It was narrated from ‘Amrah that ‘Aishah told her that the Messenger of Allah صلی اللہ علیہ وآلہ وسلم was with her, and she heard a man asking permission to enter Hafsah’s house. ‘Aishah said: “I said: ‘Messenger of Allah صلی اللہ علیہ وآلہ وسلم, there is a man asking permission to enter your house.’ The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: ‘I think it is so-and-so the paternal uncle of Hafsah through breast- feeding.’ ‘Aishah said: ‘If so-and-so (her own paternal uncle through breast-feeding) were alive, would he be allowed to enter upon me?’ The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: ‘What becomes unlawful (for marriage) through breast-feeding is that which becomes unlawful through birth.” (Sahih)

They acquired female prisoners who had husbands among the idolaters. The Muslims felt reluctant to be intimate with them. Then Allah, the Mighty and Sublime revealed: “Also (forbidden are) women already married, except those (slaves) whom your right hands possess, meaning, this is permissible for you once they have completed their ‘Iddah. She should have a dowry like that of her peers and no less, with no injustice, and she may inherit from him, and she has to observe the ‘Iddah.’ A man from A stood up and said: ‘The Messenger of Allah صلی اللہ علیہ وآلہ وسلم passed a similar judgment among us concerning a woman called Birwa’ bint Washiq. She married a man who died before consummating the marriage with her, and the Messenger of Allah صلی اللہ علیہ وآلہ وسلم ruled that she should be given a dowry like that of her peers, and she could inherit, and she had to observe the ‘Iddah.’ ‘Abdullah raised his hands and said the Takbir.” (Sahih) AbtI ‘Abdur-Rahman (An-Nasá’I) said: I do not know anyone who said “Al-Aswad” in this Hadith, other than Za’idah.

It was narrated from ‘Abdullah that some people came to him and said: “A man among us married a woman, but he did not name a dowry for her, and he did not have intercourse with her before he died. ‘Abduliah said: ‘Since I left the Messenger of Allah صلی اللہ علیہ وآلہ وسلمI have never been asked a more difficult question than this. Go to someone else.’ They kept coming to him for a month, then at the end of that they said: ‘Who shall we ask if we do not ask you? You are one of the most prominent Companions of Muhammadin this land and we cannot find anyone else.’ He said: ‘I will say what I think, and if it is correct then it is from Allah alone, with no partner, and if it is wrong then it is from me and from the Shaifan, and Allah and His Messenger have nothing to do with it. I think that she should be given a dowry like that of her peers and no less, with no injustice, and she may inherit from him, and she has to observe the ‘k/dali, four months and ten days.” He said: “And that was heard by some people from Ashja’, who stood up and said: ‘We bear witness that you have passed the same judgment as the Messenger of Allah صلی اللہ علیہ وآلہ وسلم did concerning a woman from among us who was called Birwa’ bint Washiq.” He said: “Abdullah was never seen looking so happy as he did on that day, except with having accepted Islam.” (Sahih).

Aishah said: Barirah came seeking my help to purchase her freedom. She said: I have arranged with my people to buy my freedom for nine 'uqiyahs: one to be paid annually. So help me. She (Aishah) said: If your people are willing that I should count them ('uqiyahs) out to them all at one time and set you free and that I shall have the right to inherit from you, I shall do so. She then went to her people. The narrator then transmitted the rest of the tradition like the version of al-Zuhri. He added to the wordings of the Prophet ﷺ in the last: What is the matter with people that one of you says: Set free, O so-and-so, and the right of inheritance belongs to me. The right of inheritance belongs to the one who has set a person free.
