أَخْبَرَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ بُكَيْرٍ، عَنِ ابْنِ أَبِي عَيَّاشٍ: أَنَّهُ كَانَ جَالِسًا مَعَ عَبْدِ اللَّهِ بْنِ الزُّبَيْرِ وَعَاصِمِ بْنِ عُمَرَ قَالَ: فَجَاءَهُمَا مُحَمَّدُ بْنُ إِيَاسِ بْنِ الْبُكَيْرِ، فَقَالَ: إِنَّ رَجُلا مِنْ أَهْلِ الْبَادِيَةِ طَلَّقَ امْرَأَتَهُ ثَلاثًا قَبْلَ أَنْ يَدْخُلَ بِهَا فَمَاذَا تَرَيَانِ؟ فَقَالَ ابْنُ الزُّبَيْرِ: إِنَّ هَذَا الأَمْرَ مَا لَنَا فِيهِ قَوْلٌ، اذْهَبْ إِلَى ابْنِ عَبَّاسٍ وَأَبِي هُرَيْرَةَ، فَإِنِّي تَرَكْتُهُمَا عِنْدَ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا فَسَلْهُمَا ثُمَّ ائْتِنَا فَأَخْبِرْنَا، فَذَهَبَ فَسَأَلَهُمَا. قَالَ ابْنُ عَبَّاسٍ لأَبِي هُرَيْرَةَ: أَفْتِهِ يَا أَبَا هُرَيْرَةَ، فَقَدْ جَاءَتْكَ مُعْضِلَةٌ. فَقَالَ أَبُو هُرَيْرَةَ: الْوَاحِدَةُ تَبُتُّهَا، وَالثَّلاثُ تُحَرِّمُهَا حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ. وَقَالَ ابْنُ عَبَّاسٍ مِثْلَ ذَلِكَ. قَالَ الشَّافِعِيُّ: وَلَمْ يَعِبَا عَلَيْهِ الثَّلاثَ وَلا عَائِشَةُ رَضِيَ اللَّهُ عَنْهَا. أَخْرَجَ الْحَدِيثَيْنِ مِنْ كِتَابِ إِبَاحَةِ الطَّلاقِ، وَإِلَى آخِرِ الْخَامِسِ مِنْ كِتَابِ أَحْكَامِ الْقُرْآنِ.

Tell us the owner, Yahya ibn Said from Bakir, Ibn Abi Ayyash: he was sitting with Abdullah ibn al-Zubayr and Asim bin Omar said: Fjahma Mohammed bin Illes bin Bakar, said: The man of the people of the desert divorces his wife three times before it enters the What do you see? Ibn Abbas said like that. Al-Shafi’i said: He did not care about the three nor did he live in a family that God was pleased with.
