مسند امام شافی #1563

أَخْبَرَنَا مَالِكٌ، عَنْ ثَوْرِ بْنِ زَيْدٍ الدِّيلِيِّ: أَنَّ عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ اسْتَشَارَ فِي الْخَمْرِ يَشْرَبُهَا الرَّجُلُ، فَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ رَضِيَ اللَّهُ عَنْهُ: نَرَى فِيهَا أَنْ يُجْلَدَ ثَمَانِينَ؛ فَإِنَّهُ إِذَا شَرِبَ سَكِرَ، وَإِذَا سَكِرَ هَذَى، وَإِذَا هَذَى افْتَرَى، أَوْ كَمَا قَالَ: فَجَلَدَهُ عُمَرُ رَضِيَ اللَّهُ عَنْهُ ثَمَانِينَ فِي الْخَمْرِ. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ الأَشْرِبَةِ.

أَخْبَرَنَا مُسْلِمُ بْنُ خَالِدٍ الزَّنْجِيُّ، عَنْ يَحْيَى بْنِ جُرَيْجٍ، قَالَ: قُلْتُ لِعَطَاءٍ: أَيُجْلَدُ فِي رِيحِ الشَّرَابِ؟ فَقَالَ عَطَاءٌ: إِنَّ الرِّيحَ لَتَكُونُ مِنَ الشَّرَابِ الَّذِي فِيهِ بَأْسٌ، فَإِذَا اجْتَمَعُوا جَمِيعًا عَلَى شَرَابٍ وَاحِدٍ فَسَكِرَ أَحَدُهُمْ جُلِدُوا جَمِيعًا الْحَدَّ تَامًّا. قَالَ الشَّافِعِيُّ: وَقَوْلُ عَطَاءٍ مِثْلُ قَوْلِ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُمَا لا يُخَالِفُهُ.

أَخْبَرَنَا مَالِكٌ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ، عَنْ أَبِي هُرَيْرَةَ. وَعَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ: أَنَّهُمَا أَخْبَرَاهُ: أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ أَحَدُهُمَا: يَا رَسُولَ اللَّهِ، اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ، وَقَالَ الآخَرُ وَهُوَ أَفْقَهُهُمَا: أَجَلْ يَا رَسُولَ اللَّهِ، فَاقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ، وَائْذَنْ لِي فِي أَنْ أَتَكَلَّمَ، قَالَ: «تَكَلَّمْ» ، قَالَ: إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا، فَزَنَا بِامْرَأَتِهِ، فَأُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ، فَافْتَدَيْتُ مِنْهُ بِمَائَةِ شَاةٍ وَبِجَارِيَةٍ لِي، ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ، وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " وَالَّذِي نَفْسِي بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ تَعَالَى: أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ إِلَيْكَ "، وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا، وَأَمَرَ أُنَيْسًا الأَسْلَمِيَّ أَنْ يَأْتِيَ امْرَأَةَ الآخَرِ، فَإِنِ اعْتَرَفَتْ رَجَمَهَا، فَاعْتَرَفَتْ فَرَجَمَهَا.
