قَالَ الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ فِي كِتَابِهِ: أَخْبَرَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنْ عَطَاءِ بْنِ السَّائِبِ، عَنْ عَبْدِ خَيْرٍ، عَنْ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ ثُمَّ يَمُوتُ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ لَهَا صَدَاقًا أَنَّ لَهَا الْمِيرَاثَ وَعَلَيْهَا الْعِدَّةُ وَلا صَدَاقَ لَهَا.
مسند امام شافی · Hadith 1307
Shafei may Allah be pleased with him in his book, said: Tell us Sufian bin appointment, from Ata ibn Saa'ib, Abd good, Ali may Allah be pleased with him in a man marries a woman and then die and did not come out and did not impose her dowry to her inheritance and preparing them and Friendship her.
