أَخْبَرَنَا مُحَمَّدُ بْنُ رَافِعٍ قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ قَالَ أَنْبَأَنَا مَعْمَرٌ عَنْ صَالِحِ بْنِ کَيْسَانَ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنْ ابْنِ عَبَّاسٍ عَنْ النَّبِيِّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَيْسَ لِلْوَلِيِّ مَعَ الثَّيِّبِ أَمْرٌ وَالْيَتِيمَةُ تُسْتَأْمَرُ فَصَمْتُهَا إِقْرَارُهَا
سنن نسائی · Hadith 3271
It was narrated from Ibn ‘Abbas that the Prophet صلی اللہ علیہ وآلہ وسلم said: “The guardian has no right (to force) the previously married woman (into a marriage). And an orphan girl should be consulted, and her silence is her approval.” (Sahih)
