4739 حدثنا الصغاني قثنا علي بن الجعد قثنا صخر بن جويرية عن نافع عن ابن عمر أنه كان يفتي إن العبد أو الأمة يكون أحدهم بين شركاء فأعتق أحدهم نصيبه منه فإنه يجب عتقه على الذي أعتق نصيبه منه يقوم في ماله قيمة عدل فيدفع بقية ثمنه إلى شركائه أنصباءهم منه ويخلى سبيل المعتق - * 4 بيان الخبر الدال على أن المعتق نصيبه من عبد منه بينه وبين شركائه يجبر على عتق نصيب غيره وعلى بيع ماله ودفع قيمة نصيب غيره من العبد إليه إن كان له مال - *
