122 حدثنا تمتام قال ثنا بندار محمد بن بشار قال ثنا ابن أبي عدي عن شعبة عن الأعمش بإسناده بهذا الحديث وقال فيه ( رجل على فضل ماء بالطريق ) وقال فيه أيضا ( ورجل أقام سلعة بعد العصر في سوق المدينة أو بالبقيع فحلف لقد منعها من كذا وكذا فجاء رجل فرغب فيها فأخذها ) ورواه عمرو الناقد عن ابن عيينة عن عمرو عن أبي صالح عن أبي هريرة أراه مرفوعا بهذا وقال فيه ( رجل حلف على يمين بعد العصر على مال المسلم فاقتطعه ) - * 7 بيان التشديد في الذي يقتل نفسه وفي لعن المؤمن وأخذ ماله والدليل على أن القاتل إذا مات بغير توبة لم ينفعه إسلامه واجتهاده ويخلد في نار جهنم وأن من قتل على المعصية استوجب بمعصيته النار ولا يكون ذلك كفارة معصيته وبيان إباحة قتل من تعمد لقتاله وأنه إن قتل على منع ماله منه فهو شهيد وبيان أن الجنة لا يدخلها إلا المؤمنون وأنه لا فرق بين الإيمان والإسلام - *
