أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ: أَنَّ عُمَرَ رَضِيَ اللَّهُ عَنْهُ قَتَلَ نَفَرًا خَمْسَةً أَوْ سَبْعَةً بِرَجُلٍ قَتَلُوهُ قَتْلَ غِيلَةٍ، وَقَالَ عُمَرُ: لَوْ تَمَالأَ عَلَيْهِ أَهْلُ صَنْعَاءَ لَقَتَلَهُمْ جَمِيعًا. أَخْرَجَهُ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ.

أَخْبَرَنَا الشَّافِعِيُّ فِي كِتَابِهِ، قَالَ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ هِشَامٍ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: يَا عَائِشَةُ، أَمَا عَلِمْتِ أَنَّ اللَّهَ تَعَالَى أَفْتَانِي فِي أَمْرٍ اسْتَفْتَيْتُهُ فِيهِ، وَقَدْ كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَكَثَ كَذَا وَكَذَا يُخَيَّلُ إِلَيْهِ أَنَّهُ يَأْتِي النِّسَاءَ وَلا يَأْتِيهِنَّ، أَتَانِي رَجُلانِ فَجَلَسَ أَحَدُهُمَا عِنْدَ رِجْلَيَّ، وَالآخَرُ عِنْدَ رَأْسِي، فَقَالَ الَّذِي عِنْدَ رِجْلَيَّ لِلَّذِي عِنْدَ رَأْسِي: مَا بَالُ الرَّجُلِ؟ قَالَ: مَطْبُوبٌ. قَالَ: وَمَنْ طَبَّهُ؟ قَالَ: لَبِيدُ بْنُ أَعْصَمَ. قَالَ: وَفِيمَ؟ قَالَ: فِي جُفِّ طَلْعَةٍ ذَكَرٍ فِي مُشْطٍ وَمُشَاقَةٍ تَحْتَ رُعُوفَةٍ أَوْ عُوفَةٍ، شَكَّ رَبِيعٌ، فِي بِئْرِ ذَرْوَانَ ". قَالَ: فَجَاءَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: «هَذِهِ الَّتِي أُرِيتُهَا كَأَنَّ رُءُوسَ نَخْلِهَا رُءُوسُ الشَّيَاطِينِ، وَكَأَنَّ مَاءَهَا نُقَاعَةُ الْحِنَّاءِ» . فَأَمَرَ بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأُخْرِجَ، قَالَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا: فَقُلْتُ يَا رَسُولَ اللَّهِ فَهَلا، قَالَ سُفْيَانُ، يَعْنِي: تَنَشَّرْتَ، قَالَتْ عَائِشَةُ: فَقَالَ: «أَمَّا اللَّهُ فَقَدْ شَفَانِي، وَأَكْرَهُ أَنْ أُثِيرَ عَلَى النَّاسِ مِنْهُ شَرًّا» . قَالَ: وَلَبِيدُ بْنُ أَعْصَمَ رَجُلٌ مِنْ بَنِي زُرَيْقٍ حَلِيفٌ لِيَهُودَ. أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ مِنْ كِتَابِ الطَّعَامِ وَالشَّرَابِ وَعِمَارَةِ الأَرْضِينَ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ.

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ أَيُّوبَ بْنِ أَبِي تَمِيمَةَ، عَنْ عِكْرِمَةَ، قَالَ: لَمَّا بَلَغَ ابْنَ عَبَّاسٍ أَنَّ عَلِيًّا رَضِيَ اللَّهُ عَنْهُمَا حَرَّقَ الْمُرْتَدِّينَ أَوِ الزَّنَادِقَةَ قَالَ: لَوْ كُنْتُ أَنَا لَمْ أُحْرِقْهُمْ وَلَقَتَلْتُهُمْ؛ لِقَوْلِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ بَدَّلَ دِينَهُ فَاقْتُلُوهُ» ، وَلَمْ أُحْرِقْهُمْ؛ لِقَوْلِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لا يَنْبَغِي لأَحَدٍ أَنْ يُعَذِّبَ بِعَذَابِ اللَّهِ» .

