أَخْبَرَنَا غَيْرُ وَاحِدٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: الْقَطْعُ فِي رُبُعِ دِينَارٍ فَصَاعِدًا.

أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، عَنْ عَمْرَةَ بِنْتِ عَبْدِ الرَّحْمَنِ: أَنَّهَا قَالَتْ: خَرَجَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا إِلَى مَكَّةَ شَرَّفَهَا اللَّهُ تَعَالَى وَمَعَهَا مَوْلاتَانِ وَغُلامٌ لابْنِ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرٍ، فَبَعَثَتْ مَعَ مَوْلاتَيْنِ بِبُرْدٍ مُرَجَّلٍ قَدْ خِيطَتْ عَلَيْهِ خِرْقَةٌ خَضْرَاءُ. قَالَتْ: فَأَخَذَ الْغُلامُ الْبُرْدَ فَفَتَقَ عَنْهُ فَاسْتَخْرَجَهُ وَجَعَلَ مَكَانَهُ لِبْدًا أَوْ فَرْوَةً، وَخَاطَ عَلَيْهِ، فَلَمَّا قَدِمَتِ الْمَوْلاتَانِ الْمَدِينَةَ دَفَعَتَا ذَلِكَ إِلَى أَهْلِهِ، فَلَمَّا فَتَقُوا عَنْهُ وَجَدُوا فِيهِ اللِّبْدَ وَلَمْ يَجِدُوا فِيهِ الْبُرْدَ، فَكَلَّمُوا الْمَوْلاتَيْنِ فَكَلَّمَتَا عَائِشَةَ زَوْجَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَطَعَتْ يَدَهُ، وَقَالَتْ عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا: الْقَطْعُ فِي رُبُعِ دِينَارٍ فَصَاعِدًا.

أَخْبَرَنَا مَالِكٌ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، عَنْ أَبِيهِ: أَنَّ رَجُلا مِنْ أَهْلِ الْيَمَنِ أَقْطَعَ الْيَدِ وَالرِّجْلِ، قَدِمَ عَلَى أَبِي بَكْرٍ الصِّدِّيقِ رَضِيَ اللَّهُ عَنْهُ، فَشَكَا إِلَيْهِ أَنَّ عَامِلَ الْيَمَنِ ظَلَمَهُ، وَكَانَ يُصَلِّي مِنَ اللَّيْلِ، فَيَقُولُ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: وَأَبِيكَ مَا لَيْلُكَ بِلَيْلِ سَارِقٍ. ثُمَّ إِنَّهُمُ افْتَقَدُوا حُلِيًّا لأَسْمَاءَ بِنْتِ عُمَيْسٍ، امْرَأَةِ أَبِي بَكْرٍ رَضِيَ اللَّهُ عَنْهُ، فَجَعَلَ الرَّجُلُ يَطُوفُ مَعَهُمْ، وَيَقُولُ: اللَّهُمَّ عَلَيْكَ بِمَنْ بَيَّتَ أَهْلَ هَذَا الْبَيْتِ الصَّالِحِ، فَوَجَدُوا الْحُلِيَّ عِنْدَ صَائِغٍ، وَأَنَّ الأَقْطَعَ جَاءَ بِهِ فَاعْتَرَفَ الأَقْطَعُ أَوْ شَهِدَ عَلَيْهِ، فَأَمَرَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ، فَقُطِعَتْ يَدُهُ الْيُسْرَى. وَقَالَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ: وَاللَّهِ لَدُعَاؤُهُ عَلَى نَفْسِهِ أَشَدُّ عِنْدِي مِنْ سَرِقَتِهِ. أَخْرَجَ السِّتَّةَ الأَحَادِيثَ مِنْ كِتَابِ الْقَطْعِ فِي السَّرِقَةِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ صَفْوَانَ بْنِ عَبْدِ اللَّهِ بْنِ صَفْوَانَ: أَنَّ صَفْوَانَ بْنَ أُمَيَّةَ، قِيلَ لَهُ: مَنْ لَمْ يُهَاجِرْ هَلَكَ. فَقَدِمَ صَفْوَانُ الْمَدِينَةَ، فَنَامَ فِي الْمَسْجِدِ مُتَوَسِّدًا رِدَاءَهُ. فَجَاءَ سَارِقٌ فَأَخَذَ رِدَاءَهُ مِنْ تَحْتِ رَأْسِهِ فَأَخَذَ صَفْوَانُ السَّارِقَ فَجَاءَ بِهِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَمَرَ بِهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَطَعَ يَدَهُ، فَقَالَ: إِنِّي لَمْ أُرِدْ هَذَا، هُوَ عَلَيْهِ صَدَقَةٌ. فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فَهَلا قَبْلَ أَنْ تَأْتِيَنِي بِهِ» .

أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ طَاوُسٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِثْلَ حَدِيثِ مَالِكٍ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الْقَطْعِ وَالسَّرِقَةِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ يَحْيَى بْنِ عَبْدِ الرَّحْمَنِ بْنِ حَاطِبٍ: أَنَّ رَقِيقًا لِحَاطِبٍ سَرَقُوا نَاقَةً لِرَجُلٍ مِنْ مُزَيْنَةَ فَانْتَحَرُوهَا، فَرُفِعَ ذَلِكَ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَأَمَرَ كَثِيرَ بْنَ الصَّلْتِ أَنْ يَقْطَعَ أَيْدِيَهُمْ، ثُمَّ قَالَ عُمَرُ: إِنِّي أَرَاكَ تُجِيعُهُمْ، وَاللَّهِ لأُغَرِّمَنَّكَ غُرْمًا يَشُقُّ عَلَيْكَ، ثُمَّ قَالَ لِلْمُزَنِيِّ: كَمْ ثَمَنُ نَاقَتِكَ؟ قَالَ: أَرْبَعُ مِائَةِ دِرْهَمٍ. قَالَ عُمَرُ: أَعْطِهِ ثَمَانَ مِائَةِ دِرْهَمٍ.

أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ: أَنَّ عَبْدًا لَهُ سَرَقَ وَهُوَ آبِقٌ، فَأَبَى سَعِيدُ بْنُ الْعَاصِ أَنْ يَقْطَعَهُ فَأَمَرَ بِهِ ابْنُ عُمَرَ فَقُطِعَتْ يَدُهُ. أَخْرَجَ الْحَدِيثَيْنِ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ السَّائِبِ بْنِ يَزِيدَ: أَنَّ عُبَيْدَ اللَّهِ بْنَ عَمْرٍو الْحَضْرَمِيَّ جَاءَ بِغُلامٍ لَهُ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ لَهُ: اقْطَعْ يَدَ هَذَا؛ فَإِنَّهُ سَرَقَ، فَقَالَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ: فِي مَاذَا سَرَقَ؟ قَالَ: سَرَقَ مِرْآةً لامْرَأَتِي ثَمَنُهَا سِتُّونَ دِرْهَمًا. فَقَالَ لَهُ عُمَرُ رَضِيَ اللَّهُ عَنْهُ: أَرْسِلْهُ لَيْسَ عَلَيْهِ قَطْعٌ، خَادِمُكُمْ سَرَقَ مَتَاعَكُمْ. أَخْرَجَهُ فِي كِتَابِ اخْتِلافِ مَالِكٍ وَالشَّافِعِيِّ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ أَبِي حُسَيْنٍ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: «لا قَطْعَ فِي ثَمَرٍ مُعَلَّقٍ فَإِذَا آوَاهُ الْجَرِينُ فَفِيهِ الْقَطْعُ» .

أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حِبَّانَ، عَنْ عَمِّهِ وَاسِعِ بْنِ حِبَّانَ، أَنَّ رَافِعَ بْنَ خَدِيجٍ أَخْبَرَهُ: أَنَّهُ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «لا قَطْعَ فِي ثَمَرٍ وَلا كَثَرٍ» .

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا إِبْرَاهِيمُ بْنُ أَبِي يَحْيَى، عَنْ جَعْفَرٍ، عَنْ أَبِيهِ، عَنْ عَلِيِّ بْنِ حُسَيْنٍ، قَالَ: لا وَاللَّهِ مَا سَمَلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَيْنًا وَلا زَادَ أَهْلَ اللِّقَاحِ عَلَى قَطْعِ أَيْدِيهِمْ وَأَرْجُلِهِمْ.
