أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، أَنَّ بِنْتَ عُبَيْدِ اللَّهِ بْنِ عُمَرَ وَأُمَّهَا بِنْتَ زَيْدِ بْنِ الْخَطَّابِ كَانَتْ تَحْتَ ابْنٍ لِعَبْدِ اللَّهِ بْنِ عُمَرَ، فَمَاتَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يُسَمِّ لَهَا صَدَاقًا، فَاتَّبَعَتْ أُمُّهَا صَدَاقَهَا، فَقَالَ ابْنُ عُمَرَ: لَيْسَ لَهَا صَدَاقٌ، وَلَوْ كَانَ لَهَا صَدَاقٌ لَمْ نَمْنَعْكُمُوهُ وَلَمْ نَظْلِمْهَا، فَأَبَتْ أَنْ تَقْبَلَ ذَلِكَ، فَجَعَلَ بَيْنَهُمْ زَيْدَ بْنَ ثَابِتٍ، فَقَضَى أَنَّ لا صَدَاقَ لَهَا وَلَهَا الْمِيرَاثُ. أَخْرَجَ الأَوَّلَ مِنْ كِتَابِ اخْتِلافِ عَلِيٍّ وَعَبْدِ اللَّهِ مِمَّا لَمْ يَسْمَعِ الرَّبِيعُ مِنَ الشَّافِعِيِّ، وَالثَّانِيَ مِنْ كِتَابِ الصَّدَاقِ وَالإِيلاءِ.
