حَدَّثَنَا سُفْيَانُ عَنْ عَمْرٍو عَنْ إِسْمَاعِيلَ الشَّيْبَانِيِّ بِعْتُ مَا فِي رُءُوسِ نَخْلِي بِمِائَةِ وَسْقٍ إِنْ زَادَ فَلَهُمْ وَإِنْ نَقَصَ فَلَهُمْ فَسَأَلْتُ ابْنَ عُمَرَ فَقَالَ نَهَى عَنْهُ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَرَخَّصَ فِي الْعَرَايَا
مسند امام احمد بن حنبل · Hadith 4590
It was narrated from 'Arm, from Ismaa'eel ash-Shaybaani who said: I sold what was at the top of my palm trees for one hundred wasqs and if there was more than that, it would be theirs (the buyers') and if there was less than that then it would be their loss Then I asked Ibn 'Umar (about that) and he said: The Messenger of Allah (PBUH) forbade that, but he granted a concession allowing ' araayah [1].
