمِيَّةَ نَفِسَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ، فَجَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَاسْتَأْذَنَتْهُ فِي أَنْ تَنْكِحَ فَأَذِنَ لَهَا.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا سَعِيدُ بْنُ سَالِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرٍ أَخْبَرَهُ، أَنَّ رَجُلا مِنَ الأَنْصَارِ، يُقَالُ لَهُ: حَبَّانُ بْنُ مُنْقِذٍ طَلَّقَ امْرَأَتَهُ وَهُوَ صَحِيحٌ، وَهِيَ تُرْضِعُ ابْنَتَهُ فَمَكَثَتْ سَبْعَةَ عَشَرَ شَهْرًا لا تَحِيضُ، يَمْنَعُهَا الرَّضَاعُ أَنْ تَحِيضَ ثُمَّ مَرِضَ حَبَّانُ بَعْدَ أَنْ طَلَّقَهَا بِسَبْعَةِ أَشْهُرٍ أَوْ ثَمَانِيَةِ أَشْهُرٍ، فَقُلْتُ لَهُ: إِنَّ امْرَأَتَكَ تُرِيدُ أَنْ تَرِثَ. فَقَالَ لأَهْلِهِ: احْمِلُونِي إِلَى عُثْمَانَ رَضِيَ اللَّهُ عَنْهُ، فَحَمَلُوهُ إِلَيْهِ، فَذَكَرَ لَهُ شَأْنَ امْرَأَتِهِ وَعِنْدَهُ عَلِيُّ بْنُ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ وَزَيْدُ بْنُ ثَابِتٍ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ لَهُمَا عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ: مَا تَرَيَانِ؟ فَقَالا: نَرَى أَنَّهَا تَرِثُهُ إِنْ مَاتَ، وَيَرِثُهَا إِنْ مَاتَتْ، فَإِنَّهَا لَيْسَتْ مِنَ الْقَوَاعِدِ اللَّاتِي قَدْ يَئِسْنَ مِنَ الْمَحِيضِ، وَلَيْسَتْ مِنَ الأَبْكَارِ الَّلاتِي لَمْ يَبْلُغْنَ الْمَحِيضَ، ثُمَّ هِيَ عَلَى عِدَّةِ حَيْضِهَا مَا كَانَ مِنْ قَلِيلٍ أَوْ كَثِيرٍ، فَرَجَعَ حَبَّانُ إِلَى أَهْلِهِ وَأَخَذَ ابْنَتَهُ، فَلَمَّا فَقَدَتِ الرَّضَاعَ حَاضَتْ حَيْضَةً ثُمَّ حَاضَتْ حَيْضَةً أُخْرَى ثُمَّ تُوُفِّيَ حَبَّانُ قَبْلَ أَنْ تَحِيضَ الثَّالِثَةَ، فَاعْتَدَّتْ عِدَّةَ الْمُتَوَفَّى عَنْهَا وَوَرِثَتْهُ. قَالَ: فِي كِتَابٍ فِي حَبَّانَ بْنِ مُنْقِذٍ بِالْبَاءِ.
