أَخْبَرَنَا الشَّافِعِيُّ رَضِيَ اللَّهُ عَنْهُ، قَالَ: أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ: كَانَ ابْنُ عُمَرَ يَقُولُ: إِذَا مَلَّكَ الرَّجُلُ امْرَأَتَهُ، فَالْقَضَاءُ مَا قَضَتْ إِلا أَنْ يُنَاكِرَهَا الرَّجُلُ، فَيَقُولَ: لَمْ أُرِدْ إِلا تَطْلِيقَةً وَاحِدَةً فَيَحْلِفُ عَلَى ذَلِكَ، وَيَكُونُ أَمْلَكَ لَهَا مَا كَانَتْ فِي عِدَّتِهَا.
مسند امام شافی · Hadith 1286
Tell us Shafei may Allah be pleased with him, said: Tell us the owner, Nafie: was the son of Omar says: If the king of the man his wife, Eradicating the ruled but Anala man, he says: I did not want only Ttliqh one Faihlv on it, and have I own her what was promised .
