أَخْبَرَنَا الرَّبِيعُ، قَالَ: أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا أَنَسُ بْنُ عِيَاضٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا أَنَّهَا حَدَّثَتْهُ: أَنَّ هِنْدَ أُمَّ مُعَاوِيَةَ جَاءَتْ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَتْ: يَا رَسُولَ اللَّهِ، إِنَّ أَبَا سُفْيَانَ رَجُلٌ شَحِيحٌ، وَإِنَّهُ لا يُعْطِينِي مَا يَكْفِينِي وَوَلَدِي إِلا مَا أَخَذْتُ مِنْهُ سِرًّا وَهُوَ لا يَعْلَمُ، فَهَلْ عَلَيَّ فِي ذَلِكَ مِنْ شَيْءٍ؟ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «خُذِي مَا يَكْفِيكِ وَوَلَدَكِ بِالْمَعْرُوفِ» .

أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، أَنَّ هِنْدَ بِنْتَ عُتْبَةَ أَتَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَتْ: يَا رَسُولَ اللَّهِ، إِنَّ أَبَا سُفْيَانَ رَجُلٌ شَحِيحٌ وَلَيْسَ لِي مِنْهُ إِلا مَا يُدْخِلُ عَلَيَّ. فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «خُذِي مَا يَكْفِيكِ وَوَلَدَكِ بِالْمَعْرُوفِ» .

أَخْبَرَنَا سُفْيَانُ، عَنْ مُحَمَّدِ بْنِ عَجْلانَ، عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ: جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَ: يَا رَسُولَ اللَّهِ، عِنْدِي دِينَارٌ، قَالَ: «أَنْفِقْهُ عَلَى نَفْسِكَ» . قَالَ: عِنْدِي آخَرُ. قَالَ: «أَنْفِقْهُ عَلَى وَلَدِكَ» . قَالَ: عِنْدِي آخَرُ. قَالَ: «أَنْفِقْهُ عَلَى أَهْلِكَ» ، قَالَ: عِنْدِي آخَرُ. قَالَ: «أَنْفِقْهُ عَلَى خَادِمِكَ» . قَالَ: عِنْدِي آخَرُ. قَالَ: عِنْدِي آخَرُ. قَالَ سَعِيدٌ: ثُمَّ يَقُولُ أَبُو هُرَيْرَةَ إِذَا حَدَّثَ بِهَذَا الْحَدِيثِ: يَقُولُ وَلَدُكَ: أَنْفِقْ عَلَيَّ إِلَى مَنْ تَكِلُنِي؟ تَقُولُ زَوْجَتُكَ: أَنْفِقْ عَلَيَّ أَوْ طَلِّقْنِي، يَقُولُ خَادِمُكَ: أَنْفِقْ عَلَيَّ أَوْ بِعْنِي.

جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ فَقَالَ: ← أَبِي هُرَيْرَةَ، ← سَعِيدِ بْنِ أَبِي سَعِيدٍ، ← مُحَمَّدِ بْنِ عَجْلَانَ، ← سُفْيَانَ،

أَخْبَرَنَا سُفْيَانُ، عَنْ أَبِي الزِّنَادِ، قَالَ: سَأَلْتُ سَعِيدَ بْنَ الْمُسَيِّبِ عَنِ الرَّجُلِ لا يَجِدُ مَا يُنْفِقُ عَلَى امْرَأَتِهِ قَالَ: يُفَرَّقُ بَيْنَهُمَا. قَالَ أَبُو الزِّنَادِ: قُلْتُ سُنَّةٌ، فَقَالَ سَعِيدٌ: سُنَّةٌ. قَالَ الشَّافِعِيُّ: وَالَّذِي يُشْبِهُ قَوْلَ سَعِيدٍ: سُنَّةٌ، أَنْ تَكُونَ سُنَّةَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ.

أَخْبَرَنَا مُسْلِمٌ، عَنِ ابْنِ جُرَيْجٍ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، سَمِعَهُ يَقُولُ: تَزَوَّجَ عَقِيلُ بْنُ أَبِي طَالِبٍ فَاطِمَةَ بِنْتَ عُتْبَةَ. فَقَالَتْ لَهُ: اصْبِرْ لِي وَأُنْفِقُ عَلَيْكَ، وَكَانَ إِذَا دَخَلَ عَلَيْهَا تَقُولُ لَهُ: أَيْنَ عُتْبَةُ وَشَيْبَةُ؟ فَسَكَتَ عَنْهَا، فَدَخَلَ يَوْمًا بَرِمًا، فَقَالَتْ: أَيْنَ عُتْبَةُ بْنُ رَبِيعَةَ وَأَيْنَ شَيْبَةُ بْنُ رَبِيعَةَ؟ فَقَالَ: عَلَى يَسَارِكِ فِي النَّارِ إِذَا دَخَلْتِ. فَشَدَّتْ عَلَيْهَا ثِيَابَهَا فَجَاءَتْ عُثْمَانَ بْنَ عَفَّانَ رَضِيَ اللَّهُ عَنْهُ فَذَكَرَتْ لَهُ ذَلِكَ فَأَرْسَلَ ابْنَ عَبَّاسٍ وَمُعَاوِيَةَ، فَقَالَ ابْنُ عَبَّاسٍ: لأُفَرِّقَنَّ بَيْنَهُمَا. وَقَالَ مُعَاوِيَةُ: مَا كُنْتُ لأُفَرِّقَ بَيْنَ شَيْخَيْنِ مِنْ بَنِي عَبْدِ مَنَافٍ. قَالَ: فَأَتَيَاهُمَا فَوَجَدَاهُمَا قَدْ شَدَّا عَلَيْهِمَا أَثْوَابَهُمَا فَأَصْلَحَا أَمْرَهُمَا.

