5221 حدثنا إسحاق بن الجراح الأذني والحارث بن أبي أسامة وعمار بن رجاء قالوا ثنا يزيد بن هارون قال أنبا يحيى بن سعيد أن أبا بكر بن محمد أخبره عن عمر بن عبد العزيز عن أبي بكر بن عبد الرحمن بن الحارث بن هشام عن أبي هريرة أن النبي صلى الله عليه وسلم قال ( أيما رجل أفلس فوجد رجل متاعه عنده بعينه فهو أحق به من الغرماء ) إلا أن عمار قال به من غيره

5224 حدثنا أبو الأزهر وعمار بن رجاء قالا ثنا وهب بن جرير قثنا أبي عن قتادة بإسناده أن النبي صلى الله عليه وسلم قال ( إذا أفلس الرجل فوجد رجل متاعه بعينه أو قال سلعته ) مثله وقالا فهو أحق به من الغرماء - * باب ذكر الخبر الدال على أن الرجل إذا باع من رجل سلعة فوجده مفلسا كان له نقض بيعها وأخذها منه ما كره المشتري فعله أو لم يكره - *