أَخْبَرَنَا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ: أَنَّ عَلِيًّا رَضِيَ اللَّهُ عَنْهُ قَالَ فِي ابْنِ مُلْجَمٍ بَعْدَ مَا ضَرَبَهُ: أَطْعِمُوهُ وَاسْقُوهُ وَأَحْسِنُوا إِسَارَهُ، فَإِنْ عِشْتُ فَأَنَا وَلِيُّ دَمِي أَعْفُو إِنْ شِئْتُ، وَإِنْ شِئْتُ اسْتَقَدْتُ، وَإِنْ مِتُّ فَقَتَلْتُمُوهُ فَلا تُمَثِّلُوا. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ قِتَالِ الْمُشْرِكِينَ، وَالثَّانِيَ مِنْ كِتَابِ الأُسَارَى والْغُلُولِ، وَالثَّالِثَ مِنْ كِتَابِ قِتَالِ أَهْلِ الْبَغْيِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ: وُجِدَ فِي قَائِمِ سَيْفِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كِتَابٌ: «إِنَّ أَعْدَى النَّاسِ عَلَى اللَّهِ سُبْحَانَهُ وَتَعَالَى الْقَاتِلُ غَيْرَ قَاتِلِهِ، وَالضَّارِبُ غَيْرَ ضَارِبِهِ، وَمَنْ تَوَلَّى غَيْرَ مَوَالِيهِ فَقَدْ كَفَرَ بِمَا أَنْزَلَ اللَّهُ سُبْحَانَهُ عَلَى مُحَمَّدٍ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ» .

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، قَالَ: قُلْتُ لأَبِي جَعْفَرٍ مُحَمَّدِ بْنِ عَلِيٍّ: مَا كَانَ فِي الصَّحِيفَةِ الَّتِي كَانَتْ فِي قِرَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: كَانَ فِيهَا: «لَعَنَ اللَّهُ الْقَاتِلَ غَيْرَ قَاتِلِهِ، وَالضَّارِبَ غَيْرَ ضَارِبِهِ، وَمَنْ تَوَلَّى غَيْرَ وَلِيِّ نِعْمَتِهِ فَقَدْ كَفَرَ بِمَا أَنْزَلَ اللَّهُ تَعَالَى عَلَى مُحَمَّدٍ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ» . أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ.

أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ عَبْدِ الْمَلِكِ بْنِ سَعِيدِ بْنِ أَبْجَرَ، عَنْ إِيَادِ بْنِ لَقِيطٍ، عَنْ أَبِي رِمْثَةَ، قَالَ: دَخَلْتُ مَعَ أَبِي عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَرَأَى أَبِي الَّذِي بِظَهْرِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: دَعْنِي أُعَالِجُ الَّذِي بِظَهْرِكَ فَإِنِّي طَبِيبٌ، قَالَ: «أَنْتَ رَفِيقٌ» ، وَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ هَذَا مَعَكَ» ؟ فَقَالَ: ابْنِي. قَالَ: «اشْهَدْ بِهِ» ، قَالَ: «أَمَا إِنَّهُ لا يَجْنِي عَلَيْكَ وَلا تَجْنِي عَلَيْهِ» . أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ أَحْكَامِ الْقُرْآنِ، وَالثَّانِيَ مِنْ كِتَابِ جِرَاحِ الْعَمْدِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مُحَمَّدُ بْنُ الْحَسَنِ، قَالَ: أَنْبَأَنَا إِبْرَاهِيمُ بْنُ مُحَمَّدٍ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْبَيْلَمَانِيِّ: أَنَّ رَجُلا مِنَ الْمُسْلِمِينَ قَتَلَ رَجُلا مِنْ أَهْلِ الذِّمَّةِ، فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «أَنَا أَحَقُّ مَنْ وَفَّى بِذِمَّتِهِ» ، ثُمَّ أَمَرَ بِهِ فَقُتِلَ.