أَخْبَرَنَا الثَّقَفِيُّ، عَنْ أَيُّوبَ، عَنِ ابْنِ سِيرِينَ، عَنْ عَبِيدَةَ أَنَّهُ قَالَ فِي هَذِهِ الآيَةِ: {وَإِنْ خِفْتُمْ شِقَاقَ بَيْنِهِمَا فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا} [النساء: 35] . قَالَ: جَاءَ رَجُلٌ وَامْرَأَةٌ إِلَى عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ، وَمَعَ كُلِّ وَاحِدٍ مِنْهُمَا فِئَامٌ مِنَ النَّاسِ، فَأَمَرَهُمْ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ فَبَعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا، ثُمَّ قَالَ لِلْحَكَمَيْنِ: تَدْرِيَانِ مَا عَلَيْكُمَا إِنْ رَأَيْتُمَا أَنْ تَجْمَعَا وَإِنْ رَأَيْتُمَا أَنْ تُفَرِّقَا، قَالَ: قَالَتِ الْمَرْأَةُ: رَضِيتُ بِكِتَابِ اللَّهِ بِمَا عَلَيَّ فِيهِ وَلِي. وَقَالَ الرَّجُلُ: أَمَّا الْفُرْقَةُ فَلا، فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: كَذَبْتَ وَاللَّهِ حَتَّى تُقِرَّ بِمِثْلِ الَّذِي أَقَرَّتْ بِهِ.

أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: كَانَتْ بِنْتُ مُحَمَّدِ بْنِ مَسْلَمَةَ عِنْدَ رَافِعِ بْنِ خَدِيجٍ، فَكَرِهَ مِنْهَا شَيْئًا إِمَّا كِبْرًا وَإِمَّا غَيْرَهُ فَأَرَادَ أَنْ يُطَلِّقَهَا فَقَالَتْ: لا تُطَلِّقْنِي وَأَنَا أَحِلُّ لَكَ. فَنَزَلَ فِي ذَلِكَ: {وَإِنِ امْرَأَةٌ خَافَتْ مِنْ بَعْلِهَا نُشُوزًا أَوْ إِعْرَاضًا} [النساء: 128] الآيَةَ. قَالَ: فَمَضَتْ بِذَلِكَ السُّنَّةُ.أَخْرَجَ الثَّلاثَةَ الأَحَادِيثَ مِنْ كِتَابِ الْخُلْعِ وَالنُّشُوزِ وَالرَّابِعَ مِنْ كِتَابِ النِّكَاحِ مِنَ الإِمْلاءِ.

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ، عَنْ إِيَاسِ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي ذُبَابٍ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لا تَضْرِبُوا إِمَاءَ اللَّهِ» ، قَالَ: فَأَتَاهُ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: يَا رَسُولَ اللَّهِ، ذَئِرَ النِّسَاءُ عَلَى أَزْوَاجِهِنَّ، فَأَذِنَ فِي ضَرْبِهِنَّ. فَأَطَافَ بِآلِ مُحَمَّدٍ نِسَاءٌ كَثِيرٌ، كُلُّهُنَّ يَشْكُونَ أَزْوَاجَهُنَّ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لَقَدْ أَطَافَ بِآلِ مُحَمَّدٍ سَبْعُونَ امْرَأَةً، كُلُّهُنَّ يَشْتَكِينَ أَزْوَاجَهُنَّ، وَلا تَجِدُونَ أُولَئِكَ خِيَارَكُمْ» . أَخْرَجَهُ مِنْ كِتَابِ الْخُلْعِ وَالنُّشُوزِ

إِيَاسِ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي ذُبَابٍ، ← عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ. ← الزُّهْرِيِّ، ← ابْنُ عُيَيْنَةَ، ← الشَّافِعِیُّ

أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا ابْنُ عُيَيْنَةَ، عَنْ زِيَادِ بْنِ سَعِيدٍ، قَالَ أَبُو مُحَمَّدٍ، أَظُنُّهُ، عَنْ هِلالِ بْنِ أَبِي مَيْمُونَةَ، عَنْ أَبِي مَيْمُونَةَ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ: أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَيَّرَ غُلامًا بَيْنَ أَبِيهِ وَأُمِّهِ.
