أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ يَزِيدَ بْنِ أَبِي زِيَادٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى، عَنِ ابْنِ عُمَرَ، قَالَ: بَعَثَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي سَرِيَّةٍ فَلَقُوا الْعَدُوَّ فَحَاصَ النَّاسُ حَيْصَةً، فَأَتَيْنَا الْمَدِينَةَ فَفَتَحْنَا بَابَهَا، وَقُلْنَا: يَا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَيْكَ نَحْنُ الْفَارُّونَ، قَالَ: «بَلْ أَنْتُمُ الْكَارُّونَ وَأَنَا فِئَتُكُمْ» . أَخْرَجَهُ مِنْ كِتَابِ الْجِزْيَةِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا الثِّقَةُ، عَنْ مُحَمَّدِ بْنِ أَبَانٍ، عَنْ عَلْقَمَةَ بْنِ مَرْثَدٍ، عَنْ سُلَيْمَانَ بْنِ بُرَيْدَةَ، عَنْ أَبِيهِ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ إِذَا بَعَثَ جَيْشًا أَمَّرَ عَلَيْهِمْ أَمِيرًا، وَقَالَ: «فَإِذَا لَقِيتَ عَدُوًّا مِنَ الْمُشْرِكِينَ فَادْعُهُمْ إِلَى ثَلاثِ خِلالٍ أَوْ ثَلاثِ خِصَالٍ، شَكَّ عَلْقَمَةُ، ادْعُهُمْ إِلَى الإِسْلامِ، فَإِنْ أَجَابُوكَ فَاقْبَلْ مِنْهُمْ وَكُفَّ عَنْهُمْ ثُمَّ ادْعُهُمْ إِلَى التَّحَوُّلِ مِنْ دَارِهِمْ إِلَى دَارِ الْمُهَاجِرِينَ، فَأَخْبِرْهُمْ إِنْ هُمْ فَعَلُوا أَنَّ لَهُمْ مَا لِلْمُهَاجِرِينَ، وَأَنَّ عَلَيْهِمْ مَا عَلَيْهِمْ فَإِنِ اخْتَارُوا الْمُقَامَ فِي دَارِهِمْ أَنَّهُمْ كَأَغْرَابِ الْمُسْلِمِينَ يَجْرِي عَلَيْهِمْ حُكْمُ اللَّهِ كَمَا يَجْرِي عَلَى الْمُسْلِمِينَ، وَلَيْسَ لَهُمْ فِي الْفَيْءِ شَيْءٌ إِلا أَنْ يُجَاهِدُوا مَعَ الْمُسْلِمِينَ، فَإِنْ لَمْ يُجِيبُوكَ فَادْعُهُمْ إِلَى أَنْ يُعْطَوُا الْجِزْيَةَ عَنْ يَدٍ وَهُمْ صَاغِرُونَ، فَإِنْ فَعَلُوا فَاقْبَلْ مِنْهُمْ وَدَعْهُمْ، فَإِنْ أَبَوْا فَاسْتَعِنْ بِاللَّهِ تَعَالَى وَقَاتِلْهُمْ» .

أَخْبَرَنَا الثَّقَفِيُّ، عَنْ حُمَيْدٍ، عَنْ أَنَسٍ، قَالَ: حَاصَرْنَا تُسْتَرَ فَنَزَلَ الْهُرْمُزَانُ عَلَى حُكْمِ عُمَرَ، فَقَدِمْتُ بِهِ عَلَى عُمَرَ، فَلَمَّا انْتَهَيْنَا إِلَيْهِ قَالَ لَهُ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: تَكَلَّمْ، قَالَ: كَلامَ حَيٍّ أَوْ كَلامَ مَيِّتٍ، قَالَ: تَكَلَّمْ، لا بَأْسَ. قَالَ: إِنَّا وَإِيَّاكُمْ مَعْشَرَ الْعَرَبِ مَا خَلَّى اللَّهُ بَيْنَنَا وَبَيْنَكُمْ، وَكُنَّا نَتَعَبَّدُكُمْ وَنَقْتُلُكُمْ وَنُغْضِبُكُمْ، فَلَمَّا كَانَ اللَّهُ مَعَكُمْ لَمْ تَكُنْ لَنَا بِكُمْ يَدَانِ. فَقَالَ عُمَرُ: مَا تَقُولُ؟ . فَقُلْتُ: يَا أَمِيرَ الْمُؤْمِنِينَ، تَرَكْتُ بَعْدِي عَدُوًّا كَثِيرًا وَشَوْكَةً شَدِيدَةً، فَإِنْ قَتَلْتَهُ يَيْئَسِ الْقَوْمُ الْحَيَاةَ، وَيَكُنْ أَشَدَّ لِشَوْكَتِهِمْ. فَقَالَ عُمَرُ: أَسْتَحْيِي قَاتِلَ الْبَرَاءِ بْنِ مَالِكٍ وَمَجْزَأَةَ بْنِ ثَوْرٍ، فَلَمَّا خَشِيتُ أَنْ يَقْتُلَهُ قُلْتُ لَهُ: لَيْسَ إِلَى قَتْلِهِ سَبِيلٌ، قَدْ قُلْتَ لَهُ: تَكَلَّمْ لا بَأْسَ، فَقَالَ عُمَرُ: ارْتَشَيْتَ وَأَصَبْتَ مِنْهُ. فَقُلْتُ: وَاللَّهِ مَا ارْتَشَيْتُ وَلا أَصَبْتُ مِنْهُ، قَالَ: لِتَأْتِيَنِّي عَلَى مَا شَهِدْتَ بِهِ بِغَيْرِكَ، أَوْ لأَبْدَأَنَّ بِعُقُوبَتِكَ. قَالَ: فَخَرَجْتُ فَلَقِيتُ الزُّبَيْرَ بْنَ الْعَوَّامِ، فَشَهِدَ مَعِي، وَأَمْسَكَ عُمَرُ، وَأَسْلَمَ وَفَرَضَ لَهُ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الأُسَارَى والْغُلُولِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ، عَنْ حُمَيْدٍ، عَنْ أَنَسٍ، قَالَ: سَارَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَى خَيْبَرَ، فَانْتَهَى إِلَيْهَا لَيْلا وَكَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذَا طَرَقَ قَوْمًا لَمْ يُغِرْ عَلَيْهِمْ حَتَّى يُصْبِحَ، فَإِنْ سَمِعَ أَذَانًا أَمْسَكَ، وَإِنْ لَمْ يَكُونُوا يُصَلُّونَ أَغَارَ عَلَيْهِمْ حِينَ يُصْبِحُ، فَلَمَّا أَصْبَحَ رَكِبَ، وَرَكِبَ الْمُسْلِمُونَ، وَخَرَجَ أَهْلُ الْقَرْيَةِ، وَمَعَهُمْ مَكَاتِلُهُمْ وَمَسَاحِيهِمْ، فَلَمَّا رَأَوْا رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، قَالُوا: مُحَمَّدٌ وَالْخَمِيسُ. قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «اللَّهُ أَكْبَرُ خَرِبَتْ خَيْبَرُ، إِنَّا إِذًا نَزَلْنَا بِسَاحَةِ قَوْمٍ فَسَاءَ صَبَاحُ الْمُنْذَرِينَ» . قَالَ أَنَسٌ: وَإِنِّي لَرَدِيفُ أَبِي طَلْحَةَ، وَإِنَّ قَدَمِي لَتَمَسُّ قَدَمَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ. أَخْرَجَهُ مِنْ كِتَابِ الأُسَارَى والْغُلُولِ.
