حَدَّثَنَا يَزِيدُ أَخْبَرَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ عِكْرِمَةَ بْنِ خَالِدٍ الْمَخْزُومِيِّ عَنِ ابْنِ عُمَرَ أَنَّ رَجُلًا اشْتَرَى نَخْلًا قَدْ أَبَّرَهَا صَاحِبُهَا فَخَاصَمَهُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ الثَّمَرَةَ لِصَاحِبِهَا الَّذِي أَبَّرَهَا إِلَّا أَنْ يَشْتَرِطَ الْمُشْتَرِي
مسند امام احمد بن حنبل · Hadith 4852
It was narrated from Ibn 'Umar that a man bought a date palm tree that had been pollinated by its owner. The dispute was referred to the prophet (PBUH) and the Messenger of Allah (PBUH) ruled that the produce of the palm tree belongs to the one who pollinated it, unless the buyer stipulates otherwise.
